Terms of Use of Yandex Go

 

PLEASE READ THESE TERMS CAREFULLY BEFORE ACCESSING OR USING YANDEX GO.

 

1. General Provisions

1.1. These Terms (hereinafter referred to as the Terms) constitute an offer of YE Bilgi Teknolojileri Danışmanlık Limited Şirketi (hereinafter referred to as Company) to an Internet user (hereinafter referred to as the User) to use Yandex Go service (hereinafter referred to as the Service or Yandex Go) via Yandex Go application (“Application”) in Turkey.

1.2. By starting to use the Service / its certain functions, the User is deemed to have accepted these Terms and provisions of regulatory documents Privacy Policy and other regulations applicable to the usage of the Application (hereinafter referred to as Regulatory Documents), in full, without any reservations and exceptions. If the User disagrees with any provisions of the Terms and/or Regulatory Documents, the User may not use the Service.

1.3. Yandex Go enables the User to place information, free of charge, on the User’s potential demand for passenger and baggage transportation services or other services, including delivery services (if available in the country via Yandex Go) of available transportation providers, look through offers of organizations providing services in the said fields, and search for such offers using parameters set by the User. All currently available functions of the Service along with any developments and/or newly added functions are subject to these Terms.

YOU ACKNOWLEDGE THAT COMPANY DOES NOT PROVIDE TRANSPORTATION SERVICES OR FUNCTION AS A CARRIER AND THAT ALL SUCH TRANSPORTATION SERVICES ARE PROVIDED BY THIRD PARTY – TRANSPORTATION PROVIDERS, WHO ARE NOT EMPLOYED BY COMPANY OR ANY OF ITS AFFILIATES. THE RELATIONS BETWEEN YOU AND TRANSPORTATION PROVIDERS ON THE ACQUISITION OF SERVICES ARE REGULATED BY RELEVANT AGREEMENTS BETWEEN YOU AND TRANSPORTATION PROVIDER, COMPANY IS NOT THE PARTY OF THESE AGREEMENTS.

1.4. Depending on the User’s region, any or all functions of the Service can be inaccessible or limited. Functions are deemed to be inaccessible (limited) for the User from a certain region, if such User is unable to use them explicitly. It is prohibited to apply any technical and software-based methods to circumvent these limitations. Provisions hereof governing functions of the Service inaccessible (limited) for the User will apply until such functions become explicitly accessible for the User. Information on the accessibility of functions of the Service in a certain region shall be provided to the User upon his or her request sent to the Company.

1.5. For the avoidance of doubt, the Company does not provide passenger and baggage transportation services or other services, including delivery services, and help desk services.

1.6. All conversations the User holds with the support team and drivers of transportation providers - partners of the Service can be recorded to control quality and improve services.

1.7. By using the Service, the User consents to receive promotional messages, including emails and messages. The User may unsubscribe from promotional messages by using relevant functions of the Service or following instructions specified in a promotional message received.

 

2. Use of the Service. Certain Functions of the Service

2.1. The Service is provided to the User for personal non-commercial use, free of charge.

2.2. Through the Application, the User has the option to place information, free of charge, on the User’s potential demand for passenger and baggage transportation services or other services, including delivery services (if available in the country via Yandex Go) from a range of available transportation providers. The list of partners is available at https://Yandex Go.com/partners. as set by regulatory authorities.

2.3. Users have the option to specify their destination in the Application. The estimated fee and estimated arrival time generated by the Application when a destination is entered should be regarded as approximate values. Importantly, toll fees for bridges and highways are not factored into these estimates. It's essential to note that the actual fee and arrival time may vary due to factors like the chosen route or the traffic preferences of the Driver or User. The Company will not assume responsibility for discrepancies in fees or arrival times.

2.4. The User is responsible for covering any toll charges (such as those for bridges and highways) to the transportation providers as mandated by the applicable laws. These toll fees are in addition to the fare determined by the transportation providers’ taximeter for trips booked through the Application.

2.5. Information on passenger and baggage transportation services or other services (hereinafter referred to as the Information) is provided by third parties (partners)- transportation providers. For more information about the services offered (including Wi-Fi access point availability in the cabin, in-cabin photo / video surveillance by the Company's partner, and other information), the User may contact the partners of the Service - transportation providers or provide their contact details through the functions of the Service for the partners of the Service to independently contact the User and provide them with information about the services offered.

2.6. The Company shall not be held liable for the content and/or relevance of information provided by the partners of the Service - transportation providers, including information on the cost and current availability of the transportation providers’ benefits. The User shall independently (without the participation of Company) discuss the acquisition of services with the transportation providers in accordance with the transportation providers’ rules on the provision of transportation services. Company shall not be held liable for financial, and any other transactions effected by the User and the transportation providers and for any consequences of the acquisition of the transportation providers’ services by the User.

2.7. The User may access functions of rating the services of the Service partners - transportation providers and commenting / leaving feedback on the Service and/or services of the transportation providers. Users’ ratings and feedback are posted on the Service website and can be available on third-party websites. The Company reserves the right to refuse to post any ratings / feedback and delete / block, at any time, any rating / feedback the User posted, at own discretion and without giving any reason.

2.8. The Company reserves the right, at its own discretion, to limit user access to the Service (or to certain functions of the Service, if technologically feasible) using the User's account or block the User’s entire account upon multiple violations hereof or take any other measures against the User to respect legislative requirements or third-party rights and legitimate interests.

2.9. Passenger and baggage transportation services as per Yellow Coloured Taxi, Turquise Coloured Taxi, Black Coloured Taxi (where applicable) are rendered by different types of vehicles. Vehicles are ranked automatically based on vehicle performance data provided by the partners of the Service.

2.10. If the Service supports ordering rides in advance (hereinafter, "pre-ordered rides") in certain Service tariffs, the order will be available for the Service partner to confirm near the time specified by the User in the order (no earlier than 30 minutes before the pre-ordered ride is scheduled to start). The cost of the pre-ordered ride will be calculated and indicated in the Service when the ride is ordered. The price may change in circumstances listed on the Service website https://go.yandex/en_tr.

2.11. A transportation provider charges fees for a trip cancelled by the User, if such cancellation took place after the vehicle's arrival to the place the User had appointed. The amount of such fees is calculated the same way as the cost of trip/service as per tariff for a period of time from when the vehicle actually arrived at the pick-up place or from the time of arrival specified in information the transportation provider submitted to the User regarding the transportation of the User/Users’ parcel ordered (whichever comes later) until the User cancelled the trip/service. The User shall cancel a trip/service by sending a relevant notice to the transportation provider via the Service. A User that has not boarded a vehicle served by the transportation provider within ten (10) minutes considering no-charge waiting time specified in a respective tariff is deemed to have cancelled a trip/service, unless otherwise stipulated by the relevant transportation provider's rules or agreements between the User and a representative (driver) of the transportation provider. The cancellation fee for airport-to-city transfers is calculated as described above plus an additional fee charged for out-of-town ride as per tariff.

2.12. The User authorizes the Company to process personal information (including personal details) of the User of Service (Yandex Go) or a person in respect of which the User places information through the Service about the potential demand for services involving the transportation of passengers and their baggages. The User authorizes the Company to transfer such personal information to the companies that are the parts of the same group of companies with the Company, and to the partners of the Service. The User authorizes the companies that are the parts of the same group of companies with the Company and the partners of the Service to process personal information for providing the services to the User or to the person specified by the User within the Service.

2.13. In case the User’s mobile phone is stolen or lost or used by third parties, the Company cannot be held liable for any payments made over the App.

2.14. In the event that the User accidentally leaves any belongings in the vehicle, they have the option to contact the Company's User service and request assistance in reaching the Driver. Under these circumstances, the Company's User service will get in touch with the Driver regarding the lost item, and if the Driver confirms its presence in the vehicle, both the User and the Driver can mutually exchange their contact details to facilitate the retrieval of the lost item.

During the process of returning the lost item to the location specified by the User, the Driver may activate the taxi meter. It's important to note that the Company's role is limited to facilitating communication between the User and the Driver for the purpose of recovering lost items, and the Company cannot be held responsible in any way.

2.15. If the User has complaints about Drivers, they can report such issues through the complaints section within the Application. In response, the Company will follow its established policies and may choose to discontinue its partnership with transportation services providers who receive repeated complaints, at its own discretion.

Nevertheless, it's important to understand that the Application primarily serves as a technological platform designed to facilitate connections between Drivers and Users. Consequently, the Company cannot be held accountable for any actions or oversights of the transportation providers and\or their Drivers.

2.16. User agrees not to take any action that could be abusive of the services offered by the Company free of charge.

2.17. The Company reserves the right to suspend or terminate the User’s membership to the Application in case the User breaches these Terms.

2.18. The User commits to using the Application in a lawful and responsible manner, understanding that they will bear legal responsibility for any unlawful activities conducted through the App. The Company cannot be held responsible, either directly or indirectly, for any illegal transactions or actions carried out by the User within or via the Application.

2.19. The Company holds no liability in the event that the User encounters technical difficulties preventing them from utilizing the services within the Application due to their actions. Consequently, the User is not entitled to make any claims against the Company in such instances.

2.20. The User acknowledges that the Company cannot be held accountable, whether directly or indirectly, for any transactions or actions conducted by the transportation providers, the Driver or third parties in violation of the Terms or applicable laws through the Application or using the App.

2.21. The User accepts full responsibility for safeguarding and maintaining the security of their system access credentials (such as username and password) necessary for accessing the services provided by the Company through the Application.

2.22. The User agrees not to reproduce, duplicate, distribute, or manipulate any content within the Application, including but not limited to images, text, visual and auditory content, video clips, files, databases, catalogs, and lists, in a manner that infringes upon the real or personal rights and assets of the Company or any third parties.

2.23. Periodically, the Company may extend promotional offers or campaigns to the User. To take advantage of these promotions or campaigns, the User must adhere to the specified conditions and refrain from engaging in fraudulent activities, such as colluding with Drivers to exploit the promotion/campaign, making deceptive statements, or creating false User profiles.

2.24. The Company retains the right to withdraw, suspend, or terminate the User's access to the Application if the User breaches the conditions associated with a particular campaign or promotion and/or engages in fraudulent activities. If the User disagrees with the Company's decision in such cases and believes they have not violated the stipulated terms, they may contact the Company's User Service to raise an objection.

 

3. Cancellation

The User has the option to terminate their account in the service at any time without providing a specific reason either via the Application or by contacting the support service at support.taxi@go.yandex.com.

 

4.Personal Data Protection

4.2. The User acknowledges, affirms, and commits to the following:

(i) The information provided in the registration form is accurate.

(ii) Each User profile can be associated with only one mobile phone number.

(iii) A new mobile phone number can be linked to a User profile solely by creating a new profile within the App.

(iv) The User assumes full responsibility for all transactions conducted using their registered mobile phone number.

 

5. Governing law and dispute resolution

5.1. These Terms of Use of Yandex Go arising out of or in connection with these Terms shall be governed by and construed in accordance with laws of Turkey.

5.2. Any disputes arising out or in connection with these Terms of Use shall be settled by Istanbul (Central) Courts and Execution Offices.

 

6. Force Majeure

The Company shall not bear responsibility for delays, partial execution, or non-execution of any of its obligations as outlined in the Terms of Use in the event of a Force Majeure Event. During the occurrence and duration of such events, no claims for compensation shall be made against the Company. The term "force majeure" encompasses, but is not limited to, circumstances such as natural disasters, civil disturbances, war, labor strikes, communication disruptions, pandemics, infrastructure and internet failures, power outages, and adverse weather conditions. It refers to events that are beyond the reasonable control of the Company and cannot be prevented despite the exercise of due diligence.

 

7. Termination

These terms shall remain in force and effective until the User chooses to terminates its account. The Company reserves the unilateral right to terminate the User's account if the User violates the provisions outlined in these Terms or any rules or policies specified within the Application.

 

8. Amendments to the Terms and Regulatory Documents

8.1. This Terms and Regulatory Documents may be unilaterally amended by the Company, at any time without notice to the User. User notification of the amendments introduced to the Terms of Use of Yandex Go posted at: https://yandex.com/legal/yandexgo_termsofuse. The said amendments to the Terms shall come into effect from the date of their publication, unless otherwise specified in the relevant publication. The User bears a risk of failure to review a new version of the Terms and Regulatory Documents. Any continued use of the Service after the Terms or Regulatory Documents have been changed will qualify as the acceptance of the new version.

8.2. The User shall stop using the Service, if he or she disagrees with any amendments to these Terms Company made as prescribed by s. 5.1 hereof.

9. Terms and restrictions of marketing benefits and campaigns

The terms and restrictions presented in connection with advertisements and campaigns of Yandex Go are always applied to such advertisements and campaigns..
