This License Agreement (hereinafter referred to as the License) set the terms of use of YandexGo (previously Yandex.Taxi) for mobile devices (hereinafter referred to as the Program) and is signed with any person using the Program (hereinafter referred to as the User) and Yandex Go UB LLC, being a body authorized to grant the rights to use the Program (hereinafter referred to as the Rightholder) in Uzbekistan. 1\.2. By copying the Program, installing it on its mobile device or using the Program in any way, the User expresses its full and unconditional consent to all terms and conditions of the License. 1\.3. It is permitted to use the Program only under the terms and conditions of this License. The Rightholder can provide the User with a translation of this License from English into other languages. However, in the event of a conflict between the License in English and its translation, only the English version of the License shall be legally binding. **2\. Rights to the Program** 2\.1. The exclusive right to the Program is vested in the Rightholder. **3\. License** 3\.1. The Rightholder shall, free of charge and under an ordinary (non-exclusive) license, grant to the User the non-transferable right to use the Program in all countries of the world in the following ways: 3\.1.1. to use the Program as intended, wherefore to copy and install (reproduce) it on the User’s mobile device/-s. The User may install the Program on an unlimited number of mobile devices; 3\.1.2. to reproduce and distribute the Program for non-commercial purposes (free of charge). 3\.2. The Program shall be used (inter alia, be distributed) under the name: YandexGo. The User may not change and/or delete the name of the Program, the copyright notice or any other references to the Rightholder. **4\. Limitations** 4\.1. Except as used in the scope and in the ways expressly stipulated by this License, the User may not modify, decompile, disassemble, decrypt and perform any other actions with the object code and source code of the Program meant to obtain information on the implementation of algorithms used in the Program, create derivative works using the Program and otherwise use (allow to use) the Program and any components thereof, maps and other images and data stored by the Program on the User’s mobile device, without the Rightholder’s written consent. 4\.2. The User may not reproduce and distribute the Program for commercial purposes (inter alia, for a fee), inter alia, as part of software product collections, without the Rightholder’s written consent. 4\.3 The User may not distribute the Program in any form other than the form received, without the Rightholder’s written consent. **5\. Special Provisions** 5\.1. Some functions of the Program can only be performed with the Internet available. The User shall independently get and pay for such access under terms and as per tariffs of its communication or Internet provider. 5\.2. The Program enables the User to place information on the User’s potential demand for services involving the transportation of passengers and baggage, look through offers of organizations providing services in the said field, and search for such offers using parameters set by the User. 5\.3. Information available to the User within the Program (hereinafter referred to as the Data) is provided by the Rightholder’s partners. To get more details on services offered (including the information on the availability of Wi-Fi hotspot inside the taxi, carrying out of photo/video recording inside the taxi by the Right Holder's partners or other information), the User can either address the Rightholder’s partners or provide its contact information through the functions of the Program, which can be used by the Rightholder’s partners to contact the User on their own and provide it with the information on services offered. 5\.4. The Rightholder shall not be held liable for the content and/or relevance of information provided by the partners, including information on the cost of the partners’ services and on their availability at the moment. 5\.5. The User shall independently (without the participation of the Rightholder) discuss with the partners the acquisition of services in accordance with the partners’ rules on the provision of services. The Rightholder shall not be held liable for financial and any other transactions effected by the User and partners and for any consequences of the acquisition of the partners’ services by the User. 5\.6. The User agrees that the Rightholder can process the User’s personal information (including personal details), transfer the User’s personal details to the Rightholder’s partners and that the Rightholder’s partners can process personal information in order to provide services to the User within the Program. When the User uses the Program, its personal information is to be processed under the terms and for the purposes determined in the Privacy Notice available at: [https://yandexgo.com/legal/yandexgo_privacy_notice](https://yandexgo.com/legal/yandexgo_privacy_notice). 5\.7. The User is hereby notified, understands and agrees that the Program can collect anonymized statistical data on the use of the Program and automatically transfer these data to the Rightholder. 5\.8. The Program shall be registered and used by applying the User’s mobile phone number. When the User deletes the Program from the memory of the User’s mobile device, the User’s personal information obtained by Yandex.Taxi during authorization in the Program using the User’s mobile phone number and application of the Program will be saved in the Service for 1 (one) year. If the Program is re-installed on the device and registered using the same mobile phone number as an identifier, the User’s personal information provided with the use of the said mobile phone number will be restored in full. 5\.9. For the avoidance of doubt, Yandex.Taxi does not provide services involving the transportation of passengers and baggage and help desk services. **6\. Liability under the License** 6\.1. The Program is provided “as is”. The Rightholder provides no guarantees of error- and trouble-free operation of the Program or its certain components and/or functions, fitness of the Program for specific goals of the User, does not guarantee the reliability, accuracy, completeness and timeliness of the Data, and provides no other guarantees, which are not expressly stated in this License. 6\.2. The Rightholder shall not be held liable for any direct or indirect consequences of any use of or inability to use the Program (including the Data) and/or any losses incurred by the User and/or third parties as a result of any use of, failure to use or inability to use the Program (including the Data) or its certain components and/or functions, inter alia, due to possible errors or failures in their operation, except as expressly stipulated by laws. 6\.3. Huquq egasi oddiy (istisnosiz) litsenziya shartlarida Foydalanuvchiga Dasturdan butun dunyo mamlakatlarida quyidagi usullar bilan foydalanish uchun o‘tkazilmaydigan huquqni bepul beradi: 3\.1.1. Dasturdan belgilangan maqsadda foydalanish, shu maqsadda Foydalanuvchining mobil qurilmasi(lar)iga undan nusxa ko‘chirish va o‘rnatish (takror o‘rnatish). Foydalanuvchi Dasturni cheklanmagan miqdordagi mobil qurilmalarga o‘rnatish huquqiga ega; 3\.1.2. Dasturni notijorat maqsadlarda takror o‘rnatish va tarqatish (bepul). 3\.2. Dastur Yandex.Go nomi ostida ishlatilishi (shu jumladan tarqatilishi) kerak. Foydalanuvchi Dastur nomini, mualliflik huquqini muhofaza qilish belgisini yoki Huquq egasini ko‘rsatuvchi boshqa alomatlarni o‘zgartirish va (yoki) o‘chirish huquqiga ega emas. **4\. Cheklovlar** 4\.1. Foydalanuvchi Huquq egasining yozma roziligisiz Dasturda foydalaniladigan algoritmlarning amalga oshirilishi haqida axborot olish maqsadida Dasturning obyekt kodini o‘zgartirish, dekompilyatsiya qilish, assemblerini o‘zgartirish, shifrini ochish yoki boshqa harakatlarni amalga oshirish, Dasturdan foydalanib hosila asarlar yaratish, shuningdek, Dasturdan, Dasturning har qanday tarkibiy qismlari, Dastur tomonidan Foydalanuvchining mobil qurilmasida saqlanadigan xaritalar va boshqa tasvirlar hamda boshqa ma’lumotlardan boshqacha foydalanishni amalga oshirish (amalga oshirish uchun ruxsat berish) huquqiga ega emas, ushbu Litsenziyada to‘g‘ridan- to‘g‘ri nazarda tutilgan hajmda va usullar bilan foydalanish bundan mustasno. 4\.2. Foydalanuvchi Huquq egasining yozma roziligisiz Dasturni tijorat maqsadlarida (shu jumladan haq evaziga), shu jumladan dasturiy mahsulotlar to‘plamining bir qismi sifatida takror o‘rnatish va tarqatish huquqiga ega emas. 4\.3 Foydalanuvchi Huquq egasining yozma roziligisiz Dasturni uni olganidan farqli shaklda tarqatish huquqiga ega emas. **5\. Maxsus qoidalar** 5\.1. Dasturning ba’zi funksiyalari faqat Internetga kirish imkoni bo‘lganda bajarilishi mumkin. Foydalanuvchi o‘z aloqa operatori yoki Internetga kirish provayderining shartlarida va tariflari bo‘yicha bunday kirishni mustaqil ravishda oladi va to‘laydi. 5\.2. Dastur Foydalanuvchiga yo‘lovchilar va bagajlarni tashish bo‘yicha xizmatlarga bo‘lgan Foydalanuvchining potensial talabi to‘g‘risidagi axborotni bepul joylashtirish imkoniyatini, shuningdek, ushbu sohada xizmatlar ko‘rsatuvchi tashkilotlarning takliflari haqidagi axborot bilan tanishishni amalga oshirish va Foydalanuvchi tomonidan belgilangan parametrlarga muvofiq bunday takliflarni qidirish imkoniyatini taqdim etadi. 5\.3. Huquq egasi hamkorlar tomonidan taqdim etiladigan axborotning mazmuni va (yoki) dolzarbligi, shu jumladan hamkorlar xizmatlarining narxi, shuningdek ularning ayni paytda mavjudligi to‘g‘risidagi axborot uchun javobgar bo‘lmaydi. 5\.5. Foydalanuvchining xizmatlarni sotib olish bo‘yicha Hamkorlar bilan o‘zaro aloqasi Foydalanuvchi tomonidan hamkorlarda qabul qilingan xizmatlarni taqdim etish qoidalariga muvofiq mustaqil ravishda (Huquq egasi ishtirokisiz) amalga oshiriladi. Huquq egasi Foydalanuvchi va hamkorlar tomonidan amalga oshirilgan moliyaviy va boshqa har qanday operatsiyalar uchun, shuningdek, Foydalanuvchining hamkorlar xizmatlarini sotib olishining har qanday oqibatlari uchun javobgar bo‘lmaydi. 5\.6. Foydalanuvchi Dasturni Foydalanuvchining mobil qurilmasi xotirasidan o‘chirib tashlaganida, Dasturda Foydalanuvchining mobil telefon raqami va Dastur ilovasidan foydalangan holda avtorizatsiya qilish vaqtida Yandex.Taxi tomonidan olingan Foydalanuvchining shaxsiy axboroti Servisda 1 (bir) yil muddat davomida saqlanadi. Dasturni qurilmaga qayta o‘rnatish va identifikator sifatida aynan bitta mobil telefon raqamidan foydalangan holda ro‘yxatdan o‘tishda ko‘rsatilgan mobil telefon raqamidan foydalangan holda taqdim etilgan Foydalanuvchining shaxsiy axboroti to‘liq tiklanadi. 5\.9. Shubhaga yo‘l qo‘ymaslik uchun Yandex.Taxi yo‘lovchilar va bagajlarni tashish bo‘yicha xizmatlarni yoki axborot-dispetcherlik xizmati xizmatlarini ko‘rsatmaydi. **6\. Litsenziya bo‘yicha javobgarlik** 6\.1. Dastur “qanday bo‘lsa shunday” shartlarida taqdim etiladi. Huquq egasi Dasturning yoki uning alohida komponentlari va (yoki) funksiyalarining xatosiz va uzluksiz ishlashi, Dasturning Foydalanuvchining muayyan maqsadlariga muvofiqligi bo‘yicha hech qanday kafolatlar bermaydi, Ma’lumotlarning ishonchliligi, aniqligi, to‘liqligi va o‘z vaqtida bo‘lishini kafolatlamaydi, shuningdek ushbu Litsenziyada to‘g‘ridan- to‘g‘ri ko‘rsatilmagan hech qanday kafolatlarni bermaydi. 6\.2. Общие положения** 1\.1. Новые редакции документов вступают в силу с момента их публикации, если иное не предусмотрено самой редакцией документа. **2\. Права на Программу** 2\.1. Право на распространение Программы на территории Республики Узбекистан принадлежит Правообладателю. **3\. Лицензия** 3\.1. Правообладатель безвозмездно на условиях простой (неисключительной) лицензии предоставляет Пользователю непередаваемое право использования Программы на территории стран всего мира следующими способами: 3\.1.1. Применять Программу по прямому назначению, в целях чего произвести ее копирование и установку (воспроизведение) на мобильное(-ые) устройство(-а) Пользователя. Пользователь вправе произвести установку Программы на неограниченное число мобильных устройств; 3\.1.2. Воспроизводить и распространять Программу в некоммерческих целях (безвозмездно). 3\.2. Программа должна использоваться (в том числе распространяться) под наименованием: Yandex Go. Пользователь не вправе изменять и (или) удалять наименование Программы, знак охраны авторского права или иные указания на Правообладателя. **4\. Ограничения** 4\.1. За исключением использования в объемах и способами, прямо предусмотренными настоящей Лицензией, Пользователь не имеет права изменять, декомпилировать, дизассемблировать, дешифровать и производить иные действия с объектным кодом Программы, имеющие целью получение информации о реализации алгоритмов, используемых в Программе, создавать производные произведения с использованием Программы, а также осуществлять (разрешать осуществлять) иное использование Программы, любых компонентов Программы, карт и иных изображений и прочих данных, сохраняемых Программой на мобильном устройстве Пользователя, без письменного согласия Правообладателя. 4\.2. Пользователь не имеет права воспроизводить и распространять Программу в коммерческих целях (в том числе за плату), в том числе в составе сборников программных продуктов, без письменного согласия Правообладателя. 4\.3 Пользователь не имеет права распространять Программу в виде, отличном от того, в котором он ее получил, без письменного согласия Правообладателя. **5\. Особые положения** 5\.1. Выполнение некоторых функций Программы возможно только при наличии доступа к сети Интернет. Пользователь самостоятельно получает и оплачивает такой доступ на условиях и по тарифам своего оператора связи или провайдера доступа к сети Интернет. 5\.2. Программа предлагает Пользователю бесплатную возможность размещать информацию о потенциальном спросе Пользователя на услуги по перевозке пассажиров и багажа, а также возможность осуществлять ознакомление с информацией о предложениях организаций, оказывающих услуги в указанной сфере, и заниматься поиском таких предложений по заданным Пользователем параметрам. 5\.3. Информация, доступная Пользователю в рамках Программы (далее — «Данные»), предоставляется партнерами Правообладателя. Для получения более подробной информации о предлагаемых услугах (включая информацию о наличии точки доступа Wi-Fi в машине такси, проведении фото-/видеосъемки в машине такси партнерами Правообладателя или другой информации) Пользователь может обратиться к партнерам Правообладателя или предоставить свою контактную информацию, воспользовавшись функциональными возможностями Программы, которая может быть использована партнерами Правообладателя для самостоятельной связи с Пользователем и предоставления ему информации о предлагаемых услугах. 5\.4. Правообладатель не несет ответственности за содержание и (или) актуальность информации, предоставляемой партнерами, включая информацию о стоимости услуг партнеров, а также об их наличии в данный момент. 5\.5. Взаимодействие Пользователя с партнерами по вопросам приобретения услуг осуществляется Пользователем самостоятельно (без участия Правообладателя) в соответствии с принятыми у партнеров правилами оказания услуг. Правообладатель не несет ответственности за финансовые и любые другие операции, совершаемые Пользователем и партнерами, а также за любые последствия приобретения Пользователем услуг партнеров. 5\.6. Пользователь соглашается с тем, что Правообладатель может обрабатывать персональную информацию Пользователя (включая персональные данные), передавать персональные данные Пользователя партнерам Правообладателя, а также с тем, что партнеры Правообладателя могут обрабатывать персональные данные с целью предоставления услуг Пользователю в рамках Программы. При использовании Программы Пользователем его персональная информация передается для обработки на условиях и в целях, определенных Уведомление о конфиденциальности, размещенным онлайн по адресу: [https://yandexgo.com/legal/yandexgo_privacy_notice](https://yandexgo.com/legal/yandexgo_privacy_notice). 5\.7. Настоящим Пользователь уведомляется, понимает и соглашается с тем, что Программа может собирать обезличенные статистические данные об использовании Программы и автоматически передавать эти данные Правообладателю. 5\.8. Для регистрации и использования Программы необходимо указать номер мобильного телефона Пользователя. При удалении Пользователем Программы из памяти мобильного устройства Пользователя персональная информация Пользователя, полученная Правообладателем при авторизации в Программе с использованием номера мобильного телефона Пользователя и приложения Программы, сохраняется в Сервисе на период в 1 (один) год. При повторной установке Программы на устройство и регистрации с использованием того же номера мобильного телефона в качестве идентификатора личная информация Пользователя, предоставленная с использованием указанного номера мобильного телефона, будет полностью восстановлена. 5\.9. Во избежание сомнений Правообладатель не оказывает услуги по перевозке пассажиров и багажа и услуги информационно-диспетчерской службы. **6\. Ответственность по Лицензии** 6\.1. Программа предоставляется на условиях «как есть». Правообладатель не предоставляет никаких гарантий в отношении безошибочной и бесперебойной работы Программы или отдельных ее компонентов и (или) функций, соответствия Программы определенным целям Пользователя, не гарантирует достоверность, точность, полноту и своевременность Данных, а также не предоставляет никаких иных гарантий, прямо не указанных в настоящей Лицензии. 6\.2. Правообладатель не несет ответственности за какие-либо прямые или косвенные последствия какого-либо использования или невозможности использования Программы (включая Данные) и (или) ущерб, причиненный Пользователю и (или) третьим лицам в результате какого-либо использования, неиспользования или невозможности использования Программы (включая Данные) или отдельных ее компонентов и (или) функций, в том числе из-за возможных ошибок или сбоев в работе Программы, за исключением случаев, прямо предусмотренных законодательством. 6\.3. Все вопросы и претензии, связанные с использованием / невозможностью использования Программы или Данных, а также возможным нарушением Программой или Данными законодательства и (или) прав третьих лиц, должны направляться через форму обратной связи по адресу [support@taxi.yandex.com](mailto:support@taxi.yandex.com) 6\.4. Настоящая Лицензия и все взаимоотношения, связанные с использованием Программы, регулируются законодательством Нидерландов. **7\. Обновления / новые версии Программы** 7\.1. Действие настоящей Лицензии распространяется на все последующие обновления / новые версии Программы. Соглашаясь с установкой обновления / новой версии Программы, Пользователь принимает условия настоящей Лицензии для соответствующих обновлений / новых версий Программы, если обновление / новая версия Программы не сопровождается иным Лицензионным соглашением. **8\. Изменения условий настоящей Лицензии** 8\.1. Настоящее лицензионное соглашение может изменяться Правообладателем в одностороннем порядке.
