Terms of Use of Service Provider (Yandex Go)

 

1. General Provisions

1.1. These Terms (hereinafter referred to as the Terms) constitute an offer of RideTechnology Global FZ-LLC (hereinafter referred to as Service Provider) to an Internet user (hereinafter referred to as the User) to use Yandex.Go (hereinafter referred to as the Service).

1.2. The User’s work with the Service is governed by these Terms and Privacy Policy (https://yandexgo.com/legal/yandexgo_termsofuse).

(hereinafter jointly referred to as the Regulatory Documents).

1.3. When starting using the Service / its certain functions, the User is deemed to have accepted these Terms and provisions of the Regulatory Documents, in full, without any qualification or exception. If the User disagrees with any provisions of the Terms and/or Regulatory Documents, the User may not use the Service.

1.4. Service Provider may, at any time without notice to the User, amend provisions of these Terms, and amend provisions of the Regulatory Documents. The current version of these Terms is available at: https://yandexgo.com/legal/yandexgo_termsofuse. The risk of failing to read a revised version of the Terms and Regulatory Documents shall be borne by the User; the continued use of the Service once the Terms or Regulatory Documents have been amended shall constitute consent to the revised version thereof.

1.5. The User shall stop using the Service, if it disagrees with any amendments to these Terms made by Yandex in the manner prescribed by cl. 1.4 hereof.

1.6. The Service enables the User to place information, free of charge, on the User’s potential demand for services involving the transportation of passengers and baggage, look through offers of organizations providing services in the said field, and search for such offers using parameters set by the User. All currently available functions of the Service along with any developments thereof and/or newly added functions are subject to these Terms.

1.7. Depending on the User’s region, any or all functions of the Service can be inaccessible or limited. The functions are deemed to be inaccessible (limited) for the User from a certain region, if such a User is unable to use them explicitly. It is prohibited to apply any technical and software-based methods to circumvent these limitations. Provisions of these Terms governing functions of the Service inaccessible (limited) for the User shall not be applied until such functions become explicitly accessible for the User. Information on the accessibility of functions of the Service in a certain region shall be provided to the User upon its request sent to Service Provider.

1.8. For the avoidance of doubt, Service Provider does not provide services involving the transportation of passengers and baggage and help desk services.

1.9. All conversations the User holds with the support team and drivers of partners of the Service can be recorded to control quality and improve services.

1.10. By using the Service, the User gives its consent to receive advertising messages. The User may refuse to receive advertising messages by using the relevant functionality of the Service or following instructions specified in the received advertising message.

 

2. Use of the Service. Certain Functions of the Service

2.1. Service is provided to the User for personal non-commercial use.

2.2. Information on services involving the transportation of passengers and baggage (hereinafter referred to as the Information) is provided by partners of the Service. The list of partners is available at http://taxi.yandex.com/partners. To get more details on services offered (including the information on the availability of Wi-Fi hotspot inside the taxi, carrying out of photo/video recording inside the taxi by the Right Holder's partners or other information), the User can either address partners of the Service or provide its contact information through the functionality of the Service, which can be used by partners of the Service to contact the User on their own and provide it with the information on services offered.

2.3. Service Provider shall not be held liable for the content and/or relevance of information provided by the Service’s partners, including information on the cost of the partners’ services and on their current availability. The User shall independently (without the participation of Service Provider) discuss the acquisition of services with the partners in accordance with the partners’ rules on the provision of services. Service Provider shall not be held liable for financial and any other transactions effected by the User and the partners and for any consequences of the acquisition of the partners’ services by the User.

2.4. The User access functions to rate services of the Service’s partners and comment / leave feedback on the Service and/or services of the Service’s partners. Ratings and feedback of users are posted on the Service website and can be found on third-party websites. Service Provider reserves the right to refuse to post ant ratings / feedback and remove / block, at any time, any rating / feedback posted by the User at own discretion and without giving any reason.

2.5. Service Provider reserves the right, at own discretion, to limit access of the User to the Service (or to certain functions of the Service, if technologically feasible) using its account or block the User’s entire account upon multiple violations of these Terms, or take any other measures against the User to respect legislative requirements or third-party rights and legitimate interests.

2.6. When the demand for taxi services is higher (including rush hours, days before holidays, days of mass events and other cases), maximum price of the ride can be increased. Service Provider can inform of such increases by posting the relevant notice on the Service website https://go.yandex/en_rs or otherwise, if Service Provider so decides, inter alia, by sending an information message to the User’s mobile phone number.

2.7. Services involving the transportation of passengers and baggage as per Economy, Comfort, Business tariffs and other tariffs represented on the Service are rendered by different types of vehicles. Vehicles are ranked automatically based on vehicle performance data provided by the Service’s partners.

2.8. The taxi service charges a cancellation fee, in case of User’s refusal of transport services, occurred after the car arrival to the pickup location appointed by the User. The amount of such fee is calculated similar to transport services fee for the period from the moment of actual car arrival to the pickup location or from the moment specified in information notice sent to the User by the taxi service as a moment of the car arrival to the pickup location (depending on what have taken place later) to the moment of User’s refusal of transport services. The User makes the refusal of transport services sending the information notice to the taxi service by the Service. Unless otherwise is foreseen by the rules of the corresponding taxi service or by the agreement between User and taxi service representative (driver), the User is considered to be refused of transport services if the User hasn’t get into a car that arrived to the pickup location appointed by the User within 10 (ten) minutes including the waiting time limits specified in the corresponding transport services rate. The cancellation fee for transport services from the airport is calculated with extra charge for the car arrival to the pickup location outside the city according to the corresponding transport services rate.

2.9. By using the Service the User gives its consent to Service Provider to process personal information (including personal details) of the User, to transfer personal information of the User to Service Provider’s partners and to process personal information of the User by Service Provider’s partners to provide services to the User within the Service. By using the Service the personal information of the User is to be processed under the terms and for the purposes determined in the Privacy Policy available at: https://yandexgo.com/legal/yandexgo_privacy_notice.

 

3. Function of Cashless Payment for Services Involving the Transportation of Passengers and Baggage

3.1. The User can pay for services involving the transportation of passengers and baggage provided to the User in compliance with the information on potential demand for the relevant service posted by the User via the Service:

3.1.1. directly to a taxi service (inter alia, by cash or by any other means stipulated by the said taxi service, if any, hereinafter referred to in these Terms and the Service interface as Cash). The said payment shall be made without Service Provider being involved and shall not be governed by these Terms;

3.1.2. the User can access the function of cashless payment through a Linked Bank Card (cl. 3.2 hereof); in this case, Service Provider acts on the authority of the relevant taxi service or otherwise involving an authorized payment processor, an electronic money processor or another party to settlements or a party to communication, and receives payments as an agent of the taxi service or otherwise (hereinafter referred to as cashless payments). Service Provider does not guarantee that the operation of the Service will be error- and failure-free in view of enabling cashless payments.

Depending on the User’s region, cashless payments can be made without the participation of Service Provider as a payment recipient or with the participation of Service Provider as another party to settlements or a party to communication.

The User chooses the relevant form of payment in the Service interface. In this respect, if it is impossible to make cashless payments for any reason (including, but not limited to temporary technical inaccessibility of this function, temporary or constant impossibility to make cashless payments using the Linked Card, insufficient funds in the Linked Card), the User undertakes to pay by Cash.

In case of cashless payments, it is possible to effect both one transaction for the total cost of the service involving the transportation of passengers and baggage and several transactions for parts of the cost, during and after the trip.

In case of cashless payments, the User can, along with payment for services involving the transportation of passengers and baggage, at own discretion, make an additional cashless payment to the taxi service as a percentage of the cost of the paid service involving the transportation of passengers and baggage (hereinafter referred to in these Terms and the Service interface as Tips).

3.2. The User shall specify the Linked Bank Card in the Service interface indicating the following details:

  • Bank card number
  • Valid through

  • Security code

If the bank card details are true, valid and it is technically feasible to use this card within the Service, the said bank card becomes the Linked one and can be used for cashless payments (cl. 3.1.2 hereof). All Linked Cards are displayed in the Service interface; for the User’s convenience, the interface displays the last 4 digits of the Linked Card’s number.

3.2.1. The User can also specify the Linked Card in the interface of third-party services supporting integration with the Service and parties to the settlements and authorizing the User’s payment with no information on the Linked Card transferred to Service Provider. In this case provisions of cl. 3.2 and 3.3 hereof shall not apply.

The use of third-party services specified herein is governed by rules of such third parties. Service Provider shall not be held liable for the use of such third-party services by the User and does not guarantee the proper and safe operation of such third-party services.

3.3. When the Linked Card is added and when the User chooses the function of cashless payment for a certain trip, the amount limited to EUR 1 (or any other amount in the User’s region currency) will be charged to confirm that the Linked Card details are true and valid; if the transaction is successfully effected, the said amount will be refunded to the User. Failure to charge the said amount means that it is impossible to add this Linked Card and/or the function of cashless payment is unavailable, respectively.

3.4. When adding the Linked Card and at any time after it was added, the User can set and/or change the default amount of Tips through the Service interface; the User can change the amount of Tips for a certain trip in the Service interface, when the trip is over.

3.5. Tips (in the default amount or in the amount specifically indicated by the User for a certain trip) will be charged from the Linked Card, if the User, within 30 minutes after the trip is over, assigns a high rating to the trip (4-5 stars) in the Service interface and clicks “Done” or assigns neither high nor low rating to the trip (does not specify the number of stars) and clicks “Done”.

3.6. If the User, within 30 minutes after the trip is over, assigns a low rating to the trip (1-3 stars) in the Service interface and clicks “Done”, no Tips will be charged from the Linked Card.

3.7. If the User, within 30 minutes after the trip is over, did not click “Done”, the amount of Tips (in the default amount or in the amount specifically indicated by the User for a certain trip) will be blocked in the Linked Card for 24 hours, during which the User can increase or reduce the amount of Tips for this trip. When the said time expires, the Tips will be charged in the amount specified by the User (by default or for this trip).

3.8. Cashless payments shall be made by the User involving an authorized payment processor or electronic money processor and shall be governed by rules of international payment systems, banks (including the bank that issued the Linked card) and other parties to settlements.

3.9. When indicating its details pursuant to cl. 3.2 hereof and further using the Linked Card, the User confirms and guarantees that it indicated reliable and full information on the valid bank card issued in its name; it complies with rules of international payment systems and requirements of the bank that issued the Linked Card, inter alia, in relation to the procedure of cashless payments.

3.10. The User understands and agrees that all actions performed within the Service using the mobile phone number confirmed by the User, inter alia, cashless payments with the use of the Linked Bank Card, are deemed to be performed by the User.

3.11. If the User disagrees with the fact and/or the amount of cashless payments and has any other questions associated with the use of the Linked Card within the Service, it may contact Service Provider by phone numbers specified by the Service and/or via the help desk (feedback) interface within 14 days from the date of cashless payments or any other actions or events that prompted the request.

If, following the inspection caused by such a request, Service Provider decides to refund the cashless payment amount, in whole or in part, the said amount shall be refunded to the bank account of the bank card, with which the cashless payment was made. The refund shall be made involving an authorized payment processor or electronic money processor and governed by rules of international payment systems, banks (including the bank that issued the Linked Card) and other parties to settlements. If Service Provider is not a party to settlements made by the Linked Card, Service Provider can act as a body that transfers Users’ above requests to taxi services, dispatch offices or any other person being a recipient of payments under the above transactions with the Linked Card.

3.12. Service Provider reserves the right to require, at any time, from the User to confirm the details it specified within the Service, including the details of the Linked Card, and request supporting documents in this regard (in particular, identity documents); failure to provide these documents can, at Service Provider’s discretion, be deemed amounting to the provision of unreliable information and have implications stipulated by cl. 2.5 hereof.

3.13. The provisions on the terms and procedure of payment for services involving the transportation of passengers and baggage specified in this Section shall not apply, when a third party pays for such services instead of the User under a contract signed by Service Provider with such a third party.

Uslove korištenja Servisa Yandeks.Go

 

1. Opšte odredbe

1.1. Ovi Uslovi (u dalјem tekstu: Uslovi) predstavlјaju ponudu kompanije RideTechnology Global FZ-LLC (u dalјem tekstu: „Pružalac usluga“) Korisniku Interneta (u dalјem tekstu: „Korisnik“) za korisćenje servisa Yandeks Go (u dalјem tekstu: „Servis“).

1.2. Korišćenje Servisa od strane Korisnika regulisano je ovim Uslovima, kao i Politikom privatnosti (https://yandexgo.com/legal/yandexgo_privacy_notice)

(u dalјem tekstu: „Regulatorni dokumenti“).

1.3. Kada Korisnik počne da koristi Servis / njegove pojedinačne funkcije, smatra se da je on u potpunosti prihvatio ove Uslove, kao i uslove Regulatornih dokumenata u punom obimu, bez ikakvih uslova ili izuzetaka. Ako se Korisnik ne slaže sa bilo kojom odredbom Uslova i (ili) Regulatornih dokumenata, Korisnik nema pravo da koristi Servis.

1.4. Pružalac usluga ima pravo da promeni odredbe ovih Uslova u bilo kom trenutku bez obaveštavanja Korisnika. Važeća redakcija navedenih Uslova dostupna za pregled na adresi: https://yandexgo.com/legal/yandexgo_termsofuse. Korisnik snosi rizik ako se ne upozna sa novom redakcijom Uslova i Regulatornih dokumenata. Nastavak korišćenja Servisa nakon promene Uslova ili Regulatornih dokumenata znači da je Korisnik saglasan sa njihovom novom redakcijom.

1.5. U slučaju da je kompanija Yandeks izvršila promene ovih Uslova na način predviđen u tački 1.4. ovih Uslova, sa kojima se Korisnik ne slaže, Korisnik je dužan da prestane koristiti Servis.

1.6. Servis nudi Korisniku besplatnu mogućnost da objavlјuje informacije o potencijalnoj potražnji Korisnika za uslugama prevoza putnika i prtlјaga, kao i mogućnost da se upozna sa informacijama o ponudama organizacija koje pružaju usluge u navedenoj oblasti, a takođe da traži takve ponude prema parametrima koje je odredio Korisnik. Predmet ovih Uslova su sve trenutno postojeće funkcije Servisa, kao i svaki njihov razvoj i (ili) dodavanje novih funkcija.

1.7. U zavisnosti od regiona Korisnika, sve ili samo neke funkcije Servisa mogu biti nedostupne ili ograničene. Funkcije se smatraju nedostupnim (ograničenim) za Korisnika iz određenog regiona, ako ih takav Korisnik ne može eksplicitno koristiti. Zabranjena je upotreba bilo kojih tehničkih i softverskih metoda za zaobilaženje ovih ograničenja. Odredbe ovih Uslova koji regulišu funkcije Servisa nedostupne (ograničene) za Korisnika, ne primenjuju se sve dok takve funkcije ne postanu eksplicitno dostupne Korisniku. Informacije o dostupnosti funkcija Servisa u određenom regionu pružaju se Korisniku na njegov zahtev, upućen kompaniji Pružalac usluga.

1.8. U cilju izbegavanja sumnji, Pružalac usluga ne pruža usluge prevoza putnika i prtlјaga, i ne pruža usluge informacione i dispečerske službe.

1.9. Svi pregovori koje Korisnik vodi sa službom za podršku i vozačima partnera Servisa mogu se snimati u cilјu kontrole kvaliteta i pobolјšanja usluga.

1.10. Korišćenjem Servisa Korisnik se slaže sa primanjem poruka reklamnog karaktera. Korisnik ima pravo da odbije primanje reklamnih poruka koristeći odgovarajući funkcional Servisa ili prateći uputstva navedena u primljenoj poruci reklamnog karaktera.

 

2. Korišćenje Servisa. Posebne funkcije Servisa

2.1. Servis se pruža Korisniku za ličnu i nekomercijalnu upotrebu.

2.2. Informacije o uslugama prevoza putnika i prtlјaga (u dalјem tekstu - „Informacije“) pružaju partneri Servisa. Spisak partnera dostupan je na adresi:http://taxi.yandex.com/partners. Za detalјnije informacije o ponuđenim uslugama (uklјučujući informaciju o dostupnosti Wi-Fi u taksi vozilu i foto/video snimanju u taksi vozilu od strane partnera Nosioca prava ili druge informacije), Korisnik može kontaktirati partnere Servisa ili dostaviti svoje kontakt podatke koristeći funkcionalne mogućnosti Servisa, koje partneri Servisa mogu koristiti za samostalnu komunikaciju sa Korisnikom i za pružanje njemu informacija o ponuđenim uslugama.

2.3. Pružalac usluga nije odgovoran za sadržaj i (ili) relevantnost informacija koje pružaju partneri Servisa, uklјučujući informacije o ceni usluga partnera, kao i o njihovoj dostupnosti u određenom trenutku. Interakciju Korisnika sa partnerima u vezi pitanja kupovine usluga Korisnik vrši samostalno (bez učešća Pružalac usluga) u skladu sa pravilima za pružanje usluga koja su odredili partneri. Pružalac usluga nije odgovoran za finansijske i bilo koje druge radnje koje su izvršili Korisnik i partneri, kao ni za bilo kakve posledice sticanja usluga partnera od strane Korisnika.

2.4. Korisnik može imati pristup funkcijama ocene usluga partnera Servisa, kao i objavlјivanju komentara/recenzija o Servisu i (ili) uslugama partnera Servisa. Ocene i komentari korisnika objavlјuju se na web-stranici Servisa a mogu biti dostupni i na web-stranicama trećih lica. Pružalac usluga zadržava pravo da odbije objavlјivanje bilo kakvih ocena/recenzija, kao i da izbriše/blokira ocenu/recenziju koju je Korisnik objavio u bilo kom trenutku po sopstvenom nahođenju i bez navođenja razloga.

2.5. Pružalac usluga zadržava pravo da po svom nahođenju ograniči pristup Korisnika Servisu (ili određenim funkcijama Servisa, ako je to tehnološki moguće) koristeći njegov korisnički račun ili ga potpuno blokirati u slučaju ponovlјenog kršenja ovih Uslova, ili primeniti druge mere prema Korisniku u cilјu ispunjavanja zahteva zakonodavstva ili prava i zakonskih interesa trećih lica.

2.6. Tokom perioda povećane potražnje za taksi uslugama (uključujući špiceve, dane pred praznike, dane masovnih događaja i druge slučajeve), maksimalna cena vožnje se može povećati. Pružalac usluga može da obavesti o takvim povećanjima postavljanjem relevantnog obaveštenja na veb-sajt Usluge https://go.yandex/en_rs ili na drugi način po nahođenju kompanije Pružalac usluga, uklјučujući, ali ne ograničavajući se, slanje Korisniku informativne poruke na broj mobilnog telefona.

2.7. Usluge prevoza putnika i prtlјaga po tarifima „Ekonom“, „Komfort“, „Biznis“i drugim tarifama, predstavlјenim na Servisu, obavlјaju se različitim klasama automobila. Dodelјivanje automobila određene klase vrši se automatski na osnovu podataka o karakteristikama automobila koje pružaju partneri Servisa.

2.8. U slučaju da Korisnik odbije uslugu prevoza nakon što automobil stigne na mesto preuzimanja koje je odredio Korisnik, taksi služba naplaćuje naknadu za otkazivanje. Iznos takve provizije izračunava se analogno vrednosti transportnih usluga za period od trenutka kada je automobil stvarno stigao na mesto isporuke ili od vremena naznačenog u informativnoj poruci koju je Korisniku poslala taksi služba, od trenutka kada je automobil stigao na mesto isporuke (u zavisnosti od toga šta se kasnije dogodilo) do trenutka kada Korisnik otkaže transportne usluge. Korisnik otkazuje transportne usluge putem slanja informativne poruke taksi službi preko Servisa. Ako pravilima relevantne taksi službe nije drugačije predviđeno ili ugovorom između Korisnika i predstavnika taksi službe (vozača), smatra se da je Korisnik otkazao transportne usluge ako Korisnik nije ušao u automobil koji je stigao na mesto isporuke, koje je Korisnik naznačio, u roku od 10 (deset) minuta, uklјučujući vreme čekanja, predviđeno odgovarajućom tarifom za pružanje usluga prevoza. Naknada za otkazivanje transportnih usluga sa aerodroma obračunava se uzimajući u obzir doplatu za dolazak automobila na mesto isporuke van grada u skladu sa odgovarajućom tarifom za transportne usluge.

2.9. Korisnik daje saglasnost Pružalac usluga za obradu ličnih informacija (uklјučujući lične podatke) Korisnika Pružalac usluga, za prenos ličnih podataka Korisnika servisu Pružalac usluga partnerima Pružalac usluga, kao i na obradu ličnih podataka od strane partnera Pružalac usluga za svrhe pružanja usluga u okviru Servisa. Lični podaci Korisnika Servisa se prenose za obradu pod uslovima i za svrhe navedene u Pravilima o privatnosti koji su dostupni za pregled na adresi: (https://yandexgo.com/legal/yandexgo_privacy_notice).

 

3. Funkcija bezgotovinskog plaćanja Servisa za prevoz putnika i prtlјaga

3.1. Plaćanje usluge prevoza putnika i prtlјaga, koja je pružena Korisniku u skladu sa informacijom o potencijalnoj potražnji za odgovarajućom uslugom koju je on objavio koristeći Servis, Korisnik može izvršiti:

3.1.1. direktno taksi službi (uklјučujući gotovinom ili na druge načine koje je odredila navedena taksi služba, ako postoje, u dalјem tekstu ovih Uslova i u interfejsu Servisa - „Gotovina“). Ova vrsta plaćanja se vrši bez učešća Pružalac usluga-a i nije regulisana ovim Uslovima.

3.1.2. Korisnik može imati pristup funkciji bezgotovinskog plaćanja sa Povezane bankovne kartice (tačka 3.2 ovih Uslova); u ovom slučaju Pružalac usluga deluje u ime određenih taksi službi ili na nekom drugom osnovu, uz učešće ovlašćenog operatora za prijem plaćanja ili operatora elektronskog novca ili druge strane koja obavlja platni promet ili informacione interakcije i primalac je uplate kao agent taksi službe, ili u drugom svojstvu (u dalјem tekstu - „Bezgotovinsko plaćanje“). Pružalac usluga ne garantuje odsustvo grešaka i poremećaja u radu Servisa u vezi sa pružanjem mogućnosti bezgotovinskog plaćanja.

U zavisnosti od regiona Korisnika, bezgotovinska plaćanja mogu se vršiti bez Pružalac usluga-ja kao primaoca uplate, ili sa angažovanjem drugih učesnika u platnom prometu ili učesnika u informacionoj interakciji.

Izbor odgovarajućeg načina plaćanja vrši Korisnik u interfejsu Servisa. Istovremeno, ako je iz bilo kog razloga nemoguće izvršiti bezgotovinsko plaćanje (uklјučujući, ali ne ograničavajući se na privremenu tehničku nedostupnost ove funkcije, privremenu ili trajnu nemogućnost bezgotovinskog plaćanja pomoću povezane kartice, nedovolјno sredstava na Povezanoj kartici), korisnik se obavezuje da će platiti gotovinom.

Bezgotovinsko plaćanje moguće je izvršiti kako jednom transakcijom u punom iznosu vrednosti usluge prevoza putnika i prtlјaga, tako i putem nekoliko transakcija za delove vrednosti usluge, kako za vreme putovanja, tako i na kraju putovanja.

U slučaju bezgotovinskog plaćanja, uz plaćanje usluge prevoza putnika i prtlјaga, Korisnik ima mogućnost, po svom nahođenju, da izvrši i dodatno bezgotovinsko plaćanje u korist taksi službe u procentnom odnosu od vrednosti plaćene usluge prevoza putnika i prtlјaga (u dalјem tekstu ovih Uslova i u interfejsu Servisa - "Napojnica").

3.2. Povezanu bankovnu karticu Korisnik navodi u interfejsu Servisa i pri tome Korisnik daje sledeće podatke:

  • broj bankovne kartice;
  • rok važenja;
  • zastitni kod.

Ako su podaci o bankovnoj kartici tačni, važeći i ako je upotreba ove kartice u okviru Servisa tehnički moguća, navedena bankarska kartica stiče status Povezane i može se koristiti za bezgotovinsko plaćanje (tačka 3.1.2 ovih Uslova). Sve Povezane kartice su prikazane u interfejsu Servisa. Radi udobnosti Korisnika prikazuju se poslednje 4 cifre broja Povezane kartice.

3.2.1. Korisnik takođe može da navede informacije o Povezanoj kartici u interfejsu drugih servisa koji podržavaju integraciju sa Servisom, a takođe i učesnike platnog prometa koji autorizuju plaćanja Korisnika bez prenošenja podataka o Povezanoj kartici na Pružalac usluga. U ovom slučaju, odredbe člana 3.2 i 3.3 ovog dokumenta se ne primenjuju.

Korišćenje usluga drugih servisa, navedenih u ovom dokumentu, reguliše se pravilima tih servisa. Pružalac usluga nije odgovoran za korisnikovo korišćenje takvih drugih servisa i ne garantuje ispravan i siguran rad takvih servisa.

3.3. Prilikom dodavanja Povezane kartice, kao i u slučaju da Korisnik odabere funkciju bezgotovinskog plaćanja za određeno putovanje, tereti se iznos od 5 ruskih rubalјa (ili drugi iznos u valuti regiona Korisnika), koji je neophodan za potvrdu tačnosti i validnosti podataka Povezane kartice; u slučaju uspešne transakcije, navedeni iznos se vraća Korisniku. Neuspeli pokušaj skidanja navedenog iznosa znači da je nemoguće dodati ovu Povezanu karticu i (ili) je funkcija bezgotovinskog plaćanja nedostupna.

3.4. Prilikom dodavanja Povezane kartice, kao i u bilo koje vreme nakon dodavanja, Korisnik ima mogućnost da preko interfejsa Servisa postavi i (ili) promeni zadanu veličinu Napojnice. Iznos Napojnice za određeno putovanje Korisnik može promeniti u interfejsu Servisa nakon završetka ovog putovanja.

3.5. Napojnice (u zadatom iznosu ili u iznosu koji je Korisnik posebno utvrdio za određeno putovanje) skinuće se sa Povezane kartice ako je Korisnik u roku od 30 minuta nakon završetka putovanja u interfejsu Servisa naznačio pozitivnu ocenu putovanja (4-5 zvezdica) i kliknuo na dugme „Gotovo“ili nije označilo ni pozitivnu, ni negativnu ocenu putovanja (nije naznačio broj zvezdica) i kliknuo je na dugme „Gotovo “.

3.6. Ako je Korisnik u roku od 30 minuta nakon završetka putovanja u interfejsu Servisa naznačio negativnu ocenu za putovanje (1-3 zvezdice) i kliknuo na dugme „Gotovo“, Napojnice se neće skinuti sa Povezane kartice.

3.7. Ako Korisnik ne klikne na dugme „Gotovo“u roku od 30 minuta nakon završetka putovanja, iznos Napojnice (u zadatom iznosu ili u iznosu koji je Korisnik posebno naveo za određeno putovanje) blokiraće se na povezanoj kartici tokom 24 sata, tokom koje Korisnik ima mogućnost da promeni iznos Napojnice za ovo putovanje nagore ili nadole. Po isteku navedenog vremena, dolazi do skidanja Napojnice sa kartice u iznosu koji je odredio Korisnik (u zadatom iznosu ili za ovo određeno putovanje).

3.8. Korisnik vrši bezgotovinsko plaćanje uz učešće ovlašćenog operatora za prijem plaćanja ili operatora elektronskog novca i reguliše se pravilima međunarodnih platnih sistema, banaka (uklјučujući banku izdavaoca Povezane kartice) i drugih učesnika platnog prometa.

3.9. Prilikom navođenja svojih podataka u skladu sa tačkom 3.2 ovih Uslova i dalјe upotrebe Povezane kartice, Korisnik potvrđuje i garantuje da je pružio tačne i potpune informacije o važećoj bankovnoj kartici izdatoj na njegovo ime, pridržavanje pravila međunarodnih platnih sistema i zahteva banke koja je izdala povezanu karticu, uklјučujući i u odnosu na način obavlјanja bezgotovinskog plaćanja.

3.10. Korisnik razume i saglasan je da se sve radnje, izvršene u okviru Servisa uz korišćenje broja mobilnog telefona koji je on potvrdio, uklјučujući bezgotovinsko plaćanje pomoću Povezane bankovne kartice, smatraju izvršenim od strane Korisnika.

3.11. Ako se Korisnik ne slaže sa činjenicom i (ili) iznosom bezgotovinskog plaćanja i drugim pitanjima, vezanim za upotrebu Povezane kartice u okviru Servisa, Korisnik ima pravo da kontaktira Pružalac usluga na brojeve telefona Servisa i (ili) putem interfejsa službe za podršku (povratne informacije) u roku 14 dana od datuma bezgotovinskog plaćanja ili drugih radnji ili događaja koji su prouzrokovali žalbu.

Ako na osnovu rezultata provere u vezi takvog obraćanja Pružalac usluga donese rešenje o vraćanju iznosa bezgotovinske isplate u celosti ili delimično, navedeni povrat se vrši na bankovni račun bankarske kartice sa koje je izvršeno bezgotovinsko plaćanje. Postupak povrata sredstava sprovodi se uz učešće ovlašćenog operatora za prihvatanje plaćanja ili operatora elektronskog novca i regulisan je pravilima međunarodnih platnih sistema, banaka (uklјučujući banku izdavaoca povezane kartice) i ostalih učesnika u platnom prometu. U slučajevima kada Pružalac usluga nije stranka u platnom prometu sa Povezanom karticom, Pružalac usluga može delovati kao lice koje prenosi zahteve Korisnika o gore navedenim pitanjima taksi službama, dispečerima ili drugom licu koje je primalac plaćanja za gore navedene operacije pomoću Povezane kartice.

3.12. Pružalac usluga zadržava pravo da u bilo kom trenutku zahteva od Korisnika da potvrdi podatke koje je on naveo u okviru Servisa, uklјučujući podatke Povezane kartice, i s tim u vezi da zatraži prateću dokumentaciju (posebno lične dokumente) čije se nedostavljanje, po nahođenju Pružalac usluga-a, može izjednačiti sa davanjem lažnih podataka i dovesti do posledica predviđenih tačkom 2.5 ovih Uslova.

3.13. Odredbe o uslovima i način plaćanja usluge prevoza putnika i prtlјaga, navedene u ovom odelјku, ne primenjuju se u slučaju kada se plaćanje takve usluge vrši za Korisnika od strane trećeg lica pod uslovima posebnog ugovora koji je zaklјučio Pružalac usluga sa trećim licem.
