  **License Agreement for the Use of Yandex Go for Mobile Devices**
  
  
  
  _Before using the Program, please read the terms and conditions of the following License Agreement._
  
  
  
  _Any use of the Program will mean your full and unconditional acceptance of the terms and conditions hereof._
  
  
  
  _Should you not accept the terms and conditions of the License Agreement in full, you are not allowed to use the Program for whatsoever purpose._
  
  
  
  **1\. General Provisions**
  
  
  
  1\.1. This License Agreement (hereinafter the “License”) sets out the terms and conditions of use of the Yandex.Go (hereinafter the “Program”) and is entered into by and between any person using the Program (hereinafter the “User”) and Ridetech RS doo Beograd, an organization authorized to provide the right to use the Program (hereinafter the “Rightholder”) in Serbia.
  
  
  
  1\.2. By copying the Program, installing it on your mobile device or using the Program in any way, the User expresses their full and unconditional agreement with all the License terms and conditions.
  
  
  
  1\.3. The use of the Program is permitted only under the terms and conditions of this License. If the User does not accept the License terms and conditions in full, the User may not use the Program for whatsoever purpose. It is prohibited to use the Program in violation (default) of any of the License term or condition.
  
  
  
  1\.4. The use of the Program by User under this License terms and conditions for personal, non-commercial purposes shall be free of charge. The use of the Program on terms and conditions and in ways not provided for herein may be possible only on the basis of a separate agreement with the Rightholder.
  
  
  
  1\.5. By using the Program, you hereby agree that the following documents form the integral parts hereof:

  - Privacy Notice, available at: [https://yandexgo.com/legal/yandexgo_privacy_notice](https://yandexgo.com/legal/yandexgo_privacy_notice).
  
  
  The above documents (including all their parts) may be modified by the Rightholder without prior notice. Updated documents shall enter into force immediately upon publication, unless otherwise specified in the respective document.
  
  
  
  **2\. Rights to Program**
  
  
  
  2\.1. The Rightholder is the owner of the exclusive right to the Program.
  
  
  
  **3\. License**
  
  
  
  3\.1. The Rightholder shall grant the User, free of charge, under the terms and conditions of a simple (non-exclusive) license, unless otherwise provided for hereby, the non-transferable right to use the Program in all countries of the world as follows:
  
  
  
  3\.1.1. To use the Program for its intended functional purpose, in order to copy and install (run) it on the User’s mobile device(s). The User may install the Program on an unlimited number of mobile devices.
  
  
  
  3\.1.2. To run and distribute the Program for non-commercial purposes (free of charge).
  
  
  
  3\.2. The Program shall be used (including distributed) under the name: Yandex.Go. The User is not entitled to change and/or delete the Program name, the copyright symbol or other references to the Rightholder.
  
  
  
  **4\. Restrictions**
  
  
  
  4\.1. Except for use in the volume and in the ways expressly provided for hereby, the User may not modify, decompile, disassemble, decode or perform other actions with the object code and source text of the Program aimed at obtaining information on the Programlication of the algorithms used in the Program, and may not create derivatives using the Program, or carry out (permit to carry out) other use of the Program, any Program components, cartographic materials stored by the Program on the User’s mobile device, other images and other data, without the Rightholder’s written consent.
  
  
  
  4\.2. The User may not run and distribute the Program for commercial purposes (including for a fee), including as part of collections of software products, without the Rightholder’s written consent.
  
  
  
  4\.3. The User may not distribute the Program in a form other than the one in which they have received it, without the Rightholder’s written consent.
  
  
  
  **5\. Special Provisions**
  
  
  
  5\.1. Some Program functions can only run when there is access to the Internet. The User shall independently get and pay for such access under terms and as per tariffs of its communication or Internet provider.
  
  
  
  5\.2. The Program The Program enables the User to place information on the User’s potential demand for services involving the transportation of passengers and baggage, look through offers of organizations providing services in the said field, and search for such offers using parameters set by the User.
  
  
  
  5\.3. The information available to the User when using the Program (hereinafter the “Data”) is provided by the Rightholder’s Partners. For more detailed information on the services offered (including information on the availability of a Wi-Fi hotspot, photo/video recording in the taxi car cabin by the Rightholder’s Partner, and other information), the User can contact the Rightholder’s Partner or, using the Program functionality, provide their contact information, using which the Rightholder's Partners will be able to contact the User at their own, and provide the User with the information on the services offered by such Partners.
  
  
  
  5\.4. The Rightholder shall not be responsible for the content and/or relevance of the information provided by the Partners, including information on the price of the Partner’s services, as well as their availability at the given moment.
  
  
  
  5\.5. The User shall interact with the Rightholder’s Partners in matters of purchasing services at the User’s own discretion (without the participation of the Rightholder) in accordance with the rules for the provision of services adopted by the Rightholder’s Partners. The Rightholder shall not be liable for financial or any other transactions performed by the User and the Rightholder’s Partners, as well as for any consequences of the User’s purchase of the services provided by the Rightholder’s Partner.
  
  
  
  5\.6. The User agrees that the Rightholder can process the User’s personal information (including personal details), transfer the User’s personal details to the Rightholder’s partners and that the Rightholder’s partners can process personal information in order to provide services to the User within the Program. When the User uses the Program, its personal information is to be processed under the terms and for the purposes determined in the Privacy Notice available at: [https://yandexgo.com/legal/yandexgo_privacy_notice](https://yandexgo.com/legal/yandexgo_privacy_notice).
  
  
  
  5\.7. The User is hereby notified, acknowledges and agrees that the Program may collect anonymized statistics on the use of the Program and automatically transmit them to the Rightholder.
  
  
  
  5\.8. The Program shall be registered and used by applying the User’s mobile phone number. When the User deletes the Program from the memory of the User’s mobile device, the User’s personal information obtained by Yandex.Taxi during authorization in the Program using the User’s mobile phone number and application of the Program will be saved in the Service for 1 (one) year. If the Program is re-installed on the device and registered using the same mobile phone number as an identifier, the User’s personal information provided with the use of the said mobile phone number will be restored in full.
  
  
  
  5\.9. For the avoidance of doubt, Yandex.Taxi does not provide services involving the transportation of passengers and baggage and help desk services.
  
  
  
  **6\. Liability under the License**
  
  
  
  6\.1. The Program shall be provided on an “as is” basis. The Rightholder shall not provide any guarantee regarding the error-free and uninterrupted operation of the Program or its individual components and/or functions, regarding the Program’s compliance with the User’s specific goals; shall not guarantee the reliability, accuracy, completeness and timeliness of the Data, and shall not provide any other guarantees not expressly specified herein.
  
  
  
  6\.2. The Rightholder shall not be liable for any direct or indirect consequences of any use or inability to use the Program (including Data) and/or damages caused to the User and/or third parties as a result of any use, non-use or inability to use the Program (including Data) or its individual components and/or functions, including due to possible errors or failures in their operation, except in cases expressly provided for by law.
  
  
  
  6\.3. Any issue or complaint related to the use/inability to use the Program or Data, as well as possible violations of the law and/or third party rights by the Program or Data, shall be sent via the feedback form to: [support@taxi.yandex.com](mailto:support@taxi.yandex.com).
  
  
  
  6\.4. This License and all relationships related to the use of the Program shall be governed by the laws of the Netherlands.
  
  
  
  **7\. Updates / New Versions of the Program**
  
  
  
  7\.1. This License covers all future updates / new versions of the Program. By agreeing to install an update / new version of the Program, the User accepts the terms and conditions of this License for relevant updates / new versions of the Program, if there is no other license agreement for the update / new version of the Program.
  
  
  
  **8\. Amendments to the Terms and Conditions of this License**
  
  
  
  8\.1. This License Agreement may be amended unilaterally by the Rightholder. The notification about the amendments introduced to the terms and conditions hereof is published for the User at: [https://yandex.com/legal/yandexgo_mobile_agreement](https://yandex.com/legal/yandexgo_mobile_agreement). The said amendments to the terms and conditions of the License Agreement will take effect from the date of publication, unless otherwise indicated in the relevant publication.

  **"Ugovor o licenciranju za korišćenje programa Yandex Go za mobilne uređaje"**
  
  
  
  __Pre korišćenja programa, pročitajte uslove dole navedenog Licencnog ugovora_._
  
  
  
  _Svako Vaše korišćenje programa znači vaše potpuno i bezuslovno prihvatanje uslova ovog Licencnog ugovora._
  
  
  
  _Ako ne prihvatite sve uslove Licencnog ugovora, Vi nemate pravo da koristite program u bilo koju svrhu._
  
  
  
  **1\. Opšte odredbe**
  
  
  
  1\.1. Ovaj Licencni ugovor (u dalјem tekstu: „Licenca“) definiše uslove korišćenja Yandex.Go za mobilne uređaje (u dalјem tekstu: „Program“) i zaklјučuje se sa bilo kojom osobom koja koristi Program (u dalјem tekstu: „Korisnik“) i Ridetech RS doo Beograd, organizacija koja je ovlašćena za davanje prava na korišćenje Programa (u dalјem tekstu: „Nosilac prava“) u Srbiji.
  
  
  
  1\.2. Kopiranjem Programa, njegovim instaliranjem na vaš mobilni uređaj ili korišćenjem Programa na bilo koji način, Korisnik izražava svoje potpuno i bezuslovno prihvatanje svih uslova Licence.
  
  
  
  1\.3. Upotreba Programa je dozvolјena samo pod uslovima ove Licence. Ako Korisnik ne prihvati uslove Licence u ponomm obimu, Korisnik nema pravo da koristi Program u bilo koje svrhe. Zabranjena je upotreba Programa uz kršenje (neispunjenje) bilo kojeg od uslova Licence.
  
  
  
  1\.4. Korišćenje programa od strane Korisnika pod uslovima ove Licence u lične nekomercijalne svrhe je besplatno. Korišćenje Programa pod uslovima i na načine koji nisu predviđeni ovom Licencom moguće je samo na osnovu posebnog sporazuma sa Nosiocem prava.
  
  
  
  1\.5. Korišćenjem Programa slažete se da su sledeći dokumenti sastavni deo ove Licence za Program:

  -  Politika privatnosti dostupna je na linku: [https://yandexgo.com/legal/yandexgo_privacy_notice](https://yandexgo.com/legal/yandexgo_privacy_notice).
  
  
  Navedeni dokumenti (uklјučujući i sve njihove delove) mogu biti izmenjeni od strane Nosioca prava bez posebnog obaveštenja. Nove redakcije dokumenata stupaju na snagu od trenutka njihovog objavlјivanja, osim ako nije drugačije predviđeno samom redakcijom dokumenta.
  
  
  
  **2\. Prava na Program**
  
  
  
  2\.1. Ekskluzivno pravo na Program pripada Nosiocu prava.
  
  
  
  **3\. Licenca**
  
  
  
  3\.1. Nosilac prava daje Korisniku neprenosivo pravo da besplatno koristi Program na teritoriji zemalјa širom sveta pod uslovima jednostavne (neekskluzivne) licence na sledeće načine:
  
  
  
  3\.1.1 Koristiti Program prema njegovoj direktnoj nameni i u tom cilju izvršiti njegovo kopiranje i instaliranje (reprodukciju) na Korisnikov mobilni uređaj (uređaje). Korisnik ima pravo da instalira Program na neograničen broj mobilnih uređaja;
  
  
  
  3\.1.2 Reprodukovati i distribuisati Program u nekomercijalne svrhe (besplatno).
  
  
  
  3\.2. Program se mora koristiti (uklјučujući i distribuisati) pod imenom: Yandex.Go. Korisnik nema pravo da menja i (ili) briše naziv Programa, znak zaštite autorskih prava ili druge oznake Vlasnika prava.
  
  
  
  **4\. Ograničenja**
  
  
  
  4\.1. Sa izuzetkom upotrebe u obimima i na načine izričito predviđene ovom Licencom, Korisnik nema pravo da modifikuje, dekompilira, disassemblizira, dešifruje i izvršava druge radnje sa objektnim kodom Programa koje imaju za cilj dobijanje informacije o primeni algoritama koji se koriste u Programu, nema prava stvarati izvedena dela uz korištenje Programa, kao i vršiti (odobravati izvršenje) drugačiju upotrebu Programa, bilo kojih komponenti Programa, mapa i drugih slika i ostalih podataka koje Program čuva na mobilnom uređaju Korisnika, bez pismene saglasnosti Nosioca prava.
  
  
  
  4\.2. Korisnik nema pravo da reprodukuje i distribuiše Program u komercijalne svrhe (uklјučujući uz naknadu), uklјučujući i kao deo skupova softverskih proizvoda, bez pismene saglasnosti Nosioca prava.
  
  
  
  4\.3. Korisnik nema pravo da distribuiše Program u obliku koji se razlikuje od onog u kojem ga je dobio, bez pismene saglasnosti Nosioca prava.
  
  
  
  **5\. Posebne odredbe**
  
  
  
  5\.1. Neke funkcije Programa su moguće samo ako postoji pristup Internetu. Korisnik takav pristup dobija i plaća samostalno pod uslovima i po cenama svog Internet operatora ili provajdera pristupa Internetu.
  
  
  
  5\.2. Program nudi Korisniku besplatnu mogućnost objavlјivanja informacija o potencijalnoj potražnji Korisnika za usluge prevoza putnika i prtlјaga, kao i mogućnost da se upozna sa informacijama o ponudama organizacija koje pružaju usluge u navedenoj oblasti i bave se potražnjom takvih ponuda prema parametrima koje je odredio Korisnik.
  
  
  
  5\.3. Informaciju, koja je dostupna Korisniku u okviru Programa (u dalјem tekstu: „Podaci“), pružaju partneri Nosioca prava. Za detalјnije informacije o ponuđenim uslugama (uklјučujući informaciju o dostupnosti Wi-Fi u taksi vozilu i foto/video snimanju u taksi vozilu od strane partnera Nosioca prava ili druge informacije), Korisnik može kontaktirati partnere Nosioca prava ili dostaviti svoje kontakt podatke koristeći funkcionalne mogućnosti Programa, koje partneri Nosioca prava mogu koristiti za samostalnu komunikaciju sa Korisnikom i za pružanje njemu informacija o ponuđenim uslugama.
  
  
  
  5\.4. Nosilac prava nije odgovoran za sadržaj i (ili) relevantnost informacija koje pružaju partneri, uklјučujući informacije o ceni usluga partnera, kao i o njihovoj dostupnosti u određenom trenutku.
  
  
  
  5\.5. Interakciju Korisnika sa partnerima u vezi pitanja kupovine usluga Korisnik vrši samostalno (bez učešća Nosioca prava) u skladu sa pravilima za pružanje usluga koja su odredili partneri. Nosilac prava nije odgovoran za finansijske i bilo koje druge radnje koje su izvršili Korisnik i partneri, kao ni za bilo kakve posledice sticanja usluga partnera od strane Korisnika.
  
  
  
  5\.6. Nosilac prava obrađuje lične podatke korisnika u svrhu pružanja usluge. Da biste saznali više o obradi ličnih podataka Korisnika, pogledajte naše obaveštenje o privatnosti dostupno na [https://yandexgo.com/legal/yandexgo_privacy_notice/](https://yandexgo.com/legal/yandexgo_privacy_notice/).
  
  
  
  5\.7. Korisnik je ovim obavešten, saglasan je i razume da Program može prikuplјati anonimne statističke podatke o upotrebi Programa i automatski ih prenositi Nosiocu prava.
  
  
  
  5\.8. Za registraciju i korišćenje Programa potrebno je navesti broj mobilnog telefona Korisnika. Kada Korisnik izbriše Program iz memorije Korisničkog mobilnog uređaja, lični podaci Korisnika koje je Nosilac prava dobio prilikom autorizacije u Programu uz korišćenje broja mobilnog telefona Korisnika i Programskih aplikacija, čuvaju se u Servisu u periodu od 1 (jedne) godine. Kada ponovo instalirate Program na uređaju i registrujete se koristeći isti broj mobilnog telefona kao identifikator, lični podaci Korisnika, navedeni uz korištenje navedenog broja mobilnog telefona, biće u potpunosti obnovljeni.
  
  
  
  5\.9. Da bi se izbegli nesporazumi, Iandek.Taxi ne pruža usluge prevoza putnika i prtljaga, kao ni operativnu pomoć.
  
  
  
  **6\. Odgovornost prema Licenci**
  
  
  
  6\.1. Program se daje po principu „u viđenom stanju“. Nosilac prava ne pruža nikakve garancije u pogledu nepogrešivog i nesmetanog rada programa ili njegovih pojedinačnih komponenti i (ili) funkcija i usklađenosti Programa sa određenim cilјevima Korisnika, ne garantuje pouzdanost, tačnost, potpunost i pravovremenost Podataka i ne pruža nikakve druge garancije koje nisu izričito navedene u ovoj Licenci.
  
  
  
  6\.2. Nosilac prava nije odgovoran za bilo kakve direktne ili indirektne posledice bilo kakve upotrebe ili nemogućnosti korišćenja Programa (uklјučujući Podatke) i (ili) štete prouzrokovane Korisniku i (ili) trećim licima kao rezultat bilo kakve upotrebe, nekorišćenja ili nemogućnosti korišćenja Programa (uklјučujući Podatke) ili njegovih pojedinih komponenti i (ili) funkcija, uklјučujući zbog mogućih grešaka ili kvarova u radu Programa, osim u slučajevima koji su izričito predviđeni zakonom.
  
  
  
  6\.3. Sva pitanja i reklamacije koje se odnose na korišćenje/ nemogućnost korišćenja Programa ili Podataka, a takođe kada se Programom ili Podacima krši zakonodavstvo i (ili) prava trećih lica, treba poslati na obrascu za povratne informacije na adresu: [support@taxi.yandex.com](mailto:support@taxi.yandex.com).
  
  
  
  6\.4. Ova Licenca i svi uzajamni odnosi, povezani sa upotrebom Programa, regulisani su zakonodavstvom Nizozemske.
  
  
  
  **7\. Ažuriranja / nove verzije Programa**
  
  
  
  7\.1. Ova Licenca odnosi se na sva naredna ažuriranja / nove verzije Programa. Pristankom da instalira ažuriranje/ novu verziju Programa, Korisnik prihvata uslove ove Licence za odgovarajuće ažuriranje/ novu verziju Programa, osim ako ažuriranje / nova verzija Programa ne prati drugi Licencni ugovor.
  
  
  
  **8\. Promene uslova ove Licence**
  
  
  
  8\.1. Vlasnik prava može jednostrano promeniti ovaj Licencni ugovor. Obaveštenje Korisnika o promenama uslova ove Licence objavlјeno je na adresi: [https://yandex.com/legal/yandexgo_mobile_agreement](https://yandex.com/legal/yandexgo_mobile_agreement). Navedene izmene uslova Licencnog ugovora stupaju na snagu od datuma objavlјivanja, osim ako nije drugačije navedeno u odgovarajućoj publikaciji.

If the User does not accept the terms and conditions of the License in full, the User may not use the Program for any purpose. It is prohibited to use the Program in violation of (failing to fulfill) any of the terms and conditions of the License.
  
  
  
  1\.4. The Program can be used by the User under the terms and conditions of this License for personal non-commercial purposes free of charge. It is only possible to use the Program under terms and in ways not covered by this License based on a separate agreement with the Rightholder.
  
  
  
  1\.5. When using the Program, you agree that the following document forms an integral part of this License for the Program:

  The said documents (inter alia, any parts thereof) can be amended by the Rightholder without any special notice. New versions of the documents shall come into effect upon their publication, unless otherwise stipulated by the version itself.
  
  
  
  1\.6. The Rightholder can provide the User with a translation of this License from English into other languages. However, in the event of a conflict between the License in English and its translation, only the English version of the License shall be legally binding.
  
  
  
  **2\. Rights to the Program**
  
  
  
  2\.1. The exclusive right to the Program is vested in the Rightholder.
  
  
  
  **3\. License**
  
  
  
  3\.1. The Rightholder shall, free of charge and under an ordinary (non-exclusive) license, grant to the User the non-transferable right to use the Program in all countries of the world in the following ways:
  
  
  
  3\.1.1. to use the Program as intended, wherefore to copy and install (reproduce) it on the User’s mobile device/-s. The User may install the Program on an unlimited number of mobile devices;
  
  
  
  3\.1.2. to reproduce and distribute the Program for non-commercial purposes (free of charge).
  
  
  
  3\.2. The Program shall be used (inter alia, be distributed) under the name: YandexGo. The User may not change and/or delete the name of the Program, the copyright notice or any other references to the Rightholder.
  
  
  
  **4\. Limitations**
  
  
  
  4\.1. Except as used in the scope and in the ways expressly stipulated by this License, the User may not modify, decompile, disassemble, decrypt and perform any other actions with the object code and source code of the Program meant to obtain information on the implementation of algorithms used in the Program, create derivative works using the Program and otherwise use (allow to use) the Program and any components thereof, maps and other images and data stored by the Program on the User’s mobile device, without the Rightholder’s written consent.
  
  
  
  4\.2. The User may not reproduce and distribute the Program for commercial purposes (inter alia, for a fee), inter alia, as part of software product collections, without the Rightholder’s written consent.
  
  
  
  4\.3 The User may not distribute the Program in any form other than the form received, without the Rightholder’s written consent.
  
  
  
  **5\. Special Provisions**
  
  
  
  5\.1. Some functions of the Program can only be performed with the Internet available. The User shall independently get and pay for such access under terms and as per tariffs of its communication or Internet provider.
  
  
  
  5\.2. The Program enables the User to place information on the User’s potential demand for services involving the transportation of passengers and baggage, look through offers of organizations providing services in the said field, and search for such offers using parameters set by the User.
  
  
  
  5\.3. Information available to the User within the Program (hereinafter referred to as the Data) is provided by the Rightholder’s partners. To get more details on services offered (including the information on the availability of Wi-Fi hotspot inside the taxi, carrying out of photo/video recording inside the taxi by the Right Holder's partners or other information), the User can either address the Rightholder’s partners or provide its contact information through the functions of the Program, which can be used by the Rightholder’s partners to contact the User on their own and provide it with the information on services offered.
  
  
  
  5\.4. The Rightholder shall not be held liable for the content and/or relevance of information provided by the partners, including information on the cost of the partners’ services and on their availability at the moment.
  
  
  
  5\.5. The User shall independently (without the participation of the Rightholder) discuss with the partners the acquisition of services in accordance with the partners’ rules on the provision of services. The Rightholder shall not be held liable for financial and any other transactions effected by the User and partners and for any consequences of the acquisition of the partners’ services by the User.
  
  
  
  5\.6. The User agrees that the Rightholder can process the User’s personal information (including personal details), transfer the User’s personal details to the Rightholder’s partners and that the Rightholder’s partners can process personal information in order to provide services to the User within the Program. When the User uses the Program, its personal information is to be processed under the terms and for the purposes determined in the Privacy Notice available at: https://yandexgo.com/legal/yandexgo_privacy_notice.
  
  
  
  5\.7. The User is hereby notified, understands and agrees that the Program can collect anonymized statistical data on the use of the Program and automatically transfer these data to the Rightholder.
  
  
  
  5\.8. The Program shall be registered and used by applying the User’s mobile phone number. When the User deletes the Program from the memory of the User’s mobile device, the User’s personal information obtained by Yandex.Taxi during authorization in the Program using the User’s mobile phone number and application of the Program will be saved in the Service for 1 (one) year. If the Program is re-installed on the device and registered using the same mobile phone number as an identifier, the User’s personal information provided with the use of the said mobile phone number will be restored in full.
  
  
  
  5\.9. For the avoidance of doubt, Yandex.Taxi does not provide services involving the transportation of passengers and baggage and help desk services.
  
  
  
  **6\. Liability under the License**
  
  
  
  6\.1. The Program is provided “as is”. The Rightholder provides no guarantees of error- and trouble-free operation of the Program or its certain components and/or functions, fitness of the Program for specific goals of the User, does not guarantee the reliability, accuracy, completeness and timeliness of the Data, and provides no other guarantees, which are not expressly stated in this License.
  
  
  
  6\.2. The Rightholder shall not be held liable for any direct or indirect consequences of any use of or inability to use the Program (including the Data) and/or any losses incurred by the User and/or third parties as a result of any use of, failure to use or inability to use the Program (including the Data) or its certain components and/or functions, inter alia, due to possible errors or failures in their operation, except as expressly stipulated by laws.
  
  
  
  6\.3. All issues and claims related to the use of / inability to use the Program or the Data and possible violations of laws and/or third-party rights by the Program or the Data shall be sent through the feedback form to support@taxi.yandex.com.
  
  
  
  6\.4. This License and all relations associated with the use of the Program shall be governed by laws of the Netherlands.
  
  
  
  **7\. Updates / New Versions of the Program**
  
  
  
  7\.1. This License covers all future updates / new versions of the Program. By agreeing to install an update / new version of the Program, the User accepts the terms and conditions of this License for relevant updates / new versions of the Program, if there is no other license agreement for the update / new version of the Program.
  
  
  
  **8\. Amendments to this License**
  
  
  
  8\.1. This license agreement may be unilaterally amended by the Rightholder. User notification of the amendments introduced to the terms and conditions of this License is posted at: [https://yandexgo.com/legal/yandexgo_mobile_agreement](https://yandexgo.com/legal/yandexgo_mobile_agreement). The said amendments to the terms and conditions of the license agreement shall come into effect from the date of their publication, unless otherwise specified in the relevant publication.

  **Licencinė sutartis dėl “Yandex Go” programėlės naudojimo mobiliuosiuose įrenginiuose**
  
  
  
  _Prieš naudodamiesi programa, prašome susipažinti su toliau pateiktos licencijos sutarties sąlygomis._
  
  
  
  _Beėt koks programos naudojimas reiškia, kad besąlygiškai ir visa apimtimi sutinkate su šios licencinės sutarties sąlygomis._
  
  
  
  _Jei visa apimtimi nesutinkate su licencine sutartimi, neturite teisės naudoti programos bet kokiais tikslais._
  
  
  
  **1\. Bendrosios nuostatos**
  
  
  
  1\.1 Ši licencinė sutartis (toliau vadinama „Licencija“) nustato Yandex.Go (anksčiau Yandex.Taxi) mobiliesiems įrenginiams skirtos programos naudojimo sąlygas (toliau vadinama „Programa“) ir ji sudaroma su bet kuriuo asmeniu, kuris naudoja šią Programą (toliau vadinamas „Vartotojas“) ir „Ridetech International B. V.“, kuri yra organizacija, įgaliota suteikti teisę naudotis Programa (toliau vadinamas „Teisės suteikėjas“).
  
  
  
  1\.2 Kopijuodamas Programą, įdiegdamas ją savo mobiliajame įrenginyje ar naudodamas Programą bet kokiu būdu, Vartotojas išreiškia savo visišką ir besąlygišką sutikimą su visomis Licencijos sąlygomis.
  
  
  
  1\.3 Programa naudotis leidžiama tik pagal šios Licencijos sąlygas. Jei Vartotojas visa apimtimi nesutinka su licencine sutartimi, jis neturi teisės naudoti programos bet kokiais tikslais. Draudžiama naudotis Programa, pažeidžiant (nevykdant) bet kokios Licencijos sąlygos.
  
  
  
  1\.4 Vartotojo naudojimasis Programa pagal šios Licencijos sąlygas asmeniniais komerciniais tikslais vykdomas nemokamai. Naudotis Programa sąlygomis ir būdais, kurie nenumatyti šioje Licencijoje, galima tik remiantis atskiru susitarimu su Teisės suteikėju.
  
  
  
  1\.5 Naudodamiesi Programa, sutinkate su tuo, kad šie dokumentai yra neatsiejami nuo šios Programos Licencijos:

  Nurodyti dokumentai (įskaitant bet kokias jų dalis) gali būti keičiami Teisės savininko bet atskiro pranešimo. Naujos jų redakcijos įsigali nuo jų paskelbimo momento, jei kitaip nenurodyta pačioje dokumento redakcijoje.
  
  
  
  1\.6 Teisės savininkas gali pateikti Vartotojui šios Licencijos vertimą iš anglų kalbos į kitas kalbas. Tačiau, jei anglų kalba pateiktoje Licencijoje yra prieštaravimų, lyginant su jos vertimu, tiesioginę juridinę galią turi tik anglų kalba pateiktoji Licencijos versija.
  
  
  
  **2\. Programos teisės**
  
  
  
  2\.1 Išskirtinė Programos teisė priklauso Teisės savininkui.
  
  
  
  **3\. Licencija**
  
  
  
  3\.1 Teisės savininkas nemokamai paprastos (neišskirtinės) licencijos sąlygomis suteikia Vartotojui neperduodamą teisę naudotis Programa visos pasaulio šalyse šiais būdais:
  
  
  
  3\.1.1 Naudoti Programą pagal tiesioginę paskirtį, siekiant nukopijuoti ir įdiegti (atkurti) ją Vartotojo mobiliajame (-iuose) įrenginyje (-iuose). Vartotojas turi teisę įdiegti Programą neribotame mobiliųjų įrenginių kiekyje;
  
  
  
  3\.1.2 Diegti ir platinti Programą nekomerciniais tikslais (nemokamai).
  
  
  
  3\.2 Programa turi būti naudojama (įskaitant platinimą) šiuo pavadinimu: Yandex.Go. Vartotojas neturi teisės keisti ir (arba) šalinti Programos pavadinimo, autorinių teisių ženklo ar kitų Teisės savininko nurodymų.
  
  
  
  **4\. Apribojimai**
  
  
  
  4\.1 Išskyrus naudojimą apimtimis ir būdais, kurie tiesiogiai numatyti šioje Licencijoje, Vartotojas neturi teisės keisti, dekompiliuoti, skaidyti, iššifruoti ir atlikti kitų veiksmų su objektiniu Programos kodu, siekiant gauti informacijos apie algoritmų taikymą, kurie naudojami Programoje, sukurti produktus naudojantis Programa, taip pat vykdyti (leisti vykdyti) kitaip naudotis Programa, bet kuriais Programos komponentais, kortele ir kitais vaizdiniais ir duomenimis, saugomais Programos Vartotojo mobiliajame įrenginyje be Teisės savininko sutikimo raštu.
  
  
  
  4\.2 Vartotojas neturi teisės atkurti ir platinti Programos komerciniais tikslais (įskaitant už mokestį), taip pat programinių produktų rinkiniuose be Teisės avininko sutikimo raštu.
  
  
  
  4\.3 Vartotojas neturi teisės platinti Programos būdu, kuris skiriasi nuo gauto vaizdo be Teisės savininko sutikimo raštu.
  
  
  
  **5\. Ypatingosios nuostatos**
  
  
  
  5\.1 Kai kurios Programos funkcijos gali būti vykdomos tik esant prieigai prie interneto. Vartotojas savarankiškai gauna ir apmoka už tokią prieigą pagal savo ryšio operatoriaus ar prieigos prie interneto tinklo teikėjo sąlygas ir įkainiais.
  
  
  
  5\.2 Programa suteikia Vartotojui nemokamą galimybę teikti informaciją apie potencialią Vartotojo paklausą keleivių ir bagažo pervežimo paslaugoms, taip pat suteikia galimybę susipažinti su informacija apie organizacijos pasiūlymus, paslaugų teikimą atitinkamoje srityje ir ieškoti tokių pasiūlymų pagal Vartotojo pasirinktus parametrus.
  
  
  
  5\.3 Informacija, prieinama Vartotojui naudojantis Programa (toliau vadinamai „Duomenys“) teikiamai Teisės savininko partnerių. Siekdami gauti išsamesnės informacijos apie teikiamas paslaugas (įskaitant informaciją apie „Wi-Fi“ prieigos buvimą taksi automobilyje, fotografavimą / vaizdo įrašų filmavimą automobilyje Teisės savininko partnerių ar kitą informaciją), Vartotojas gali kreiptis į Teisės savininko partnerius ar pateikti savo kontaktinius duomenis, pasinaudodamas Programos funkcinėmis galimybėmis, kuriomis gali naudotis Teisės savininko partneriai, palaikydami savarankišką ryšį su Vartotoju ir teikdami informacijos apie siūlomas paslaugas.
  
  
  
  5\.4 Teisės savininkas nebus atsakingas už partnerių teikiamos informacijos turinį ir (arba) aktualumą, įskaitant informaciją apie partnerių paslaugų kainą, taip pat jų prieinamumą pasirinktu metu.
  
  
  
  5\.5 Vartotojo bendravimas su partneriais paslaugų įsigijimo klausimais vykdomas Vartotojo savarankiškai (nedalyvaujant Teisės savininkui) remiantis patvirtintomis partnerių paslaugų teikimo taisyklėmis. Teisės savininkas nebus atsakingas už finansines ir kitas operacijas, kurias vykdo Vartotojas ir partneriai, taip pat dėl Vartotojo partnerių paslaugų įsigijimo pasekmių.
  
  
  
  5\.6 Vartotojas sutinka, kad Teisės savininkas gali apdoroti asmeninius Vartotojo duomenis (įskaitant asmeninę informaciją), perduoti asmeninius Vartotojo duomenis Teisės savininko partneriams, taip pat Vartotojas sutinka, kad Teisės savininko partneriai gali apdoroti asmeninius jo duomenis, siekiant suteikti paslaugas Vartotojui remiantis šia Programa. Vartotojui naudojantis Programa, jo asmeniniai duomenys perduodami „Yandex.Taxi“ UAB (Rusija, 119021, Maskva, ul. Lva Tolstogo, d. 16) ir „YANDEX“ UAB apdoroti sąlygomis ir tikslais, kaip numatyta „YANDEX“ UAB Privatumo politika, kuri prieinama šia nuoroda: [https://yandex.com/legal/confidential](https://yandex.com/legal/confidential).
  
  
  
  5\.7 Čia Vartotojas praneša, supranta ir sutinka, kad Programa gali rinkti beasmenius statistinius duomenis apie Programos naudojimą ir automatiškai juos perduoti Teisės savininkui.
  
  
  
  5\.8 Programos registravimui ir naudojimui būtina nurodyti Vartotojo mobiliojo telefono numerį. Vartotojui šalinant Programą iš mobiliojo įrenginio atminties, Vartotojo asmeniniai duomenys, gauti „Yandex.Taxi“ autorizuojant Programą, naudojantis Vartotojo mobiliojo telefono numeriu, ir Programos prieduose, saugomi serveriuose vienerių (1) metų laikotarpiu. Pakartotinai įdiegę Programą įrenginyje ir registruojant ją naudojantis tuo pačiu mobiliuoju numeriu, kaip identifikatorius, asmeniniai Vartotojo duomenys, pateikti naudojantis nurodytu mobiliojo telefono numeriu, bus visiškai atkurti.
  
  
  
  5\.9 Siekiant išvengti abejonių, „Yandex.Taxi“ neteikia paslaugų apie keleivių ir bagažo pervežimą ir dispečerinės tarnybos informacinių paslaugų.
  
  
  
  **6\. Atsakomybė už šią Licenciją**
  
  
  
  6\.1 Programa teikiama pagal „esamas“ sąlygas. Teisės savininkas neteikia jokių garantijų dėl nepertraukiamo ar be trikdžių vykdomo Programos art atskirų jos komponentų ir (arba) funkcijų veikimo, Programos atitikties atitinkamiems Vartotojo tikslams, negarantuoja Duomenų tikrumo, tikslumo, pilnumo ir savalaikiškumo, taip pat neteikia jokių kitų garantijų tiesiogiai nenurodytų šioje Licencijoje.
  
  
  
  6\.2 Teisės savininkas nebus atsakingas už bet kokias tiesiogines ar netiesiogines bet kokio Programos (įskaitant Duomenis) naudojimo ar negalėjimo naudotis pasekmes ir (arba) žalą, sukeltą Vartotojui ir (arba) tretiems asmenims dėl bet kokio Programos (įskaitant Duomenis) ar atskirų jos komponentų ir (arba) funkcijų naudojimo, nenaudojimo ar negalėjimo naudoti, įskaitant galimas klaidas ar Programos veikimo trikdžius, išskyrus atvejus, tiesiogiai numatytus įstatymais.
  
  
  
  6\.3 Visus klausimus ir pretenzijas, sietinas su Programos ar Duomenų naudojimu / negalėjimu naudoti, taip pat galimus Programos ar Duomenų įstatymų ir (arba) trečiųjų šalių teisių pažeidimus, reikia siųsti atgalinio ryšio forma el. pašto adresu: [support@taxi.yandex.com](mailto:support@taxi.yandex.com).
  
  
  
  6\.4 Ši Sutartis ir visi ryšiai, sietini su Programos naudojimu, reglamentuojami pagal Nyderlandų įstatymus.
  
  
  
  **7\. Naujinimas / naujos Programos versijos**
  
  
  
  7\.1 Šios Licencijos nuostatos taikomos visiems naujinimams / naujoms Programos versijoms. Sutikdami su naujinimo / naujų Programos versijų diegimu, Vartotojas sutinka su šios Licencijos atitinkamų naujinimų / naujų Programos versijų sąlygomis, jei naujinimas / naujoji Programos versija nepateikiama su kita licencine sutartimi.
  
  
  
  **8\. Šios Licencijos sąlygų keitimas**
  
  
  
  8\.1 Ši licencinė sutartis gali būti keičiama Teisės savininko vienašališka tvarka. Pranešimas Vartotojui apie pakeitimus, kurie įtraukiami į šios Licencijos sąlygas, pateikti adresu: [https://yandex.com/legal/yandexgo_mobile_agreement](https://yandex.com/legal/yandexgo_mobile_agreement). Nurodyti licencinės sutarties pakeitimai įsigali nuo jų paskelbimo dienos, jei kitaip nenurodyta atitinkamame pranešime.
