General Terms and Conditions of Use for Yandex Go E-Scooters Services
PLEASE READ THESE GENERAL TERMS AND CONDITIONS CAREFULLY BEFORE USING THE SERVICES.
Yandex Go mobile application is intended for users – natural persons who are at least 18 years of age, who purchase the electric scooter rental service provided by MIKROMOBILNOST DOO BEOGRAD, a company registered for renting and leasing sports and recreational equipment (hereinafter referred to as the Rental Provider).
BY ASSESING THE YANDEX GO APPLICATION YOU ACKNOWLEDGE AND UNDERSTAND THAT RENTAL AND USE OF THE E-SCOOTER REQUIRES CERTAIN SKILLS AND COMPLINCE WITH RULES OF SAFE OPERATION OF THE E-SCOOTER FOR YOUR SAFETY AS WELL AS SAFETY OF THOSE AROUND AND THAT YOU ARE FAMILIAR WITH THE SPECIAL RULES FOR USING LIGHT ELECTRIC VEHICLES AS PRESCRIBED BY THE LAW ON ROAD TRAFFIC SAFETY
YOU UNDERSTAND THE RISK OF ADVERSE CONSEQUENCES FOR YOU AND/OR AS A RESULT OF NON-COMPLIANCE WITH RULES OF SAFE OPERATION OF E-SCOOTER.
These General Terms and Conditions (“Terms”) govern the access or use by you, an individual (“You” or “User”) to the Yandex Go application (information service that allows you to order a rental of E- scooters), as well as terms and conditions for rental of E-scooters. The term “Services” refers to Yandex Go E-Scooters Services provided through Yandex Go application. Services is made available in the Republic of Serbia through mobile application Yandex Go managed by Ridetech RS LLC Belgrade, a company duly incorporated under the laws of the Republic of Serbia, having its seat at Bulevar vojvode Bojovića 4g, Stari Grad, Belgrade, Serbia, TIN 112987561 (“Ridetech Serbia”).
Actual E-Scooters rental is made available to you not by Ridetech Serbia itself, but by its Service providers, i.e. Rental service provider that provide E-Scooter rental services and are acknowledged as operators of E-scooters in certain territory (“Partners”).

Rental agreement for the E-Scooters is concluded directly between User and the Rental service provider. Services made available to you by Ridetech Serbia is strictly limited to the provision of a technical platform (information service) that facilitates the rental process, and Ridetech Serbia does not act as a rental operator or rental service provider in the legal or practical sense. Ridetech Serbia does not own, lease, or operate the E-Scooters, and is not a party to rental agreement concluded between the User and the Rental service provider.
The following documents are incorporated into these Terms by reference:

- License agreement for Yandex Go mobile app https://yandexgo.com/legal/yandexgo_mobile_agreement/;
- Other terms and conditions communicated to User from time to time via App, email or otherwise.
Your access and use of the Service constitutes your agreement to be bound by these Terms, which establish a contractual relationship between you and Ridetech Serbia as well as between you and Rental service provider.
Rental of E-Scooter means your full consent to these Terms as well as other terms & conditions shown in the Yandex Go mobile app and applicable laws of Republic of Serbia in respect of the E-Scooters.
If you do not agree to these Terms, you may not access or use the Services.

SERVICES IS PROVIDED “AS IS” AND “AS AVAILABLE.” RIDETECH SERBIA OR ITS SERVICE PROVIDERS MAKE NO REPRESENTATIONS OR WARRANTIES, EITHER EXPRESS, IMPLIED, OR STATUTORY, EXCEPT AS EXPLICITLY STATED IN THESE TERMS. RIDETECH SERBIA DOES NOT GUARANTEE THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR AVAILABLE AT ALL TIMES. IN THE EVENT OF A SERVICE FAILURE OR DOWN TIME RIDETECH SERBIA WILL MAKE REASONABLE EFFORTS TO RESTORE THE PLATFORM’S FUNCTIONALITY, BUT SHALL NOT BE HELD LIABLE FOR ANY DAMAGES OR LOSSES ARISING FROM SUCH FAILURES. FURTHERMORE, RIDETECH SERBIA DISCLAIMS NO RESPONSIBILITY FOR THE RENTAL SERVICES, WHICH ARE PROVIDED EXCLUSIVELY BY ITS RENRAL SERVICE PROVIDERS (PARTNERS).
By accepting these Terms, the User fully releases RIDETECH SERBIA from any liability for damages that may arise from the use of the application, including any damages that in any way result from or are related to the use of the application.
The User also fully releases RIDETECH SERBIA from liability for any consequences resulting from the User's actions or omissions stemming from the use or misuse of the application's content, as well as for any damage that may be caused to the User or any third party in connection with the use or misuse of the application's content.
1. Definitions
1.1 Rental shall mean temporary and short-term transfer to the User of the rights to use the E-Scooter for its own benefit.
1.2. Traffic accident shall mean an event involving the E-Scooter, in which people were killed or injured, vehicles, structures, cargo were damaged, or other material damage was caused.
1.3. App shall mean Yandex Go mobile app for mobile devices whose functionality allows Users to use it subject to License Agreement for Yandex Go mobile app https://yandexgo.com/legal/yandexgo_mobile_agreement/.
1.4. Rental service providers or Rental service provider shall mean legal entities that provide E-Scooter Rental services and are acknowledged as operators as provided in the table above.
1.5. Traffic Rules shall mean Law of Traffic Safety on the Roads, Rulebook on the Classification of Motor and Trailer Vehicles and Technical Conditions for Vehicles in Road Traffic and other traffic laws and rules of Republic of Serbia applicable to E-Scooters Rental as amended and in effect at the time of the Rental.
1.6. Fee shall mean payment for the Rental and the cost of additional services to be paid by the User to the Rental service provider in accordance with these Terms. For avoidance of any doubt, Ridetech Serbia does not charge any fees for its information services.
1.7. E-Sсooter or E-Scooters shall mean Service provider's E-Scooters available for Rental by Users in accordance with these Terms via App.
1.8. Contractors shall mean Ridetech Serbia and Service provider(s) jointly, with Ridetech Serbia responsible for providing and operating the information service (platform that allows Rental) and Service provider(s) responsible for the actual Rental, including the availability, provision and maintenance of E-Scooters.
2. General rules for accessing the App and Rental
2.1. To access the App, the User must download it through Google Play or the App Store and register an account.
2.2. By downloading and installing the App, the User accepts all risks that may arise from its use and agrees to use the application's content solely for personal purposes and at their own risk.
2.3. The User agrees to take all necessary measures to prevent any third party from gaining access to the device on which the application is installed and further agrees not to allow any unauthorized person to access their personal account within the App.
2.4. Ridetech Serbia and the Service provider shall not be held liable for any damages resulting from the unauthorized use of mobile phones, computers, or other devices on which the web platform or mobile application is installed, nor for unauthorized access to the User's personal data stored within the applications on such devices.
2.5. The User agrees to use all services and features of the App strictly in accordance with their intended purpose and to refrain from any actions that could interfere with or compromise their normal operation.
2.6 To access the Rental and other features of the Services, the User must agree to these Terms by performing all of the following actions:
- Registering an account and providing accurate data as specified in the App (provided that account in the App was not registered earlier).
- Confirming that the User has read and understood all the Terms in full by tapping the "I agree to the Terms" (or similar in meaning) button as well as other conditions for Rental (including guarantee of age and mandatory use of helmets).
- Adding and validating a Linked Card in the App (provided that the Linked Card has not been added earlier).
2.7. By confirming agreement to the Terms, the User expresses its intent to accept the Rental in accordance with Article 39 of the Law on Obligations, and this action shall be considered as the acceptance of the public offer which essential elements are contained in these Terms.
2.8. Ridetech Serbia and Rental service provider retain the right to amend the Terms at any time. The User’s continued use of the Services, even if they have not reviewed the updated Terms, will be considered as acceptance of the modified Terms. The most recent version of the Terms will always be available on the https://yandexgo.com/legal/scooters_rs.
2.9. User agrees that Ridetech Serbia has the right to verify the data provided by the User during account registration by any legal means, including by sending User a request to validate the data or provide additional information. Should the User fail to respond to such a request, the User's access to the Service may be restricted.
2.10. By entering confirming these Terms, User guarantees and confirms that:
2.10.1. User is at least over 18 years of age and possess the necessary legal capacity to enter into and perform transactions under applicable law of Serbia. By registering in and using the Services, the User guarantees that all actions, including but not limited to cashless payments and Services usage, are performed personally and lawfully.
The Services does not verify the User’s identity or age at the time of registration due to the automated and real-time nature of the Services. The User is solely responsible for the accuracy of the data provided and for ensuring that the use of the Service complies with applicable legal requirements.
The Services shall not be held liable for any misuse of the App by persons who misrepresent their age or legal status. In the event that a User is found to have misrepresented their age or legal capacity, the Service reserves the right to suspend or terminate their account. Additionally, the Services may withhold funds or other resources from such Users if necessary to cover any costs or sanctions arising from such misuse.
2.10.2. User’s all actions within the Services, including but not limited to cashless payments made using a linked bank card, are carried out by the User personally. In cases where a linked bank card belongs to another individual, that individual shall bear full financial responsibility for all transactions made through the User’s account. The Services shall not be held liable for any unauthorized use of payment instruments or for any disputes between the User and the lawful holder of the payment method.
2.10.3. User is fluent in Serbian or English at a level sufficient to read and understand these Terms and agree with its content and undertakes to comply with the requirements established therein.
2.10.4. User agrees to the placement of any equipment and technologies on the E-Scooter that allow tracking and recording the GPS coordinates of the E-Scooter, it’s route and condition.
2.10.5. User agrees to be notified by the administrative authorities using any available means of communication (phone message, email, text message) of the date, time and place of the drawing up of the report on the offense and the hearing of the case.
2.10.6. User agrees to take appropriate measures to protect the information about their account in the App, including their name and password, from unauthorized use by other persons, and if such use is detected, the User is obliged to immediately report the relevant information to the customer support through the App.
3. Rental of E-Scooter
3.1. Rental is provided by Rental service provider as listed above in these Terms.
3.2. Rental service provider is responsible for providing the User through the App on onboarding process with complete information about the E-Scooters required for its operation, including, but not limited to, technical specifications, safety guidelines, and usage instructions, in compliance with the applicable laws and regulations of the Republic of Serbia.
3.3. Rental service provider shall ensure the normal operation of the E-Scooter during the Rental at its own expense, including timely maintenance, necessary repairs, and ensuring compliance with safety and technical standards as required by the relevant legislation of the Republic of Serbia, including all requirements for consumer protection and product safety regulations.
3.4. How to start the Rental
3.4.1. You may find information about available E-Scooters for Rental via the App. E-Scooters photos (if available) within the App are provided for illustration purposes only and may not accurately reflect the actual appearance of the E-Scooters.
3.4.2. You can choose the E-Scooter in the App or by scanning the QR code on the E-Scooter with camera of your device. You will see the following information about this E-Scooter: Location, Fee options, and the charge level of the E-Scooter. You are solely responsible for ensuring your devices have access to the Internet and for any service fees charged by third parties (for example, Internet providers or mobile network operators) related to your use of the Services via Internet.
3.4.3. If booking function is enabled, you will be able to reserve the E-Scooter for certain time period indicated in the App by tapping “RESERVE” button in the App.
3.4.4. To start the Rental of the chosen E-Scooter you should tap “START” button in the App.
3.4.5. Before starting the Rental, User must ensure that the Linked Card has the required amount of funds available.
3.4.6. You should make sure you have necessary skills and qualifications to ride E-Scooter and have protective bicycle helmet.
3.5. During the Rental
3.5.1. Use the App, rent a E-Scooter, and use other features of the Service in accordance with the Terms; The E-Scooter is intended strictly for personal (non-commercial) use. Any commercial use of the scooter is expressly prohibited.
3.5.2. Before commencing the ride on a E-Scooter, User must check its condition and inspect it for mechanical damage. If any damage to the E-Scooter is discovered during the inspection, the User must send photos of the damage to the E-Scooter via the App; Failure to report damage before starting the ride shall be deemed an acknowledgment by the User that the E-Scooter was in good and functional condition at the commencement of the ride. By proceeding without reporting, the User fully and irrevocably waives any and all claims, demands, or legal actions against Ridetech Serbia and Rental service provider in connection with such damage or any consequences arising therefrom.
3.5.3. Follow traffic rules, as well as the rules established in the area where he/she uses and/or leaves the E-Scooter and bear responsibility for violations. In particular, the User undertakes to ride on bicycle and bicycle-pedestrian paths or lanes for cyclists, and in bicycle zones with the speed not exceeding 25 km/h. If there are no bike lanes, bike-pedestrian lanes, or bike zones, or if it is impossible to ride in them, riding on the sidewalk or pedestrian path is permitted in accordance with the Traffic Rules.
3.5.4. Avoid causing harm to the life, health, and property of third parties, including other road users;
3.5.5. Stop using the E-Scooter immediately if a traffic accident occurs involving the User and/or E-Scooter or any third party’s property has been damaged, regardless who is at fault for such an accident/damage, formalize (get the protocol signed with the competent authorities) the traffic accident and not leave the scene of the accident;
3.5.6. Report traffic accidents and any damage to the E-Scooter in the App immediately.
TO ENSURE A SAFE RIDE, THE USER ALSO AGREES TO FOLLOW THE FOLLOWING RULES AND RECOMMENDATIONS THAT DIRECTLY AFFECT THE SAFETY OF RIDING AN E-SCOOTER:
3.5.7. Mandatory use a protective helmet;
3.5.8. Ride E-Scooter in a way that makes your actions predictable and careful for other road users, including pedestrians and vulnerable road users. You must take into account the road situation and all other conditions that may affect the safe operation of the E-Scooter;
3.5.9. Stand on an E-Scooter with both feet;
3.5.10. Hold the handlebars with both hands and do not ride the E-Scooter with one hand;
3.5.11. Avoid collisions or contact of the E-Scooter with any objects that may interfere with the safe operation of the E-Scooter;
3.5.12. When on the roadway and at night or in reduced visibility conditions - the user must either wear a reflective safety vest or be illuminated or marked with reflective material;
3.5.13. Park E-Scooter only in designated areas as marked in the App;
3.5.14. Ensure safe operation of the E-Scooter at any time.
3.6. IT IS EXPRESSLY FORBIDDEN TO:
3.6.1. Ride without helmet;
3.6.2. Ride the same E-Scooter together with another person (riding in pairs or groups);
3.6.3. Release the handlebars from your hands;
3.6.4. Remove your feet from the pedals or footrests, except when the vehicle is stationary;
3.6.5. Hold on to another vehicle;
3.6.6. Lead, tow, or push other vehicles or animals, except for towing a trailer that is manufactured as a trailer intended to be towed by the same type of vehicle,
3.6.7. Allow the E-Scooter to be towed or pushed;
3.6.8. Transport objects that may interfere with their ability to operate the E-Scooter;
3.6.9. Use headphones for audio devices in both ears;
3.6.10. Ride while under the influence of alcohol, drugs, toxic substances, or any other intoxicants, and to refuse to undergo a medical examination at the request of an authorized official;
3.6.11. Ride E-Scooter off-road, in rough terrain, on uneven surfaces, or on poor-quality roads that may damage the E-Scooter;
3.6.12. Ride E-Scooter inside buildings, restricted access areas, up or down stairs, on curbs, along the edges of embankments, streets, buildings;
3.6.13. Hang heavy bags or backpacks on the E-Scooter handlebars that can interfere with the safe operation of the E-Scooter;
3.6.14. Ride E-Scooter if your (including your cargo) total weight exceeds 100 kg;
3.6.15. Sublease the E-Scooter to third parties (however it’s allowed to transfer the E-Scooter under the “Joint ride” feature);
3.6.16. Ride E-Scooter with detected damage that may affect riding safety (malfunction of the electronics, malfunction of the braking system, malfunction of the steering system, etc.)
3.6.17. Cross the road using overpasses, ground-level, underground, or other crossings without dismounting from the E-Scooter;
3.6.18. Disassemble the E-Scooter, make changes to the design of the E-Scooter, make changes/modifications to the software of the E-Scooter as well as remove, replace, modify, or add any accessories, parts, or components of the E-Scooter;
3.6.19. Charge the E-Scooter independently or connect other devices to the E-Scooter for charging;
3.6.20. Ride an E-Scooter with a pet tied to the E-Scooter, or otherwise walk a pet if it may affect ride safety (for example, holding a pet's leash while riding an E-Scooter);
3.6.21. Park the E-Scooter in areas where it’s not permitted and in places where solid waste is stored, including do not put the E-Scooter in a waste container, etc; Upon request by Contractors, you agree to provide accurate information regarding the parking location of the returned E-scooter within 24 hours after the ride has ended.
3.6.22. Operate the E-Scooter without holding the steering wheel;
3.6.23. Carrying loads that extend more than 0.5 meters beyond the dimensions (length or width) of the E-Scooter, or carrying loads that obstruct the ability to control the E-Scooter.
3.6.24. Movement, stopping, or parking of vehicles on public green areas, green areas around public-use facilities, and green areas designated for public use.
3.6.25. When crossing the roadway, ride the E-Scooter, except at designated crossings for bicycle paths or pedestrian-bicycle paths across the roadway.
3.6.26. Obstruct the use of streets or other municipal roads by stopping or leaving vehicles, especially in the following cases:
- on sidewalks not designated for parking, or in parking areas outside the boundaries of marked parking spaces; in pedestrian zones; squares and piazzettas; traffic-calmed zones, except in designated parking areas; pedestrian crossings; bicycle lanes; places where access for other vehicles to park or exit a parking space would be hindered; driveways or exits from buildings or yards; driveways between residential buildings; fire access roads, etc.;
- at public transport stops or in other parts of the road in a way that obstructs the use of the stop; in traffic lanes designated exclusively for public transport vehicles; at taxi stands; in parts of public traffic areas designated for placing waste containers, and similar;
- in other situations where the parked, stopped, or abandoned vehicle obstructs the use of streets or municipal roads, endangers traffic participants, or prevents the flow of traffic;
3.6.27. Stop or leave E-Scooters in a way that obstructs pedestrian paths, access to buildings, internal roads; driving, stopping, or parking vehicles on paved public-use areas where tactile guiding paths are installed, and similar;
3.6.28. Leave damaged or abandoned E-Scooter in public-use areas or any other areas not specified in the App;
3.6.29. Make license plates or registration stickers intentionally unrecognizable, illegible, or otherwise unsuitable for identifying the vehicle, owner, user, or driver (e.g., covering the plates or sticker, etc.);
3.6.30. Occupying unclassified (field) roads.
3.7. Rental of several E-Scooters (Joint ride)
3.7.1. User may rent up to three E-Scooters at the same time. User has the right to transfer rented E-Scooter to capable third parties aged 18 or older who meet the requirements of these Terms for a ride in the presence of the User (Joint ride).
3.7.2. Before handing over the E-Scooters to third parties, the User undertakes to familiarize all third parties to whom the User hands over the E-Scooters with these Terms.
3.7.3. When the rented E-Scooter is transferred to a third party, the User's obligations (both the monetary obligation to pay the Fee, as well the liabilities) arising in connection with the Rental are not transferred to such third party and remain with the User, and the User remains fully responsible for the safety of the E-Scooters and compliance with these Terms in front of Contractors.
3.7.4. In the case of a Joint ride, the Minutes Package option applies only to the Rental of one E-Scooter which was Rented first.
3.8. Finishing the Rental
3.8.1. At the end of the Rental, you must return the E-Scooter without any damage and in fully operational/working condition.
3.8.2. You must park the E-Scooter in the parking area indicated in the App, tap the “FINISH” button in the App, and send photos of the parked E-Scooter (photos of the parking area and E-Scooter) through the App. S
3.8.3. Rental ends after the Contractors receive through the App photos of the parked E-Scooter in accordance with the instructions provided in the App (photos of the parking area and the E-Scooter). If the User complies with the procedure for return of the E-Scooter, the App will show the User the total Fee amount.
3.8.4. After finishing the Rental, the User shall review the Fee charged as shown in the App and sent by email to the email address specified by the User when registering in the App. If the User is charged an amount that does not match the Terms, immediately notify the customer support through the App. By renting an E-scooter, you consent to receive invoices and receipts upon request, sent to the email address you provided during registration.
3.8.5. The Rental period for the E-Scooter cannot exceed 24 (twenty-four) consecutive hours – if this maximum is reached, Rental terminates automatically.
3.8.6. If finishing the Rental is impossible due to insufficient battery power on your mobile device or a disruption of your device Internet connection, you shall bear full responsibility for the rental until such time as the rental is officially concluded, as determined by Terms.
4. Fee
4.1. Rental service provider fee consists of payment for the Rental and for additional services (if applicable).
4.2. Fee amount is communicated to the User in the App. User agrees with the specified amount the Fee by tapping the “START” button in the App. User understands that Fee maybe changed at the end of a ride due to change of time and/or route.
4.3. There may be following tariffs used for the calculation of the Fee subject to availability in the App:
4.3.1. “Pay-as-you go per minute” tariff (option)
- This tariff provides for minute-by-minute payment of the Fee.
- The one-time minimum payment for the Service will be refunded to the User if the User cancels the E-Scooter ride (does not tap the “START” button).
- The fee based on this tariff is calculated after tapping the Start Ride button.
4.3.2. "Minute Package" tariff (option)
- “Minute Package" option provides for a fixed payment of the Fee.
- When the "Minute Package" option is enabled, the Fee is calculated for a certain number of minutes, including Paid Wait Time, as specified and indicated in the App.
- The "Minute Package" tariff (option) is valid for the period specified in the App. The available tariff (option) variants and the number of minutes included are determined by Rental service provider independently and communicated to Users via the App.
- As soon as the Minutes Package is fully used, the User will be automatically charged under the “Pay-as-you go per minute” tariff for the excess time.
- “Minute Package" may be utilized only during specified term (Season). If the Season ends before the expiration of the "Minute Package" tariff (option), the remaining minutes are not carried over to the next Season.
4.4. In some cases, there’s an additional charge for staring the Rental and for the waiting time. Information about all additional charges that increase the Fee is available in the App before the start of the Rental. When the User taps the Start Ride button, he agrees with all such additional charges shown.
4.5. To ensure quality of the Service for Users, as well as to account for changes in demand and other conditions, the Fee for the service may be subject to a multiplier from time to time. Services notifies Users of an increase or decrease in the Fee for rates/options by posting the corresponding notification in the App.
4.6. Fee is paid by debiting funds from the User's Linked Card. By providing App with your payment information, you expressly authorize the Ridetech Serbia to charge all applicable and outstanding fees and charges without the need for any further notice or consent.
4.7. Rental service providers (through Ridetech Serbia) may charge the Linked User's Card at the start of the Rental for up to 150 (one hundred fifty) RSD as a refundable deposit. If the Fee amount exceeds the amount of the charged refundable deposit, the Rental service provider (through Ridetech Serbia) has the right to charge up to 150 (one hundred fifty) RSD from the User's Linked Card each time this limit is exceeded. The difference between the amount of the charged refundable deposit from the User's Linked Card and the total amount of the Fee is refunded to the User's Linked Card.
4.8. Users with inquiries or disputes regarding charges from their Linked Card should contact App customer support. Approved refunds will be credited to the Linked Card. Refund processing is subject to the regulations of applicable payment organizations and systems, financial institutions, and other relevant parties.
4.9. The Fee can be charged in a single transaction for the full Fee amount, or in several transactions for a partial Fee amount. In this case, the Fee may be charged in any of the specified ways before the start of the Rental, during the Rental, or upon its completion.
4.10. If funds cannot be charged from the User's Linked Card, the Rental service provider has the right to disable the E-Scooter. In this case, the User must finish the Rental or top up the limit of the User's Linked card.
4.11. Payment to the Rental service provider for the Rental is made using the Services's functionality. In this case, Ridetech Serbia acts on behalf of the relevant Rental service provider with the involvement of a licensed payment operator (payment organization/bank), or electronic money operator based on law of Republic of Serbia. Payment processing is governed by the rules of international payment systems, banks (including the issuing bank of the Linked Card), and other settlement participants. Ridetech Serbia does not guarantee that the Services will be free of errors and malfunctions in in respect of payment processing.
5. Liability
For failure to perform or improper performance of obligations under these Terms and/or Rental, Users shall be liable in accordance with these Terms and the laws of Republic of Serbia.
5.1. From the start till the finish of the Rental until the return of the E-Scooter, the User bears all risk for the E-scooter and any resulting harm, including damage discovered later.
5.2. User is fully responsible for any expenses, fines (including administrative fines imposed for administrative offenses) to the Rental service provider and/or Ridetech Serbia, complaints, claims, and demands arising during the entire Rental period of the E-Scooter, which may be filed by any third parties during and after the rental period for any reason related to the use of the E-Scooter, including for any damages caused to third parties. If Rental service provider and/or Ridetech Serbia paid the administrative fine on behalf of the User, the User must reimburse the Rental service provider and/or Ridetech Serbia for it and any losses incurred in connection with. If User causes damage to the life, health, or property of third parties while using the E-Scooter, including other pedestrians and other road traffic participants, User undertakes to fully compensate the damage caused by their actions to third parties and Contractors, including all court settlements and expenses.
5.3. Ridetech Serbia or Rental service provider shall not be held liable for any damages, injuries, or losses arising from the User’s failure to comply with the following conditions or from any misuse of the E-Scooter during the rental period:
5.3.1. Ensuring the necessary experience and knowledge for safe operation of the E-Scooter;
5.3.2. Adherence to regulations governing the operation of E-Scooters, including use of designated paths/roads, helmets;
5.3.3. Operation of the E-Scooter in adverse weather conditions such as heavy rain, dust storms, fog, or hurricanes;
5.3.4. Use of mobile devices, including making calls, texting, or any activity that may distract from safe operation;
5.3.5. Ensuring the battery level meets the needs of Rental period with no claims allowed against the Ridetech Serbia and Rental service provider in case of battery depletion;
5.3.6. Any defects or issues with the E-Scooter not reported through the Services immediately before and/or after Rental start. Prior to the Rental period, User must check the condition of the E-Scooter, including brakes, tires, and lights.
5.4. Paying a fine does not relieve the User from liability for damage to the property of the Rental service provider (including E-Scooter itself) and/or third parties.
5.5. Contractors may charge any Linked card for any outstanding payments, including contractual penalties from point 5.6. of these Terms and compensations for E-Scooter damage, either before or after Rental in case a violation of these Terms or traffic laws is detected. Users may select a default Linked Card in the App. If the User's debt cannot be charged from his Linked card, the User undertakes to pay the full amount of the debt to Rental service provider and/or Ridetech Serbia within 3 (three) calendar days from the date of sending the notification of the debt to the User by email to the email address specified by the User when registering in the App.
5.6. The following contractual penalties shall be paid to the Ridetech Serbia and/or Rental service provider by the User:

6. Terms of Service for Discounts and Promo Codes
6.1. Promo Code for a Discount on Rental may be provided to the User through the Services, email, authorized third parties, or in other ways.
6.2. There are following types of Discounts (can be offered via Promo Codes or otherwise):
6.2.1. “Free Minutes”
- Discount on a limited number of paid minutes valid for a limited time;
- can only be used in the “Pay-as-you go per minute” tariff;
- cannot be used for “Joint ride” option.
6.2.2. “Free Rental Start"
- fixed amount Discount on the part of the Fee charged after tapping the “RESERVE” button or the “START RIDE” button;
- can be used in any tariff.
6.2.3. “Fixed Discount”
- fixed amount Discount in the amount shown;
- can only be used in the “Pay-as-you go per minute” tariff.
6.3. The following terms apply to Promo Code:
- to benefit from a Discount by Promo Code, User must activate it in the App in accordance with the Terms. Adding a Promo Code in the App is not considered its activation;
- upon activation, the Promo Code can only be used once by one User, unless provided otherwise
- until the Promo Code is activated, User may transfer the Promo Code to another User, except for non-transferrable (unique) Promo Codes;
- Promo Codes are valid for a certain period of time during which the User must activate the Promo code in the Mobile app, after which it expires and is no longer valid;
- Discount provided by the Promo Code is applicable for a certain term starting after the Promo Code is activated in the App. If the User does not use the Discount in full, the unused part of the Discount expires.
6.4. Only certain types of Discounts may be combined Discounts and only when permitted in the terms of the respective Discount.
6.5. Discounts cannot be exchanged for cash, other types of Discounts, or any other benefit.
6.6. To prevent fraud and/or abuse of Promo Codes, Ridetech Serbia and/or Rental service provider reserves the right to use verification methods in its discretion. Support team has the right to request confirmation that the User received the Promo Code, and the User must provide such confirmation: a screenshot of the page with the Promo Code and/or other confirmation as instructed by a Support team member. Ridetech Serbia and/or Rental service provider may refuse to provide a Discount and/or cancel a Promo Code for a User if fraud and/or abuse is suspected.
6.7. The use of Promo Codes may be unavailable for technical reasons if the User has not updated the App to the latest available version and/or for other reasons.
6.8. Service is not liable for any failure to allow Users to benefit from Discounts / Promo Codes due to technical reasons. Ridetech Serbia and/or Rental service provider is not obligated to compensate Users in such cases.
6.9. Contractors may refuse to provide Discounts to Users if they provided false information about themselves or otherwise violate the Terms.
7. Personal Data
7.1. The Service provider is data controller in relation to the User's personal data.
7.2. In order to provide the Service in accordance with these Terms, Ridetech Serbia and Rental service provider may process the User's personal data up to the extent and for the purpose necessary for the provision of such Service, as specified in the Notice on Personal Data Processing posted at: https://yandexgo.com/legal/yandexgo_privacy_notice/.
7.3. When providing the Service functionality, Ridetech Serbia does not make any decisions that give rise to legal consequences in relation to the User or otherwise affecting his/her rights and legitimate interests.
7.4. When providing the Service functionality Ridetech Serbia may collect individual consents to the processing of Users’ personal data for access to the Service additional (optional) options, as well as for the purpose of sending information about Ridetech Serbia and/or Rental service provider products, services and/or our partners. The User will voluntarily, of his/her own free will and in his/her own interests, provide Service with such consent to the processing of his/her personal data and can revoke the corresponding consent using the features of the Service.
7.5. The User makes a statement to Ridetech Serbia of the circumstance, which is significant for the performance hereof and the provision of the Service, that all personal data provided by him/her is reliable and relates to the User, and is liable for any negative consequences of the inaccuracy of the personal data provided.
7.6. Ridetech Serbia processes personal data strictly in accordance with the Law of Serbia on Personal Data Protection. Users are clearly informed about the types of data collected, the purposes thereof, and the legal basis for each. Optional services requiring additional consent (e.g., location tracking, marketing) will be presented with a separate, freely given opt-in, and revocable at any time.
8. Governing law and dispute resolution, miscellaneous
8.1. These Terms shall be governed by and construed and enforced in accordance with the laws of the Republic of Serbia.
8.2. Any disputes arising out or in connection with these Terms shall be decided by the competent State bodies and courts the Republic of Serbia.
8.3. If one or more provisions of this Agreement are declared invalid, such invalidity does not affect the validity of any other provision of the Agreement and the Agreement as a whole.
8.4. Any notifications under this Agreement can be provided via the App.
9. Subscription
9.1. The User may purchase the Subscription in the App at any time during the term of this Agreement. To purchase the Subscription, the User selects the Subscription from the available options in the App's user interface and then pays for the selected Subscription. The price, validity period, and information on specific services included in the Subscription are shown in the App. Only one Subscription per User is permitted.
9.2. The Subscription's terms and conditions may allow canceling of the “Unlock” fee for the Subscription validity period in the “Per Minute” tariff and in the “Minutes Bundle” option, or making changes to other Rental terms and conditions. The Subscription shall not be valid if the User activates or applies valid promo codes for a discount and/or obtains a similar personal discount in the Service from any active Subscription.
9.3. The Subscription shall be valid (activated) after the User pays for the corresponding Subscription and the App shows the end date of the Subscription period and the date when the fee for the next Subscription period is charged (except for the trial period). If the funds on the User's Linked Payment Card are not available to pay for the Subscription, then the Subscription is not purchased and is not activated.
9.4. The Subscription is provided for a fixed period (the “Subscription Period”). The information about available Subscription Periods is shown to the User in the App's user interface. The User selects the Subscription period on their own from the list of available options in the App.
9.5. The Subscription may only be purchased before the Rental period. The Subscription shall be valid only regarding Rental of the E-Scooter started after the Subscription was activated.
9.6. If a ride is carried out by several people (the “Rent Another Scooter” option is used), then the special Rental terms and conditions under the Subscription shall also apply to additional rented the E-Scooters.
9.7. By paying for the Subscription, the User agrees that at the end of the Subscription Period, their Subscription will be automatically re-activated for the same period (Subscription Extension Period) if the User has not canceled the Subscription Extension in the App. The Subscription may be extended any number of times after the end of each active Subscription Period.
The extension fee for the Subscription is charged in advance by the acquiring bank to the Linked Payment Card in the amount set in the Service as of the day of payment for the Subscription (Subscription Fee).
The Subscription is extended only when the funds on the User's Linked Payment Card are sufficient. The Subscription shall be deemed extended for the next period from the moment the Subscription price is charged to the User's Linked Payment Card. If the funds on the User's Linked Payment Card are insufficient to pay for the Subscription, then the Subscription is not automatically extended.
9.8. The User acquiring a Subscription agrees to the automatic and direct debiting of funds from their Linked Payment Card in order to make a payment for the Subscription, and acknowledges that any payment orders for debiting funds from the Linked Payment Card provided in accordance with this Clause of the Terms and Conditions shall be deemed the User's own payment orders while any actions of the acquiring bank to charge funds in accordance with this Clause of the Terms and Conditions shall be deemed approved by the User.
Ridetech Serbia shall not be responsible for any failure to charge the Subscription fee to the Linked Payment Card and activate/extend the Subscription for technical reasons.
9.9. If the issuing bank of the Linked Payment Card disputes a transaction carried out using the Linked Payment Card when making a payment for the Subscription, the Partner may deem this the User's refusal to activate/extend the Subscription from the date Ridetech Serbia receives the request from the User's issuing bank.
9.10. The User who purchases the Subscription may refuse to extend the Subscription for the next Subscription Period in the App. In this case, the Subscription ends on the day following the last day of the paid Subscription Period. The Subscription may also be terminated by Partners in other cases or on other reasons provided for in the Terms and Conditions.
9.11. The User may cancel the Subscription unilaterally at any time during the Subscription Period. The User agrees that services under the Subscription are deemed to be rendered to and accepted by the User from the moment such services are made available to the User in the App, regardless of whether the User requested such services.
9.12. Partners may unilaterally change the Subscription's terms and conditions at any time by posting updated terms and conditions in the description of the Subscription in the App. The User shall track on their own the current status of the Subscription in the App (the list of included, excluded or added services), and also monitor any changes and amendments to the Subscription's terms and conditions, including cases when it is being extended. If the User does not agree to the changes in such terms and conditions, then the User shall cancel the Subscription.
9.13. The Partner reserves the right, at its own discretion, to unilaterally revoke or restrict the User's access to the Subscription (or to certain functions under the Subscription when possible), or refuse to extend the Subscription, including, but not limited to, when the User provides incomplete or false information, fails to pay for the services, or violates the laws of the Republic of Uzbekistan or these Terms and Conditions. If the User's account is blocked because the User provides false information about themselves or violates these Terms and Conditions, then the fee paid by the User for the current Subscription Period shall not be subject to recalculation/refund.
9.14. Partners may change the Subscription fee unilaterally. The User who has requested and paid for the Subscription (with automatic Subscription Extension) shall be notified of such change by posting the information about the new Subscription Fee in the App no later than 3 (three) calendar days before the change takes effect.
In this event, the price of the Subscription paid by the User as of the date when the corresponding change was made shall remain the same.
9.15. If during the paid Subscription Period the Partners suspend services due to the end of the Season in the Service and notify the User accordingly in the App, then the remaining part of the Subscription Period shall be postponed to the beginning of the next Season and the Subscription shall be re-activated on the first day of that Season in the corresponding city for a period equivalent to the previously unused and paid Subscription Period.
9.16. The User may not transfer their rights and/or obligations under the Subscription to third parties.
9.17. Unless otherwise provided in the Subscription description, the User may activate and utilize the Subscription in their existing account during a Trial Period free of charge. The duration of such Trial Period shall be indicated in the Subscription description in the App.
9.18. To activate the Trial Period, the User shall add their Linked Payment Card to the App as stated in Clause 2.1.3 of these Terms and Conditions, and then tap the “Try for Free” button (or a button with a similar meaning).
9.19. At the end of the Trial Period, the Linked Payment Card shall be automatically charged the Subscription Fee for the Subscription Period selected by the User when activating the Trial Period. The User who does not want to extend the Subscription for a fee at the end of the Trial Period shall cancel the automatic extension (purchase) of the Subscription in the App before the end of the Trial Period. In this case, the Subscription ends on the day following the last day of the Trial Period.
9.20. Each User may only utilize the Trial Period 1 (one) time.
10. Termination and amendment
10.1. Contractors can amend these Terms by posting a new version at the following address: https://yandexgo.com/legal/scooters_rs. Prior to each Rental, the User shall familiarize with the up-to-date version of the Terms. By renting the E-Scooter, User confirms that they agree to the current version of the Terms. If the User disagrees with any provision of these Terms, he shall not use the Service.
10.2. User can withdraw from this Agreement at any time by deleting the App from the memory of the User’s mobile device. Service hereby notifies Users that the termination of the cooperation does not relieve Users from fulfilling obligations incurred prior to the termination, nor from any liabilities arising therefrom.
10.3. Service can terminate these Agreement in case the User violates the Terms, including has an outstanding debt to the Rental service provider.
10.4. Ridetech Serbia may temporarily or permanently restrict the User's access to the Service without notice if the User:
- violates any provisions of these Terms, either in relation to the App, or Rental;
- causes or may cause damage to Ridetech Serbia and/or Rental service provider or any third party;
- engages in fraudulent or dishonest actions in relation to the Services (based on Ridetech Serbia judgement/opinion).
