The current version is available at: ._ **1\. General Provisions** 1\.1. These Terms (hereinafter referred to as the Terms) constitute an offer of Ridetech Georgia LLC (hereinafter referred to as Yandex.Taxi) to an Internet user (hereinafter referred to as the User) to use Yandex.Taxi (Yandex.Go) (hereinafter referred to as the Service). 1\.2. The User’s work with the Service is governed by these Terms and the following documents: - Terms of use of Promo codes ([https://taxi.yandex.com.ge/promocode/](https://taxi.yandex.com.ge/promocode/)); - Privacy Notice ([https://yandexgo.com/legal/yandexgo_privacy_notice/](https://yandexgo.com/legal/yandexgo_privacy_notice/)) (hereinafter jointly referred to as the Regulatory Documents). 1\.3. When starting using the Service / its certain functions, the User is deemed to have accepted these Terms and provisions of the Regulatory Documents, in full, without any qualification or exception. If the User disagrees with any provisions of the Terms and/or Regulatory Documents, the User may not use the Service. 1\.4. Yandex.Taxi may, at any time without notice to the User, amend provisions of these Terms and the Regulatory Documents. The risk of failing to read a revised version of the Terms and Regulatory Documents shall be borne by the User; the continued use of the Service once the Terms or Regulatory Documents have been amended shall constitute consent to the revised version thereof. 1\.5. The User shall stop using the Service, if it disagrees with any amendments to these Terms made by Yandex in the manner prescribed by cl. 1.4 hereof. 1\.6. The Service enables the User to place information, free of charge, on the User’s potential demand for services involving the transportation of passengers and baggage, look through offers of organizations providing services in the said field, and search for such offers using parameters set by the User. All currently available functions of the Service along with any developments thereof and/or newly added functions are subject to these Terms. 1\.7. Depending on the User’s region, any or all functions of the Service can be inaccessible or limited. The functions are deemed to be inaccessible (limited) for the User from a certain region, if such a User is unable to use them explicitly. It is prohibited to apply any technical and software-based methods to circumvent these limitations. Provisions of these Terms governing functions of the Service inaccessible (limited) for the User shall not be applied until such functions become explicitly accessible for the User. Information on the accessibility of functions of the Service in a certain region shall be provided to the User upon its request sent to Yandex.Taxi. 1\.8. For the avoidance of doubt, Yandex.Taxi does not provide services involving the transportation of passengers and baggage and help desk services. 1\.9. All conversations the User holds with the support team and drivers of partners of the Service can be recorded to control quality and improve services. 1\.10. By using the Service, the User gives its consent to receive advertising messages. The User may refuse to receive advertising messages by using the relevant functionality of the Service or following instructions specified in the received advertising message. **2\. Use of the Service. Certain Functions of the Service** 2\.1. Service is provided to the User for personal non-commercial use. 2\.2. Information on services involving the transportation of passengers and baggage (hereinafter referred to as the Information) is provided by partners of the Service. The list of partners is available at [http://taxi.yandex.com/partners/](http://taxi.yandex.com/partners/). To get more details on services offered (including the information on the availability of Wi-Fi hotspot inside the taxi, carrying out of photo/video recording inside the taxi by the Right Holder's partners or other information), the User can either address partners of the Service or provide its contact information through the functionality of the Service, which can be used by partners of the Service to contact the User on their own and provide it with the information on services offered. 2\.3. Yandex.Taxi shall not be held liable for the content and/or relevance of information provided by the Service’s partners, including information on the cost of the partners’ services and on their current availability. The User shall independently (without the participation of Yandex.Taxi) discuss the acquisition of services with the partners in accordance with the partners’ rules on the provision of services. Yandex.Taxi shall not be held liable for financial and any other transactions effected by the User and the partners and for any consequences of the acquisition of the partners’ services by the User. 2\.4. The User access functions to rate services of the Service’s partners and comment / leave feedback on the Service and/or services of the Service’s partners. Ratings and feedback of users are posted on the Service website and can be found on third-party websites. Yandex.Taxi reserves the right to refuse to post ant ratings / feedback and remove / block, at any time, any rating / feedback posted by the User at own discretion and without giving any reason. 2\.5. Yandex.Taxi reserves the right, at own discretion, to limit access of the User to the Service (or to certain functions of the Service, if technologically feasible) using its account or block the User’s entire account upon multiple violations of these Terms, or take any other measures against the User to respect legislative requirements or third-party rights and legitimate interests. 2\.6. When the demand for taxi services is higher (including days before holidays, days of mass events and other cases), tariffs of the Service can be increased. Yandex.Taxi informs of tariff increases by posting the relevant notice on the Service website [http://taxi.yandex.com/](http://taxi.yandex.com/) or otherwise, if Yandex.Taxi so decides, inter alia, by sending an information message to the User’s mobile phone number. 2\.7. Services involving the transportation of passengers and baggage as per Economy, Comfort, Business tariffs and other tariffs represented on the Service are rendered by different types of vehicles. Vehicles are ranked automatically based on vehicle performance data provided by the Service’s partners. 2\.8. Cancellation of a request may be subject to a fee in the following cases: (1) If the User cancels a request via the service after a car has arrived or fails to come to the car within 30 minutes after it has arrived (taking into account the free waiting time). In this case, the cost of the paid cancellation is calculated as the sum of: (a) the minimum cost within the corresponding tariff; (b) the number of minutes of waiting exceeding the number of free waiting minutes, but not more than 30 minutes, multiplied by the cost of a minute of paid waiting according to the tariff selected by the User. (2) If the User cancels a request with paid arrival via the service three (3) minutes after it is confirmed in the service interface. In this case, the cost of paid cancellation does not exceed the sum of the minimum cost of services according to the corresponding tariff and the cost of paid dispatch. No fee is charged for canceling a request with paid arrival if the estimated time of car arrival increases by more than 2 minutes compared to the time indicated in the service interface when the request was confirmed. (3) When canceling a request to the airport, city tariff is applied, with the exception of the cost of arrival, which is calculated as a car arrival outside the city according to the tariff. 2\.9. Depending on the location of the User and the availability of vehicles at the User's location, the User may be offered to order a Transportation service using a vehicle from a more remote location for an additional fee ("Paid Delivery"). The price of the Paid Delivery will be calculated based on (1) the distance between the respective vehicle and the User's location and (2) the time required for such vehicle to cover this distance. The User may accept or reject the Paid Delivery at his own discretion by clicking the appropriate button in the Yandex Go mobile application. In case of acceptance of the Paid Delivery, the price of the Paid Delivery will be added to the price of the Transportation service. After the order, including the Paid Delivery, is accepted, the User is given free cancellation period (Free Cancellation Period). The term of the Free Cancellation Period is calculated for each order and is brought to the attention of the User in the Yandex Go mobile application. If the User decides to cancel the order upon expiration of the Free Cancellation Period (late cancellation), the User will be charged the full cost of the Paid Delivery (applicable only to Transportation services, which are paid by bank card). 2\.10. By using the Service the User gives its consent to Yandex.Taxi to process personal information (including personal details) of the User, to transfer personal information of the User to Yandex.Taxi’s partners and to process personal information of the User by Yandex.Taxi’s partners to provide services to the User within the Service. By using the Service the personal information of the User is to be processed under the terms and for the purposes determined in the Privacy Notice available at: [https://yandexgo.com/legal/yandexgo_privacy_notice/](https://yandexgo.com/legal/yandexgo_privacy_notice/). The User acknowledges and agrees that, if the User is a member of a shared account under Section 4 hereof and makes a trip upon posting of information on its potential demand via the Service using the Yandex.Taxi application for mobile devices, the information on such a trip also becomes available to the person who created such a joint account. 2\.11. If the User orders courier delivery services, the User shall not offer the following items for delivery: - Handguns, civilian and service weapons, ammunition, spare parts and accessories for them, bows and crossbows for shooting sports, weapons for light, smoke and sound signals, electric weapons, stun guns and flash guns, edged cold weapons, flails, brass knuckles, shuriken, boomerangs, and other makeshift items of percussion, shattering, throwing action, pointed or bladed items, except for sports equipment, special dual-use technical equipment and accessories for them; - Narcotic drugs, psychoactive substances, precursors and their equivalents; - Nuclear materials, radioactive, potent, corrosive, explosive or flammable substances, explosives, pyrotechnic agents and products containing them, as well as other hazardous substances; - Poisons, poisonous animals, poisonous substances, poisonous plants and seeds of poisonous plants; - National currency of Georgia and foreign currencies; - Printed press, visual materials, film, photo, audio, and video materials promoting or agitating for violent changes in the constitutional order, violation of integrity of Georgia, undermining the state security, war, social, racial, national, religious, class or clan supremacy, the cult of cruelty, violence or pornography; - Perishable foods without special packaging; - Items and substances that, due to their nature or packaging, can pose a threat for people, contaminate or spoil (damage) other cargo, surrounding people or objects; - Animals and plants, biological materials; - Items requiring specially equipped vehicles for transportation, including food; - Liquids in open containers; - Large items the sum of the length, width (two diameters or axes at the base of the roll) and height exceeds 150 cm (except as expressly stipulated otherwise), long items the length of which exceeds 150 cm; the weight of the items to be delivered shall not exceed 20 kg. When ordering foot courier delivery services, the size of the items to be delivered (width, length, height) shall not exceed 50x50x50; the weight of the items to be delivered shall not exceed 10 kg; - Fragile items without special packaging; - Any other items the circulation of which is prohibited or limited in Georgia. These requirements apply fully to the User’s order of cargo transportation services, except for the restrictions related to the transportation of large items. The Service partners may impose additional restrictions on cargo transportation and courier delivery services. The User acknowledges and agrees that in case of non-compliance with the above requirements it shall bear the sole responsibility and all negative implications that may occur in the course of providing courier delivery and/or cargo transportation services by the Service partners. The Service partner also has the right to refuse to render services to the User should the Service partner/its representatives find items not allowed for delivery and/or shipment. 2\.12. Cargo transportation as requested by the User shall be carried out by the Service partners under a contract for cargo transportation executed by the parties in writing. Cargo transportation in accordance with these Terms and Conditions and the contract for cargo transportation shall be carried out only accompanied by the User (cargo owner) or its representative. When the Service partner ships cargo to the person specified by the User, this person shall be deemed the representative of the cargo owner and bear all the rights and obligations stipulated by the contract for cargo transportation and the laws of Georgia. 2\.13. If the cost of a car trip calculated using the Service’s functionality is not a multiple of 0.1 lari, the trip cost shall be rounded up to the nearest price value that is a multiple of 0.1 lari. **3\. Function of Cashless Payment for Services** 3\.1. The User can pay for services involving the transportation of passengers and baggage provided to the User in compliance with the information on potential demand for the relevant service posted by the User via the Service: 3\.1.1. directly to a taxi service (inter alia, by cash or by any other means stipulated by the said taxi service, if any, hereinafter referred to in these Terms and the Service interface as Cash). The said payment shall be made without Yandex.Taxi being involved and shall not be governed by these Terms; 3.1.2. the User can access the function of cashless payment through a Linked Bank Card (cl. 3.2 hereof) or Apple Pay; in this case, Yandex.Taxi acts on the authority of the relevant taxi service or otherwise involving an authorized payment processor, an electronic money processor or another party to settlements or a party to communication, and receives payments as an agent of the taxi service or otherwise (hereinafter referred to as cashless payments). Yandex.Taxi does not guarantee that the operation of the Service will be error- and failure-free in view of enabling cashless payments. Depending on the User’s region, cashless payments can be made without the participation of Yandex.Taxi as a payment recipient or with the participation of Yandex.Taxi as another party to settlements or a party to communication. The User chooses the relevant form of payment in the Service interface. In this respect, if it is impossible to make cashless payments for any reason (including, but not limited to temporary technical inaccessibility of this function, temporary or constant impossibility to make cashless payments using the Linked Card, insufficient funds in the Linked Card), the User undertakes to pay by Cash. In case of cashless payments, it is possible to effect both one transaction for the total cost of the service involving the transportation of passengers and baggage and several transactions for parts of the cost, during and after the trip. In case of cashless payments, the User can, along with payment for services involving the transportation of passengers and baggage, at own discretion, make an additional cashless payment to the taxi service as a percentage of the cost of the paid service involving the transportation of passengers and baggage (hereinafter referred to in these Terms and the Service interface as Tips). 3\.2. The User shall specify the Linked Bank Card in the Service interface indicating the following details: - Bank card number - Valid through - Security code If the bank card details are true, valid and it is technically feasible to use this card within the Service, the said bank card becomes the Linked one and can be used for cashless payments (cl. 3.1.2 hereof). All Linked Cards are displayed in the Service interface; for the User’s convenience, the interface displays the last 4 digits of the Linked Card’s number. 3\.2.1. The User can also specify the Linked Card in the interface of third-party services supporting integration with the Service and parties to the settlements and authorizing the User’s payment with no information on the Linked Card transferred to Yandex.Taxi. In this case provisions of cl. 3.2 and 3.3 hereof shall not apply. The use of third-party services specified herein is governed by rules of such third parties. Yandex.Taxi shall not be held liable for the use of such third-party services by the User and does not guarantee the proper and safe operation of such third-party services. 3\.3. When the Linked Card is added and when the User chooses the function of cashless payment for a certain trip, the amount limited to 1 GEL (or any other amount in the User’s region currency) will be charged to confirm that the Linked Card details are true and valid; if the transaction is successfully effected, the said amount will be refunded to the User. Failure to charge the said amount means that it is impossible to add this Linked Card and/or the function of cashless payment is unavailable, respectively. 3\.4. When adding the Linked Card and at any time after it was added, the User can set and/or change the default amount of Tips through the Service interface; the User can change the amount of Tips for a certain trip in the Service interface, when the trip is over. 3\.5. Tips (in the default amount or in the amount specifically indicated by the User for a certain trip) will be charged from the Linked Card, if the User, within 30 minutes after the trip is over, assigns a high rating to the trip (4-5 stars) in the Service interface and clicks “Done” or assigns neither high nor low rating to the trip (does not specify the number of stars) and clicks “Done”. 3\.6. If the User, within 30 minutes after the trip is over, assigns a low rating to the trip (1-3 stars) in the Service interface and clicks “Done”, no Tips will be charged from the Linked Card. 3\.7. If the User, within 30 minutes after the trip is over, did not click “Done”, the amount of Tips (in the default amount or in the amount specifically indicated by the User for a certain trip) will be blocked in the Linked Card for 24 hours, during which the User can increase or reduce the amount of Tips for this trip. When the said time expires, the Tips will be charged in the amount specified by the User (by default or for this trip). 3\.8. Cashless payments shall be made by the User involving an authorized payment processor or electronic money processor and shall be governed by rules of international payment systems, banks (including the bank that issued the Linked card) and other parties to settlements. 3\.9. When indicating its details pursuant to cl. 3.2 hereof and further using the Linked Card, the User confirms and guarantees that it indicated reliable and full information on the valid bank card issued in its name; it complies with rules of international payment systems and requirements of the bank that issued the Linked Card, inter alia, in relation to the procedure of cashless payments. 3\.10. The User understands and agrees that all actions performed within the Service using the mobile phone number confirmed by the User, inter alia, cashless payments with the use of the Linked Bank Card or Apple Pay, are deemed to be performed by the User. 3\.11. If the User disagrees with the fact and/or the amount of cashless payments and has any other questions associated with the use of the Linked Card or Apple Pay within the Service, it may contact Yandex.Taxi by phone numbers specified by the Service and/or via the help desk (feedback) interface within 14 days from the date of cashless payments or any other actions or events that prompted the request. If, following the inspection caused by such a request, Yandex.Taxi decides to refund the cashless payment amount, in whole or in part, the said amount shall be refunded to the bank account of the bank card, with which the cashless payment was made. The refund shall be made involving an authorized payment processor or electronic money processor and governed by rules of international payment systems, banks (including the bank that issued the Linked Card) and other parties to settlements. If Yandex.Taxi is not a party to settlements made by the Linked Card or Apple Pay, Yandex.Taxi can act as a body that transfers Users’ above requests to taxi services, dispatch offices or any other person being a recipient of payments under the above transactions with the Linked Card. 3\.12. Yandex.Taxi reserves the right to require, at any time, from the User to confirm the details it specified within the Service, including the details of the Linked Card, and request supporting documents in this regard (in particular, identity documents); failure to provide these documents can, at Yandex.Taxi’s discretion, be deemed amounting to the provision of unreliable information and have implications stipulated by cl. 2.5 hereof. 3\.13. The provisions on the terms and procedure of payment for services involving the transportation of passengers and baggage specified in this Section shall not apply, when a third party pays for such services instead of the User under a contract signed by Yandex.Taxi with such a third party. **4\. Shared Account Feature** 4\.1. The User may have the option to create a shared account in Yandex.Taxi for mobile devices, i.e., the possibility to use the Service by several Users from one created account, as well as to make non-cash payments for transportation of passengers and baggage/other services by the shared account members with the bank card of the User that has created the shared account, which is linked to the shared account. 4\.2. In order to create a shared account, the User shall provide the following information: - The User’s phone number - E-mail - Phone numbers of third parties who will be the shared account members - Linked Bank Card details listed in Clause 3.2 hereof The User may specify other data as necessary. 4\.3. As part of the Shared Account feature, the User has the option to create the following types of shared accounts: 4\.3.1. Family account. 4\.3.2. Business account. 4\.4. The number of participants within the family account should not exceed 4 (four) customers. 4\.5. Business accounts within the number of participants should not exceed 20 (twenty) customers. Customers may receive offers of additional features and services for a separate fee. 4\.6. To use the Shared Account feature, the account members whose mobile phone numbers were specified by the User as per Clause 4 hereof shall install Yandex.Taxi on their mobile devices. 4\.7. When a member posts information on a potential request for transportation of passengers and baggage/other services, the member shall indicate that the Service is being used using the Shared Account feature in the Service interface. 4\.8. The User shall familiarize the shared account members with the terms of using the Shared Account feature, obtain their consent to receive technical and other messages necessary to use the Shared Account feature. **5\. Yandex Taxi‑ს უფლება აქვს, ნებისმიერ დროს, მომხმარებლის წინასწარი გაფრთხილების გარეშე, შეიტანოს ცვლილებები როგორც წინამდებარე პირობების, ისე მარეგულირებელი დოკუმენტების დებულებებში. პირობების მიმდინარე რედაქცია ხელმისაწვდომია მისამართზე [https://yandexgo.com/legal/yandexgo_termsofuse](https://yandexgo.com/legal/yandexgo_termsofuse). პირობებსა და მარეგულირებელ დოკუმენტებში შეტანილი ცვლილებების დროულად გაცნობაზე პასუხისმგებლობას საკუთარ თავზე იღებს მომხმარებელი; პირობებსა და მარეგულირებელ დოკუმენტებში ცვლილებების შეტანის შემდეგ სერვისით სარგებლობის გაგრძელება გულისხმობს პირობებისა და მარეგულირებელი დოკუმენტების ახალ რედაქციებზე თანხმობას. 1\.5. მომხმარებელმა უნდა შეწყვიტოს სერვისით სარგებლობა, თუ ის არ ეთანხმება აღნიშნულ პირობებში Yandex‑ის მიერ შეტანილ ცვლილებებს, როგორც ეს განსაზღვრულია წინამდებარე დოკუმენტის ქვეპუნქტში 1.4. 1\.6. სერვისი საშუალებას აძლევს მომხმარებელს, უსასყიდლოდ განათავსოს ინფორმაცია მგზავრებისა და ბარგის ტრანსპორტირების მომსახურების მისი მხრიდან პოტენციური საჭიროების შესახებ, გაეცნოს იმ ორგანიზაციების შემოთავაზებებს, რომლებიც აღნიშნულ სფეროში სთავაზობენ მას მომსახურებას, და, ასევე, მოიძიოს ამგვარი შემოთავაზებები მომხმარებლის მიერ დაყენებული პარამეტრების მიხედვით. სერვისის ამჟამად ხელმისაწვდომ ყველა ფუნქციაზე, ასევე, მათ ნებისმიერ განახლებაზე ან/და ახალდამატებულ ფუნქციებზე ვრცელდება წინამდებარე პირობები. 1\.7. მომხმარებლის რეგიონის მიხედვით, სერვისის ნებისმიერი ან ყველა ფუნქცია, შესაძლოა, მიუწვდომელი ან შეზღუდული იყოს. კონკრეტულ რეგიონში მყოფი მომხმარებლისთვის ფუნქციები მიუწვდომლად (შეზღუდულად) ითვლება, თუ აღნიშნული მომხმარებელი აშკარა სახით ვერ ახერხებს მათით სარგებლობას. აღნიშნული შეზღუდვებისთვის რაიმე ტექნიკური ან პროგრამული მეთოდებით გვერდის ავლა აკრძალულია. წინამდებარე პირობების დებულებები, რომლებიც არეგულირებს სერვისის მომხმარებლისთვის მიუწვდომელ (შეზღუდულ) ფუნქციებს, არ იმოქმედებს, სანამ აღნიშნული ფუნქციები აშკარა სახით არ იქნება ხელმისაწვდომი მომხმარებლისთვის. კონკრეტულ რეგიონში სერვისის ფუნქციების ხელმისაწვდომობის შესახებ ინფორმაცია მომხმარებელს მიეწოდება მის მიერ Yandex Taxi‑სთვის გაგზავნილი მოთხოვნის საფუძველზე. 1\.8. გაუგებრობის თავიდან აცილების მიზნით განვმარტავთ, რომ Yandex Taxi არ უზრუნველყოფს მგზავრებისა და ბარგის ტრანსპორტირების მომსახურებებს, ასევე, არც ტექნიკური მხარდაჭერის სამსახურს. 1\.9. მომხმარებლის ყველა საუბარი მხარდაჭერის სამსახურთან და სერვისის პარტნიორების მძღოლებთან, შესაძლოა, ჩაწერილ იქნას ხარისხის კონტროლისა და სერვისის გაუმჯობესების მიზნით. 1\.10. სერვისის გამოყენებით მომხმარებელი თანხმობას აცხადებს სარეკლამო შეტყობინებების მიღებაზე. მომხმარებელს საშუალება აქვს, უარი განაცხადოს სარეკლამო შეტყობინებების მიღებაზე, სერვისის შესაბამისი ფუნქციონალის ან მიღებულ სარეკლამო შეტყობინებაში მოცემული მითითებების საშუალებით. **2\. სერვისით სარგებლობა. სერვისის კონკრეტული ფუნქციები** 2\.1. სერვისი მომხმარებელს მიეწოდება პირადი, არაკომერციული გამოყენების მიზნით. 2\.2. მგზავრებისა და ბარგის ტრანსპორტირების მომსახურებების შესახებ ინფორმაცია (შემდგომში მოხსენიებული, როგორც „ინფორმაცია“) უზრუნველყოფილია სერვისის პარტნიორების მიერ. პარტნიორების სია ხელმისაწვდომია მისამართზე [http://taxi.yandex.com/partners](http://taxi.yandex.com/partners). შემოთავაზებული მომსახურებების შესახებ დეტალური ცნობებისთვის (ტაქსის სალონში Wi‑Fi ქსელის ხელმისაწვდომობის, უფლებების მფლობელის პარტნიორის მიერ ტაქსის სალონში ფოტო‑/ვიდეოგადაღების და სხვა ინფორმაციის ჩათვლით) მომხმარებელს შეუძლია, მიმართოს სერვისის პარტნიორებს, ან სერვისის ფუნქციონალის საშუალებით დატოვოს თავისი საკონტაქტო მონაცემები, რომელთა გამოყენებითაც სერვისის პარტნიორები შემდეგ შეძლებენ მასთან დამოუკიდებლად დაკავშირებასა და მისთვის შეთავაზებული მომსახურებების შესახებ ინფორმაციის მიწოდებას. 2\.3. Yandex Taxi პასუხს არ აგებს სერვისის პარტნიორების მიერ მოწოდებული ინფორმაციის შინაარსზე ან/და აქტუალობაზე, მათ შორის, არც ინფორმაციაზე პარტნიორების მომსახურებების ღირებულებისა და ამა თუ იმ მომენტში მათი ხელმისაწვდომობის შესახებ. მომხმარებელი დამოუკიდებლად (Yandex Taxi‑ს მონაწილეობის გარეშე) ათანხმებს პარტნიორებთან მომსახურებათა უზრუნველყოფის საკითხს, პარტნიორების მხრიდან მომსახურებათა გაწევის წესების შესაბამისად. Yandex Taxi პასუხს არ აგებს მომხმარებლისა და პარტნიორების ფინანსურ თუ ნებისმიერ სხვა სახის გარიგებებზე, ასევე, მომხმარებლის მიერ პარტნიორების მომსახურებებით სარგებლობის შედეგებზე. 2\.4. მომხმარებლისთვის ხელმისაწვდომია სერვისის პარტნიორების მომსახურებათა შეფასების, ასევე, სერვისის ან/და სერვისის პარტნიორების მომსახურებათა შესახებ კომენტარების/გამოხმაურებების დატოვების ფუნქციები. მომხმარებელთა შეფასებები და გამოხმაურებები ქვეყნდება სერვისის ვებსაიტზე, ხოლო მათი ნახვა შესაძლებელია მესამე მხარის ვებსაიტებზეც. Yandex Taxi იტოვებს უფლებას, უარი განაცხადოს შეფასებების/გამოხმაურებების გამოქვეყნებაზე და ნებისმიერ დროს წაშალოს/დაბლოკოს მომხმარებლის მიერ გამოქვეყნებული ნებისმიერი შეფასება/გამოხმაურება, თავისი შეხედულებისამებრ, მიზეზის ახსნის გარეშე. 2\.5. Yandex Taxi იტოვებს უფლებას, თავისი შეხედულებისამებრ შეუზღუდოს მომხმარებელს წვდომა სერვისზე (ან სერვისის ცალკეულ ფუნქციებზე, თუ ეს ტექნიკურად შესაძლებელია) მისი ანგარიშის მეშვეობით, ან სრულად დაბლოკოს მომხმარებლის ანგარიში, წინამდებარე პირობების არაერთგზის დარღვევის შემთხვევაში, ანდაც მომხმარებლის მიმართ გამოიყენოს სხვა ზომები კანონმდებლობის ან მესამე მხარეთა უფლებებისა თუ ინტერესების დაკმაყოფილების მიზნით. 2\.6. ტაქსის მომსახურებაზე გაზრდილი მოთხოვნის პერიოდში (წინასადღესასწაულო დღეების, მასობრივი ღონისძიებების გამართვის დღეებისა და სხვა შემთხვევების ჩათვლით) სერვისის ტარიფები, შესაძლოა, გაიზარდოს. ტარიფების ზრდის შესახებ ინფორმაციას Yandex Taxi ავრცელებს სერვისის ვებსაიტზე [http://taxi.yandex.com](http://taxi.yandex.com) შესაბამისი შეტყობინების განთავსების გზით, ან სხვაგვარად, Yandex Taxi‑ს გადაწყვეტილების შესაბამისად, მათ შორის, მომხმარებლის მობილური ტელეფონის ნომერზე საინფორმაციო შეტყობინების გაგზავნის საშუალებით. 2\.7. მგზავრებისა და ბარგის ტრანსპორტირების მომსახურებები „ეკონომის“, „კომფორტის“, „ბიზნესის“ და სერვისში წარმოდგენილი სხვა ტარიფებით ხორციელდება სხვადასხვა ტიპის ავტომობილებით. ავტომობილები რანჟირდება ავტომატურად, ავტომობილების წარმადობის მაჩვენებლების შესახებ სერვისის პარტნიორების მიერ მოწოდებული მონაცემების საფუძველზე. 2\.8. მოთხოვნის გაუქმება, შესაძლოა, დაექვემდებაროს მოსაკრებლის გადახდას შემდეგ შემთხვევებში: (1) თუ მომხმარებელი მოთხოვნას სერვისის მეშვეობით გააუქმებს მას შემდეგ, რაც ავტომობილი მის ასაყვანად მივა, ან მომხმარებელი არ გამოცხადდება აყვანის ადგილზე ავტომობილის მისვლიდან 30 წუთის განმავლობაში (უფასო ლოდინის დროის გათვალისწინებით). ასეთ შემთხვევაში ფასიანი გაუქმების ღირებულება გამოითვლება, როგორც შემდეგი კომპონენტების ჯამი: (ა) მინიმალური ღირებულება, რომელსაც ითვალისწინებს შესაბამისი ტარიფი; (ბ) ლოდინის წუთების რაოდენობა (რომელიც აღემატება უფასო ლოდინის წუთების რაოდენობას, მაგრამ არ აჭარბებს 30 წუთს) გამრავლებული ფასიანი ლოდინის წუთის ღირებულებაზე, რომელსაც ითვალისწინებს მომხმარებლის მიერ არჩეული ტარიფი. (2) თუ მომხმარებელი სერვისის მეშვეობით გააუქმებს მოთხოვნას, რომელიც ითვალისწინებს ფასიან აყვანას, სერვისის ინტერფეისში მოთხოვნის დადასტურებიდან სამი (3) წუთის შემდეგ. ასეთ შემთხვევაში, ფასიანი გაუქმების ღირებულება არ აღემატება მომსახურების მინიმალურ ღირებულებასა და ფასიანი აყვანის ღირებულებას, რომლებსაც ითვალისწინებს შესაბამისი ტარიფი. მოსაკრებელი არ იქნება დაკისრებული, თუ მოთხოვნა, რომელიც ითვალისწინებს ფასიან აყვანას, გაუქმდება მაშინ, როცა ავტომობილის ადგილზე მოსვლის სავარაუდო დრო 2 წუთზე მეტით გაიზრდება, მოთხოვნის დადასტურებისას სერვისის ინტერფეისში მითითებულ დროსთან შედარებით. (3) აეროპორტის მიმართულებით მოთხოვნის გაუქმებისას მოქმედებს ქალაქის ტარიფი, რა შემთხვევაშიც გამონაკლისია დანიშნულების წერტილში მისვლის ღირებულება, რომელიც გამოითვლება, როგორც ავტომობილის მისვლა ქალაქგარეთ, შესაბამისი ტარიფის მიხედვით. 2\.9. მომხმარებლის მდებარეობისა და მის მახლობლად სატრანსპორტო საშუალებების ხელმისაწვდომობის მიხედვით, მომხმარებელს, შესაძლოა, დამატებითი საფასურის სანაცვლოდ („ფასიანი აყვანა“) შეეთავაზოს ტრანსპორტირების მომსახურების შეკვეთა სატრანსპორტო საშუალებით, რომელიც შედარებით შორს მდებარეობს. ფასიანი აყვანის ღირებულება გამოითვლება (1) შესაბამის სატრანსპორტო საშუალებისა და მომხმარებლის მდებარეობებს შორის მანძილისა და (2) იმ დროის საფუძველზე, რომელიც აღნიშნულ სატრანსპორტო საშუალებას სჭირდება ამ მანძილის დასაფარად. მომხმარებელი უფლებამოსილია, საკუთარი სურვილისამებრ, დაეთანხმოს ფასიან აყვანას, ან უარყოს ის, Yandex Go‑ს მობილურ აპში შესაბამის ღილაკზე დაჭერის გზით. ფასიან აყვანაზე თანხმობის განცხადების შემთხვევაში ფასიანი აყვანის ღირებულება დაემატება ტრანსპორტირების მომსახურების ფასს. შეკვეთის შემდეგ (ფასიანი აყვანის შემთხვევების ჩათვლით), მომხმარებელს ექნება უფასო გაუქმების პერიოდი (შემდგომში მოხსენიებული, როგორც „უფასო გაუქმების პერიოდი“). უფასო გაუქმების პერიოდის ვადა თითოეული შეკვეთისთვის ინდივიდუალურად გამოითვლება და მომხმარებელს ეცნობება Yandex Go‑ს მობილური აპლიკაციის მეშვეობით. თუ მომხმარებელი გადაწყვეტს, გააუქმოს შეკვეთა უფასო გაუქმების პერიოდის ამოწურვის შემდეგ (გვიანი გაუქმება), მომხმარებელს დაეკისრება ფასიანი აყვანის სრული ღირებულების გადახდა (ეხება მხოლოდ ტრანსპორტირების მომსახურებას, რომლის ღირებულებაც გადაიხდება საბანკო ბარათით). 2\.10. სერვისის გამოყენებით მომხმარებელი თანხმობას აცხადებს Yandex Taxi‑ს მიერ პერსონალური ინფორმაციის (მათ შორის, პერსონალური მონაცემების) დამუშავებაზე, მომხმარებლის პერსონალური ინფორმაციის Yandex Taxi‑ს პარტნიორებისთვის გადაცემასა და Yandex Taxi‑ს პარტნიორების მიერ მომხმარებლის პერსონალური ინფორმაციის დამუშავებაზე, სერვისის ფარგლებში მომხმარებლისთვის მომსახურების გაწევის მიზნით. სერვისის გამოყენებისას მომხმარებლის პერსონალური ინფორმაცია დამუშავდება კონფიდენციალურობის შესახებ იმ შეტყობინებაში განსაზღვრული პირობებისა და მიზნების შესაბამისად, რომელიც ხელმისაწვდომია მისამართზე [https://yandexgo.com/legal/yandexgo_privacy_notice](https://yandexgo.com/legal/yandexgo_privacy_notice). მომხმარებელი აცნობიერებს და თანხმობას აცხადებს, რომ თუ მომხმარებელი გაწევრიანებულია საზიარო ანგარიშში, წინამდებარე დოკუმენტის მე‑4 პუნქტში განმარტებულის შესაბამისად, და იმგზავრებს თავისი პოტენციური საჭიროების შესახებ ინფორმაციის მობილური მოწყობილობებისთვის განკუთვნილი Yandex Taxi‑ს აპლიკაციით განთავსების შემდეგ, ამგვარი მგზავრობის შესახებ ინფორმაცია ხელმისაწვდომი გახდება იმ პირისთვის, რომელმაც აღნიშნული ერთობლივი ანგარიში შექმნა. 2\.11. როცა მომხმარებელი უკვეთს საკურიერო მიტანის მომსახურებას, მომხმარებელს უფლება არ აქვს, მოითხოვოს შემდეგი პროდუქტების მიტანა: - პისტოლეტები, სამოქალაქო და სამსახურებრივი იარაღი, საბრძოლო მასალა, იარაღის სათადარიგო ნაწილები და აქსესუარები, მშვილდები და არბალეტები სასროლო სპორტისთვის, იარაღი სინათლის, კვამლისა და ხმოვანი სიგნალებისთვის, ელექტროიარაღი, ელექტროშოკერები და სასწავლო ტყვიამფრქვევები, ბასრი ცივი იარაღი, ტრალები, კასტეტები, სიურიკენები, ბუმერანგები და სხვა ხელნაკეთი ნივთები, რომელთაც აქვს დარტყმის, დაჩეხის, სროლის ფუნქცია, წვეტიანი ან მჭრელი საგნები, გამონაკლისია სპორტული აღჭურვილობა, ორმაგი დანიშნულების მქონე სპეციალური ტექნიკური აღჭურვილობა და მათი აქსესუარები; - ნარკოტიკული ნივთიერებები, ფსიქოაქტიური ნივთიერებები, პრეკურსორები და მათი ეკვივალენტები; - ბირთვული, რადიოაქტიური, ძლიერმოქმედი, კოროზიული, ფეთქებადი ან აალებადი ნივთიერებები, ასაფეთქებლები, პიროტექნიკური საშუალებები და მათი შემცველი პროდუქტები, ასევე სხვა სახიფათო ნივთიერებები; - საწამლავები, შხამიანი ცხოველები, მომწამვლელი ნივთიერებები, შხამიანი მცენარეები და შხამიანი მცენარეების თესლები; - ქართული ეროვნული ვალუტა და უცხოური ვალუტა; - ბეჭდური პროდუქცია, ვიზუალური მასალები, კინო‑, ფოტო‑, აუდიო‑ და ვიდეომასალები, რომლებიც კონსტიტუციური წყობის ძალადობრივი ცვლილების, საქართველოს მთლიანობის დარღვევის, სახელმწიფოს უსაფრთხოებისთვის ძირგამომთხრელ, ომის, სოციალური, რასობრივი, ეროვნული, რელიგიური, კლასობრივი ან კლანური უპირატესობის, სისასტიკის კულტის, ძალადობის ან პორნოგრაფიის პოპულარიზაციას ან აგიტაციას ეწევა; - მალფუჭებადი პროდუქტები სპეციალური შეფუთვის გარეშე; - ნივთები და ნივთიერებები, რომლებიც მათი თავისებურების ან შეფუთვის გამო, შესაძლოა, სახიფათო იყოს ადამიანებისთვის, ან რომლებმაც, შესაძლოა, დააბინძუროს ან გააფუჭოს (დააზიანოს) სხვა ტვირთი, გარშემომყოფი ადამიანები ან საგნები; - ცხოველები და მცენარეები, ბიომასალები; - პროდუქტები (მათ შორის, საკვები), რომლებიც ტრანსპორტირებისთვის სპეციალურად აღჭურვილ სატრანსპორტო საშუალებებს საჭიროებს; - სითხეები ღია კონტეინერებში; - დიდი ზომის ნივთები, რომელთა სიგრძის, სიგანის (რულონის ძირის ორი დიამეტრი ან ღერძი) და სიმაღლის ჯამი აღემატება 150 სმ‑ს (თუ კონკრეტულად სხვა რამ არ არის მითითებული), გრძელი ნივთები, რომელთა სიგრძეც აღემატება 150 სმ‑ს; მისატანი ნივთების წონა არ უნდა აღემატებოდეს 20 კგ‑ს. ქვეითი კურიერის მიერ მიტანის მომსახურების შეკვეთისას მისატანი ნივთების ზომა (სიგანე, სიგრძე, სიმაღლე) არ უნდა აღემატებოდეს 50x50x50‑ს; მისატანი ნივთების წონა არ უნდა აღემატებოდეს 10 კგ‑ს; - მყიფე ნივთები სპეციალური შეფუთვის გარეშე; - ნებისმიერი სხვა ნივთი, რომელთა გავრცელებაც საქართველოში აკრძალულია. წინამდებარე მოთხოვნები სრული მოცულობით ვრცელდება მომხმარებლის მიერ შეკვეთილ ტვირთის ტრანსპორტირების მომსახურებაზე, დიდი ზომის ნივთების ტრანსპორტირებასთან დაკავშირებული შეზღუდვების გარდა. სერვისის პარტნიორები უფლებამოსილი არიან, დააწესონ დამატებითი შეზღუდვები ტვირთის ტრანსპორტირებისა და საკურიერო მიტანის მომსახურებებზე. მომხმარებელი აცნობიერებს და თანხმობას აცხადებს, რომ ზემოაღნიშნული მოთხოვნების არდაცვის შემთხვევაში ის პირადად იღებს პასუხისმგებლობას ყველა უარყოფით შედეგზე, რომლებიც, შესაძლოა, მოჰყვეს სერვისის პარტნიორების მიერ საკურიერო მიტანის ან/და ტვირთის ტრანსპორტირების მომსახურებებს. სერვისის პარტნიორი, ასევე, უფლებამოსილია, უარი განუცხადოს მომხმარებელს მომსახურების გაწევაზე, თუ სერვისის პარტნიორი/მისი წარმომადგენელი აღმოაჩენს მიტანისთვის ან/და ტრანსპორტირებისთვის დაუშვებელ ნივთებს. 2\.12. ტვირთის ტრანსპორტირება მომხმარებლის მოთხოვნით ხორციელდება სერვისის პარტნიორების მიერ, ტვირთის ტრანსპორტირებასთან დაკავშირებული იმ ხელშეკრულების საფუძველზე, რომელიც მხარეთა შორის წერილობითი ფორმითაა გაფორმებული. როგორც წინამდებარე წესებისა და პირობების, ისე ტვირთის ტრანსპორტირებასთან დაკავშირებული ხელშეკრულების შესაბამისად ტვირთის ტრანსპორტირება ხორციელდება მხოლოდ მომხმარებლის (ტვირთის მფლობელის) ან მისი წარმომადგენლის თანდასწრებით. სერვისის პარტნიორის მხრიდან კონკრეტული მომხმარებლის მიერ მითითებული პირისთვის ტვირთის გაგზავნისას, ეს პირი ითვლება ტვირთის მფლობელის წარმომადგენლად და ფლობს ყველა უფლებას და ვალდებულებას, რომელთაც ითვალისწინებს ტვირთის ტრანსპორტირებასთან დაკავშირებული ხელშეკრულება და საქართველოს კანონმდებლობა. 2\.13. თუ ავტომობილით მგზავრობის ღირებულება, რომელიც გამოთვლილია სერვისის ფუნქციონალის გამოყენებით, არ არის 0,1 ლარის ჯერადი, მგზავრობის ღირებულება დამრგვალდება მაღლა უახლოეს 0,1 ლარის ჯერად მნიშვნელობამდე. **3\. მომსახურებებისთვის უნაღდო ანგარიშსწორების ფუნქცია** 3\.1. მომხმარებელს საშუალება აქვს, გადაიხადოს მგზავრებისა და ტვირთის ტრანსპორტირების იმ მომსახურებების ღირებულება, რომლებიც მომხმარებელს გაეწია შესაბამისი მომსახურების პოტენციური საჭიროების შესახებ მომხმარებლის მიერ სერვისის მეშვეობით განთავსებული ინფორმაციის შესაბამისად: 3\.1.1. უშუალოდ ტაქსის სერვისის სასარგებლოდ (მათ შორის, ნაღდი ფულით ან ნებისმიერი სხვა მეთოდით, რომელიც დადგენილია ტაქსის აღნიშნული სერვისის მიერ, ასეთის არსებობის შემთხვევაში, და რომელიც შემდგომში, როგორც წინამდებარე წესებსა და პირობებში, ისე სერვისის ინტერფეისში, მოხსენიებულია, როგორც „ნაღდი ანგარიშსწორება“). აღნიშნული საგადახდო ოპერაცია ხორციელდება Yandex Taxi‑ს მონაწილეობის გარეშე და არ რეგულირდება წინამდებარე პირობებით; 3\.1.2. მომხმარებლისთვის ხელმისაწვდომია უნაღდო ანგარიშსწორების ფუნქცია მიბმული საბანკო ბარათის მეშვეობით (წინამდებარე დოკუმენტის ქვეპუნქტის 3.2. შესაბამისად) ან Apple Pay-ს მეშვეობით; ასეთ შემთხვევაში, Yandex Taxi მოქმედებს ტაქსის შესაბამისი სერვისისგან მიღებული უფლებამოსილებით ან სხვაგვარად, უფლებამოსილი საგადახდო ოპერატორის, ელექტრონული ფულის ოპერატორის ან ანგარიშსწორებასა თუ კომუნიკაციაში ჩართული სხვა მხარის მონაწილეობით, და იღებს საგადახდო ოპერაციებს ტაქსის სერვისის აგენტის სახით ან სხვაგვარად (შემდგომში მოხსენიებული, როგორც „უნაღდო ანგარიშსწორება“). Yandex Taxi არ იძლევა სერვისის უშეცდომო და შეუფერხებელი მუშაობის გარანტიას უნაღდო ანგარიშსწორების უზრუნველყოფის კუთხით. მომხმარებლის რეგიონის მიხედვით, უნაღდო ანგარიშსწორება, შესაძლოა, წარმოებდეს Yandex Taxi ს, როგორც საგადახდო ოპერაციების მიმღების, მონაწილეობის გარეშე, ან Yandex Taxi ს, როგორც ანგარიშსწორებასა თუ კომუნიკაციაში ჩართული სხვა მხარის, მონაწილეობით. გადახდის შესაბამის ფორმას მომხმარებელი ირჩევს სერვისის ინტერფეისში. ამ მხრივ, უნაღდო ანგარიშსწორების რაიმე მიზეზით შეუძლებლობის (მათ შორის — თუმცა ამით არ შემოიფარგლება — ამ ფუნქციის დროებითი ტექნიკური მიუწვდომლობის, მიბმული ბარათის მეშვეობით უნაღდო ანგარიშსწორების დროებითი ან მუდმივი შეუძლებლობის და მიბმულ ბარათზე არასაკმარისი თანხის) შემთხვევაში, მომხმარებელი ვალდებულია, ნაღდი ფულით გადაიხადოს ღირებულება. უნაღდო ანგარიშსწორების შემთხვევაში, მგზავრებისა და ბარგის ტრანსპორტირების მთლიანი ღირებულების გადახდა შესაძლებელია როგორც ერთი ტრანსაქციის სახით, ისე ნაწილ ნაწილ, რამდენიმე ტრანსაქციად, მგზავრობისას და მისი დასრულების შემდეგ. უნაღდო ანგარიშსწორების შემთხვევაში, მომხმარებელს შეუძლია, მგზავრებისა და ბარგის ტრანსპორტირების ღირებულების გადახდის პარალელურად, თავისი შეხედულებისამებრ, დამატებით, უნაღდო ანგარიშსწორებით, გადაუხადოს ტაქსის სერვისს მგზავრებისა და ბარგის ტრანსპორტირების სერვისისთვის გადასახდელი თანხის გარკვეული პროცენტი (შემდგომში, წინამდებარე წესებსა და სერვისის ფარგლებში, მოხსენიებული, როგორც „სამადლობელი თანხა“). 3\.2. მომხმარებელმა სერვისის ინტერფეისში უნდა განსაზღვროს მიბმული საბანკო ბარათი შემდეგი მონაცემების მითითებით: - საბანკო ბარათის ნომერი - მოქმედების ვადა - უსაფრთხოების კოდი თუ საბანკო ბარათის მონაცემები იქნება სწორი და მოქმედი, ხოლო ამ ბარათის სერვისის ფარგლებში გამოყენება — ტექნიკური თვალსაზრისით შესაძლებელი, აღნიშნული საბანკო ბარათი მიებმება და შესაძლებელი გახდება მისი გამოყენება უნაღდო ანგარიშსწორებისთვის (წინამდებარე დოკუმენტის ქვეპუნქტი 3.1.2). ყველა მიბმული ბარათი აისახება სერვისის ინტერფეისში; მომხმარებლის კომფორტისთვის, ინტერფეისში აისახება მიბმული ბარათის ნომრის ბოლო 4 ციფრი. 3\.2.1. მომხმარებელს, ასევე, შეუძლია, მიუთითოს მესამე მხარეთა იმ სერვისების ინტერფეისებში მიბმული ბარათი, რომელთა მიერაც მხარდაჭერილია როგორც სერვისთან და ანგარიშსწორებაში ჩართულ მხარეებთან ინტეგრაცია, ისე მომხმარებლის საგადახდო ოპერაციის ავტორიზება, რა დროსაც მიბმული ბარათის შესახებ ინფორმაცია არ გადაეცემა Yandex Taxi‑ს. ამ შემთხვევაში, წინამდებარე დოკუმენტის ქვეპუნქტების 3.2 და 3.3 დებულებები არ მოქმედებს. მესამე მხარის იმ სერვისების გამოყენება, რომლებიც აღნიშნულია წინამდებარე დოკუმენტში, რეგულირდება მესამე მხარეების წესებით. Yandex Taxi არ აგებს პასუხს მომხმარებლის მიერ მესამე მხარის ასეთი სერვისების გამოყენებაზე და არ იძლევა მესამე მხარის ამგვარი სერვისების უსაფრთხო და გამართული მუშაობის გარანტიას. 3\.3. მომხმარებლის მიერ მიბმული ბარათის დამატებისა და კონკრეტული მგზავრობის ღირებულების გადასახდელად უნაღდო ანგარიშსწორების ფუნქციის არჩევის შემთხვევაში, მიბმული ბარათის მონაცემების სისწორისა და ნამდვილობის დასადასტურებლად, ჩამოიჭრება თანხა 1 GEL მდე ოდენობით (ან სხვა თანხა მომხმარებლის რეგიონის ვალუტაში); ტრანსაქციის წარმატებით შესრულების შემთხვევაში, აღნიშნული თანხა მომხმარებელს დაუბრუნდება. თუ აღნიშნული თანხის ჩამოჭრა ვერ მოხერხდა, ჩაითვლება, რომ ამ კონკრეტული მიბმული ბარათის დამატება ან/და, შესაბამისად, უნაღდო ანგარიშსწორების ფუნქცია მიუწვდომელია. 3\.4. მიბმული ბარათის დამატებისას და მისი დამატების შემდეგ ნებისმიერ დროს მომხმარებელს შეუძლია სამადლობელი თანხის ნაგულისხმევი ოდენობის დაყენება ან/და შეცვლა სერვისის ინტერფეისის მეშვეობით; მომხმარებელს საშუალება აქვს, სერვისის ინტერფეისში შეცვალოს სამადლობელი თანხის ოდენობა კონკრეტული მგზავრობისთვის, მისი დასრულების შემდეგ. 3\.5. სამადლობელი თანხა (ნაგულისხმევი ან მომხმარებლის მიერ კონკრეტული მგზავრობისთვის საგანგებოდ მითითებული ოდენობით) ჩამოიჭრება მიბმული ბარათიდან, თუ მომხმარებელი მგზავრობის დასრულებიდან 30 წუთის განმავლობაში მგზავრობას სერვისის ინტერფეისში შეაფასებს მაღალი ქულით (4‑5 ვარსკვლავი) და დააჭერს ღილაკს „მზადაა“, ან მგზავრობას საერთოდ არ შეაფასებს (არ მიუთითებს ვარსკვლავების რაოდენობას) და დააჭერს ღილაკს „მზადაა“. 3\.6. თუ მომხმარებელი მგზავრობის დასრულებიდან 30 წუთის განმავლობაში მგზავრობას სერვისის ინტერფეისში შეაფასებს დაბალი ქულით (1‑3 ვარსკვლავი) და დააჭერს ღილაკს „მზადაა“, ბარათიდან სამადლობელი თანხა არ ჩამოიჭრება. 3\.7. თუ მომხმარებელი მგზავრობის დასრულებიდან 30 წუთის განმავლობაში არ დააჭერს ღილაკს „მზადაა“, სამადლობელი თანხა (ნაგულისხმევი ან მომხმარებლის მიერ კონკრეტული მგზავრობისთვის საგანგებოდ მითითებული ოდენობით) მიბმულ ბარათზე დაიბლოკება 24 საათით, რომელთა განმავლობაშიც მომხმარებელი შეძლებს სამადლობელი თანხის გაზრდას ან შემცირებას შესაბამისი მგზავრობისთვის. აღნიშნული დროის ამოწურვის შემდეგ, სამადლობელი თანხა ჩამოიჭრება მომხმარებლის მიერ მითითებული (ნაგულისხმევად ან კონკრეტული მგზავრობისთვის) ოდენობით. 3\.8. მომხმარებლის მიერ უნაღდო ანგარიშსწორება ხორციელდება უფლებამოსილი საგადახდო ოპერატორის ან ელექტრონული ფულის ოპერატორის მონაწილეობით და რეგულირდება საერთაშორისო საგადახდო სისტემების, ბანკების (მათ შორის, მიბმული ბარათის გამცემი ბანკის) და ანგარიშსწორებაში ჩართული სხვა მხარეების წესებით. 3\.9. მიბმული ბარათის მონაცემების მითითებით, წინამდებარე დოკუმენტის ქვეპუნქტის 3.2 შესაბამისად, და მისი შემდგომი გამოყენებით მომხმარებელი ადასტურებს და გარანტიას იძლევა, რომ მან მიუთითა სარწმუნო და სრული ინფორმაცია მის სახელზე გაცემული მოქმედი საბანკო ბარათის შესახებ; საბანკო ბარათი შეესაბამება საერთაშორისო საგადახდო სისტემების წესებსა და მიბმული ბარათის გამცემი ბანკის მოთხოვნებს, მათ შორის, უნაღდო ანგარიშსწორების პროცედურასთან დაკავშირებით. 3\.10. მომხმარებელი აცნობიერებს და თანხმდება, რომ მომხმარებლის მიერ დადასტურებული მობილური ტელეფონის ნომრით სერვისის ფარგლებში შესრულებული ყველა ქმედება, მათ შორის, მიბმული საბანკო ბარათით ან Apple Pay-ს მეშვეობით უნაღდო ანგარიშსწორება, ითვლება მომხმარებლის მიერ შესრულებულად. 3\.11. თუ მომხმარებელი არ ეთანხმება უნაღდო ანგარიშსწორების ფაქტს ან/და თანხას, ან სხვა შეკითხვა აქვს მიბმული საბანკო ბარათის ან Apple Pay-ს სერვისის ფარგლებში გამოყენებასთან დაკავშირებით, მას შეუძლია, მიმართოს Yandex Taxi ს სერვისის მიერ მითითებულ ტელეფონის ნომრებზე ან/და მხარდაჭერის სამსახურის (უკუკავშირის) ინტერფეისის მეშვეობით უნაღდო ანგარიშსწორებიდან ან სხვა ისეთი ქმედებებიდან თუ მოვლენებიდან 14 დღის განმავლობაში, რომლებიც მომართვის მიზეზი გახდა. თუ ამგვარი მომართვის შემოწმების შედეგად Yandex Taxi გადაწყვეტს უნაღდო ანგარიშსწორებით გადახდილი თანხის სრულად ან ნაწილობრივ დაბრუნებას, აღნიშნული თანხა დაბრუნდება იმ საბანკო ბარათთან დაკავშირებულ საბანკო ანგარიშზე, რომლითაც განხორციელდა უნაღდო ანგარიშსწორება. თანხის დაბრუნება ხორციელდება უფლებამოსილი საგადახდო ოპერატორის ან ელექტრონული ფულის ოპერატორის მონაწილეობით და რეგულირდება საერთაშორისო საგადახდო სისტემების, ბანკების (მათ შორის, მიბმული ბარათის გამცემი ბანკის) და ანგარიშსწორებაში ჩართული სხვა მხარეების წესებით. თუ Yandex Taxi არ არის ჩართული მიბმული ბარათით ან Apple Pay-ს მეშვეობით განხორციელებულ ანგარიშსწორებაში, Yandex Taxi ს შეუძლია, შეასრულოს იმ ორგანოს ფუნქცია, რომელიც მომხმარებლის ზემოაღნიშნულ მომართვებს გადასცემს ტაქსის სერვისებს, სადისპეტჩეროებს ან ნებისმიერ სხვა პირებს, რომლებიც მიბმული ბარათით განხორციელებული ზემოთ აღნიშნული ტრანსაქციის მიმღებნი არიან. 3\.12. Yandex Taxi იტოვებს უფლებას, ნებისმიერ დროს მოითხოვოს მომხმარებლისგან მის მიერ სერვისში მითითებული მონაცემების, მათ შორის, მიბმული საბანკო ბარათის მონაცემების, დადასტურება და დამადასტურებელი დოკუმენტები (კერძოდ, პირადობის დამადასტურებელი დოკუმენტები), რომელთა წარუდგენლობაც, Yandex Taxi‑ს შეხედულებისამებრ, შესაძლოა, ჩაითვალოს ცრუ ინფორმაციის მოწოდებად, რასაც მოჰყვება წინამდებარე დოკუმენტის ქვეპუნქტით 2.5 გათვალისწინებული შედეგები. 3\.13. მგზავრებისა და ბარგის ტრანსპორტირების მომსახურებათა ღირებულების გადახდის პირობებსა და პროცედურასთან დაკავშირებული დებულებები, რომლებიც მითითებულია წინამდებარე პუნქტში, არ იმოქმედებს, თუ აღნიშნულ მომსახურებათა ღირებულებას მომხმარებლის ნაცვლად იხდის მესამე მხარე, ამგვარ მესამე მხარესთან Yandex Taxi‑ს მიერ გაფორმებული ხელშეკრულების საფუძველზე. **4\. საზიარო ანგარიშის ფუნქცია** 4\.1. მობილური მოწყობილობებისთვის განკუთვნილ Yandex Taxi‑ში მომხმარებელს, შესაძლოა, ჰქონდეს საზიარო ანგარიშის შექმნის ვარიანტი, ანუ შესაძლებლობა, ერთი შექმნილი ანგარიშით რამდენიმე მომხმარებელმა ისარგებლოს, ასევე, საზიარო ანგარიშის წევრებმა განახორციელონ უნაღდო ანგარიშსწორება მგზავრებისა და ბარგის ტრანსპორტირების/სხვა მომსახურებისთვის საზიარო ანგარიშთან მიბმული იმ საბანკო ბარათის მეშვეობით, რომელმაც ეკუთვნის საზიარო ანგარიშის შემქმნელ მომხმარებელს. 4\.2. საზიარო ანგარიშის შესაქმნელად მომხმარებელმა უნდა მიუთითოს შემდეგი ინფორმაცია: - მომხმარებლის ტელეფონის ნომერი - ელფოსტის მისამართი - საზიარო ანგარიშის წევრი მესამე მხარეების ტელეფონის ნომრები - მიბმული საბანკო ბარათის მონაცემები, როგორც ეს მითითებულია წინამდებარე დოკუმენტის ქვეპუნქტში 3.2 მომხმარებელს საშუალება აქვს, საჭიროებისამებრ, მიუთითოს სხვა მონაცემები. 4\.3. „საზიარო ანგარიშის“ ფუნქციის ფარგლებში მომხმარებელს შეუძლია, შექმნას შემდეგი ტიპის საზიარო ანგარიშები: 4\.3.1. საოჯახო ანგარიში. 4\.3.2. ბიზნესანგარიში. 4\.4. საოჯახო ანგარიშის წევრების რაოდენობა არ უნდა აღემატებოდეს 4 (ოთხ) მომხმარებელს. 4\.5. ბიზნესანგარიშები, მონაწილეთა რაოდენობის კუთხით, არ უნდა აღემატებოდეს 20 (ოც) მომხმარებელს. მომხმარებლებმა, შესაძლოა, მიიღონ დამატებითი ფუნქციები და სერვისები ცალკე საფასურის სანაცვლოდ. 4\.6. საზიარო ანგარიშის ფუნქციის გამოსაყენებლად ანგარიშის წევრებმა, რომელთა მობილური ტელეფონის ნომრებიც მიუთითა მომხმარებელმა წინამდებარე დოკუმენტის მე‑4 პუნქტის შესაბამისად, თავიანთ მობილურ მოწყობილობებზე უნდა დააყენონ Yandex Taxi‑ს აპი. 4\.7. როცა წევრი აქვეყნებს ინფორმაციას მგზავრებისა და ბარგის ტრანსპორტირების/სხვა მომსახურების პოტენციური საჭიროების შესახებ, წევრმა სერვისის ინტერფეისში უნდა მიუთითოს, რომ სერვისი გამოიყენება საზიარო ანგარიშის ფუნქციის მეშვეობით. 4\.8. მომხმარებელმა საზიარო ანგარიშის მომხმარებლებს უნდა გააცნოს საზიარო ანგარიშის ფუნქციის გამოყენების პირობები, ასევე, მოიპოვოს მათი თანხმობა საზიარო ანგარიშის ფუნქციით სარგებლობისთვის აუცილებელი ტექნიკური და სხვა სახის შეტყობინებების მიღების შესახებ. **5\.
