Terms of Use of Yandex.Taxi (Yandex Go)

1. General Provisions

1.1. These Terms (hereinafter referred to as the Terms) constitute a proposal of Yandex.Taxi LLC (hereinafter referred to as Yandex.Taxi) to an Internet user (hereinafter referred to as the User) to use Yandex.Taxi (hereinafter referred to as the Service).

1.2. The User’s work with the Service is subject to these Terms and the following documents of YANDEX LLC (OGRN: 1027700229193):

(hereinafter referred to as the Regulatory Documents).

1.3.When starting using the Service / its certain functions, the User is deemed to have accepted these Terms and the terms of the Regulatory Documents, in full, without qualification or exception. If the User disagrees with any provision of the Terms and/or Regulatory Documents, the User shall not use the Service.

1.4. Yandex.Taxi may, at any time without notice to the User, amend these Terms, and YANDEX LLC may, at any time without notice to the User, amend the Regulatory Documents. The current version of these Terms can be found at: https://yandex.ru/legal/taxi_termsofuse. The risk of failing to read a revised version of the Terms and Regulatory Documents shall be borne by the User; continued use of the Service once the Terms or Regulatory Documents were amended shall constitute consent to the revised version thereof.

1.5. The User shall stop using the Service, if it disagrees with any amendments to these Terms made by Yandex in the manner prescribed by cl. 1.4 hereof.

1.6. The Service enables the User to place information, free of charge, on the User’s potential demand for services involving transportation of passengers and baggage and to look through offers of organizations rendering the said services and to search for such offers using parameters set by the User. All currently available functions of the Service as well as any developments thereof and/or newly added functions are subject to these Terms.

1.7. Depending on the User’s region, any or all functions of the Service can be inaccessible or restricted. The functions are deemed to be inaccessible (restricted) for the User from a certain region, if such User is unable to use them explicitly. It is prohibited to apply any technical and software-based methods to circumvent these restrictions. The provisions of these Terms governing functions of the Service that are inaccessible (restricted) for the User shall not be applied until such functions become explicitly accessible for the User. Information on the accessibility of functions of the Service in a certain region shall be provided to the User upon its request sent to Yandex.Taxi.

Depending on the User’s region, if the User does not have access to the Internet, it can have an opportunity to contact Yandex.Taxi help desk for assistance in using the Service. In this case, the Yandex.Taxi help desk’s specialist acts on behalf of and under instructions of the User, rights and obligations under these Terms arise directly for the User. Yandex.Taxi informs about the availability of such an opportunity on the Service's website https://taxi.yandex.ru by pointing the appropriate phone number of the Yandex.Taxi help desk. Yandex.Taxi help desk in these Terms is understood as internal division and specialists of Yandex.Taxi, as well as Yandex.Taxi contractors and its specialists performing duties of Yandex.Taxi help desk. All User conversations with Yandex.Taxi help desk’s specialists, as well as taxi service drivers, can be recorded for quality control and service improvement purposes.

1.8. By using the Service, the User gives its consent to receive advertising messages. The User may refuse to receive advertising messages by using the relevant functionality of the Service or following instructions specified in the received advertising message.

1.9. Depending on the User’s region, there is additional insurance for passengers and taxi drivers during the trip. More information about additional insurance can be found at: https://yandex.ru/support/taxi/insurance.html.

 

2. Use of the Service. Certain Functions of the Service

2.1. The Service is provided to the User for personal, non-commercial use.

2.2. Information on services for transportation of passengers and baggage (hereinafter referred to as the Information) is provided by partners of the Service. The list of partners can be found at http://taxi.yandex.ru/partners. To get more details on services offered (including the information on the availability of Wi-Fi hotspot inside the taxi, carrying out of photo/video recording inside the taxi by the Right Holder's partners or other information), the User can either address partners of the Service or provide its contact information through the functionality of the Service, which can be used by partners of the Service to contact the User on their own and provide it with the information on services offered.

2.3. Yandex.Taxi shall not be held liable for the content and/or relevance of information provided by partners of the Service, including any information on the cost of the partners’ services and their current availability. The User shall communicate with the partners on issues relating to acquisition of services on its own (without Yandex.Taxi being involved) in accordance with guidelines for services established by the partners. Yandex.Taxi shall not be held liable for financial and any other transactions effected by the User and the partners and for any consequences following acquisition of the partners’ services by the User.

2.4. The User can access functions to rate services of partners of the Service and to comment / leave feedback on the Service and/or services of partners of the Service. Ratings and feedback of users are posted on the Service website and can be found on third-party websites. When turning to the said functions, the User undertakes to meet the requirements to the user's content stipulated by Section 4 and 5 of the User Agreement for Yandex Services available at: (https://yandex.ru/legal/rules). Yandex.Taxi reserves the right to refuse to post any ratings / feedback and to remove / block, at any time, any rating / feedback posted by the User at own discretion and without giving any reason.

2.5. Yandex.Taxi reserves the right, at own discretion, to restrict access of the User to the Service (or to certain functions of the Service, if technically feasible) using its account or to block the User’s entire account upon multiple violations of these Terms, or to take any other measures against the User to adhere to legislative requirements or third-party rights and legitimate interests.

2.6. When the demand for taxi services is higher (including days before holidays, days of mass events and other cases), tariffs of the Service can be increased. Yandex.Taxi informs of tariff increases by posting the relevant notice on the Service website http://taxi.yandex.ru or by any other means at Yandex.Taxi’s discretion, inter alia, by sending an information message to the User to its mobile phone number.

2.7. Services for transportation of passengers and baggage as per Economy, Comfort, Business tariffs and other tariffs represented on the Service are rendered by different types of vehicles. Yandex.Taxi ranks vehicles independently based on vehicle performance data provided by partners of the Service.

2.8. The taxi service charges a cancellation fee, in case of User’s refusal of transport services, occurred after the car arrival to the pickup location appointed by the User. The amount of such fee is calculated similar to transport services fee for the period from the moment of actual car arrival to the pickup location or from the moment specified in information notice sent to the User by the taxi service as a moment of the car arrival to the pickup location (depending on what have taken place later) to the moment of User’s refusal of transport services. The User makes the refusal of transport services sending the information notice to the taxi service by the Service. Unless otherwise is foreseen by the rules of the corresponding taxi service or by the agreement between User and taxi service representative (driver), the User is considered to be refused of transport services if the User hasn’t get into a car that arrived to the pickup location appointed by the User within 10 (ten) minutes including the waiting time limits specified in the corresponding transport services rate. The cancellation fee for transport services from the airport is calculated with extra charge for the car arrival to the pickup location outside the city according to the corresponding transport services rate.

2.9. The User authorizes Yandex.Taxi to process personal information (including personal records) of the User of Yandex.Taxi, to transfer personal information of the User to partners of Yandex.Taxi and to process personal information for partners of Yandex.Taxi with a view to rendering services to the User within the Service. When the User turns to the Service, personal information of the User is transferred to YANDEX LLC (OGRN: 1027700229193) for processing under the terms and for the purposes determined in the Privacy Policy of YANDEX LLC available at: (https://yandex.ru/legal/confidential).

 

3. Function of Cashless Payment for Services Involving Transportation of Passengers and Baggage

3.1. The User can pay for services involving transportation of passengers and baggage rendered to the User according to the information on the potential demand for the relevant service posted by the User through the Service:

3.1.1. Directly to a taxi service (inter alia, by cash or by any other means provided by the said taxi service, if any, hereinafter referred to in these Terms and in the Service interface as Cash). The said type of payment shall be effected without Yandex.Taxi being involved and shall not be subject to these Terms.

3.1.2. The User can access the function of cashless payment from a Linked Bank Card (cl. 3.2 hereof); in this case, Yandex.Taxi acts in the name of the relevant taxi service involving an authorized payment processor or electronic money processor and receives the payment as an agent of the taxi service (hereinafter referred to as cashless payment). Yandex.Taxi does not warrant that the operation of the Service with a view to enabling cashless payments is error- and failure-free.

The User chooses the relevant form of payment in the Service interface. In this respect, if it is impossible for any reason to make cashless payments (including, but limited to temporary technical inaccessibility of this function, temporary or constant impossibility to make cashless payments using the Linked Card, insufficient funds on the Linked Card), the User undertakes to pay by Cash.

In case of cashless payments, it is possible, at Yandex.Taxi’s discretion, to effect one transaction for the total cost of the service for transportation of passengers and baggage and several transactions for parts of the cost, both during and after the ride.

In case of cashless payments, the User may, along with payment for the service involving transportation of passengers and baggage, at own discretion, make an additional cashless payment to the taxi service as a percentage of the cost of the paid service for transportation of passengers and baggage (hereinafter referred to in these Terms and in the Service interface as Tips).

Where stipulated by current laws, in case of cashless payments a cash voucher shall be sent to the confirmed mobile phone number specified by the User when using the Service via push-notifications of Yandex.Taxi Program for mobile devices (https://taxi.yandex.ru/app) and shall be available to the User, when he or she opens such notification provided the User has not disabled push-notifications for such Program. If push-notifications or a cash voucher cannot be opened, the User can contact the help desk at https://yandex.ru/support/taxi. Some versions of Yandex.Taxi Program for mobile devices can receive push-notifications only if the Program is inactive and under other conditions, which the User is recommended to check at http://yandex.ru/support/taxi/fiscal-receipt.html.

3.2. The User may indicate the Linked Bank Card in the Service interface specifying the following data:

  • Bank card number
  • Valid through
  • Security code

If the bank card data are true, valid and it is technically feasible to use this card within the Service, the said bank card becomes the Linked one and can be used for cashless payments (cl. 3.1.2 hereof). All Linked Cards are displayed in the Service interface; for the convenience of the User, the interface displays the last 4 digits of the Linked Card’s number, which is consistent with cl. 3.8 hereof.

3.2.1. The User can also specify the Linked Card in the interface of third-party services supporting integration with the Service and parties to the settlements and authorizing the User’s payment with no information on the Linked Card transferred to Yandex.Taxi. In this case provisions of cl. 3.2 and 3.3 hereof shall not apply.

The use of third-party services specified herein is governed by rules of such third parties. Yandex.Taxi shall not be held liable for the use of such third-party services by the User and does not guarantee the proper and safe operation of such third-party services.

3.3. When the Linked Card is added and when the User chooses the function of cashless payment for a certain ride, the amount limited to RUB 11 will be charged to confirm that the Linked Card’s data are true and valid; if the transaction is successful, the said amount will be refunded to the User. An unsuccessful attempt to charge the said amount means that it is impossible to add this Linked Card and/or the function of cashless payment is inaccessible, respectively.

3.4 When adding the Linked Card and at any time after it was added, the User is able to set and/or change the default amount of Tips through the Service interface; the User can change the amount of Tips for a specific ride in the Service interface, when this ride is over.

3.5. Tips (in the default amount or in the amount specifically indicated by the User for a certain ride) will be charged from the Linked Card, if the User has, within 30 minutes after the ride is over, given positive feedback on the ride (4-5 stars) in the Service interface and clicked Done or given neither positive nor negative feedback on the ride (did not specify the number of stars) and clicked Done.

3.6. If the User has, within 30 minutes after the ride is over, given negative feedback on the ride (1-3 stars) in the Service interface and clicked Done, no Tips will be charged from the Linked Card.

3.7. If the User, within 30 minutes after the ride is over, has not clicked Done, the amount of Tips (in the default amount or in the amount specifically indicated by the User for a certain ride) will be blocked on the Linked Card for 24 hours, during which the User can increase or reduce the amount of Tips for this ride. When this time expires, the Tips will be charged in the amount specified by the User (by default or for this ride).

3.8. Yandex.Taxi has no access to the bank card data specified by the User and shall not be liable for safety and confidentiality of any data transmitted during cashless payments. Cashless payments shall be made by the User involving an authorized payment processor or electronic money processor and regulated by rules of international payment systems, banks (including the bank issuing the Linked Card) and other parties to settlements.

3.9. When indicating its data pursuant to cl. 3.2 hereof and further using the Linked Card, the User confirms and warrants that it indicated reliable and complete information on the valid bank card issued in its name; it complies with rules of international payment systems and requirements of the bank that issued the Linked Card, inter alia, with regard to the procedure of cashless settlements.

3.10. The User understands and agrees that all acts performed within the Service with the use of the mobile phone number it confirmed, including cashless payments using the Linked Bank Card, are deemed to be performed by the User.

3.11. If the User disagrees with the fact and/or the amount of cashless payment and has any other questions relating to the use of the Linked Card within the Service, it may address Yandex.Taxi by phone specified by the Service and/or via the help desk (feedback) interface within 14 days from the date of cashless payment or any other actions or events that gave grounds for the request.

If the inspection triggered by such request results in Yandex’s decision to refund the amount of cashless payment, in whole or in part, the said refund shall be made to the bank account of the bank card, with which the cashless payment was made. The procedure of refund shall be performed with the participation of an authorized payment processor or electronic money processor and regulated by rules of international payment systems, banks (including the bank issuing the Linked Card) and other parties to settlements.

3.12. Yandex.Taxi reserves the right to require the User, at any time, to confirm the data it specified within the Service, including the Linked Card data, and request supporting documents to that end (in particular, identity papers); failure to provide thereof may, at Yandex.Taxi’s discretion, be held to amount to provision of unreliable information and have effects stipulated by cl. 2.5 hereof.

 

4. Function of “Corporate taxi”

4.1. If the person (or entity) who have concluded with Yandex the separate agreement on the provision of service “Corporate taxi” have indicated the User (its telephone number) as a corporate user in such person’s (or entity’s) account provided by Yandex pursuant to such agreement, the use of the Service is performed by such person (or entity) in a favor of the User on the terms determined between such person (or entity) and the User.

4.2. The use of the Service by a person (or entity) specified in cl. 4.1 herein in a favor of the User may performed either by the means of a software or functions not available to the User, or by the means of a software or functions which are available explicitly to all the Users. In the latter case, the User acts on behalf of a person (or entity) specified in cl. 4.1, and the rights and obligations arise out of this Agreement shall be the rights and obligations of such person (or entity), including the obligation to pay for the service for transportation of passengers and baggage.
