Terms of Use of Yandex Delivery

 

1. General Provisions

1.1. These Terms (hereinafter referred to as the Terms) constitute an offer of Foodtech & Delivery B.V. (hereinafter referred to as Yandex) to an Internet user (hereinafter referred to as the User) to use Yandex Delivery service (hereinafter referred to as the Service).

1.2. By starting to use the Service / its certain functions, the User is deemed to have accepted these Terms and provisions of Regulatory Documents, in full, without any reservations and exceptions. If the User disagrees with any provisions of the Terms and/or Regulatory Documents, the User may not use the Service.

1.3. Yandex may, at any time amend provisions of the Terms without notice to the User. The current version hereof is available at: https://yandex.com/legal/yandexgo_termsofuse_delivery.

1.4. The User shall stop using the Service, if he or she disagrees with any amendments to the Terms. If User continues using the Service, it is considered as provision of his or her express consent to the new terms and conditions.

1.5. The Service enables the User to place information, free of charge, on the User’s potential demand for delivery services or other services, look through offers of organizations providing services in the said fields, and search for such offers using parameters set by the User. All currently available functions of the Service along with any developments and/or newly added functions are subject to these Terms.

1.6. Depending on the User’s region, any or all functions of the Service can be inaccessible or limited. Functions are deemed to be inaccessible (limited) for the User from a certain region, if such User is unable to use them explicitly. It is prohibited to apply any technical and software-based methods to circumvent these limitations. Provisions hereof governing functions of the Service inaccessible (limited) for the User will apply until such functions become explicitly accessible for the User. Information on the accessibility of functions of the Service in a certain region shall be provided to the User upon his or her request sent to Yandex.

1.7. For the avoidance of doubt, Yandex does not provide delivery services. Nothing in these Terms shall be interpreted in a way that Yandex is performing delivery services, or that the User has engaged Yandex for such delivery services, or that the third-party partner who is actually providing such services is an agent or subcontractor of Yandex. Delivery services is done exclusively by the third-party providers, who provide those services as an individual, standalone service providers, in their own name and for their own account, and shall be obliged to have all necessary licenses and permits and to comply with all other requirements. The Service is aimed at the User to place its request and engage the third-party partner directly, and Yandex does not bear any responsibility or liability for the third-party partners or the services they provide, neither to the User not to any other person.

1.8. All conversations the User holds with the support team and partners of the Service can be recorded to control quality and improve services.

1.9. By using the Service, the User consents to receive promotional messages. The User may unsubscribe from promotional messages by using relevant functions of the Service or following instructions specified in a promotional message received.

1.10. Yandex reserves the right to limit User access to the Service temporarily or permanently without explanation, including a case of violation of these Terms by the User, receipt of an order from an authorized body, causing damage to Yandex or to third parties (as well as to prevent such actions), creating danger to others, protecting the rights and legitimate interests of Yandex and third parties, receiving repeated complaints about the actions of the User or persons, in respect of which the User places through the Service information about the potential demand for delivery services or other services, or take any other measures against the User to respect legislative requirements or third-party rights and legitimate interests.

 

2. Use of the Service. Certain Functions of the Service

2.1. The Service is provided to the User for personal non-commercial use.

2.2. Information on delivery services is provided by partners of the Service. For more information about the services offered the User may contact the partners of the Service or provide their contact details through the functions of the Service for the partners of the Service to independently contact the User and provide their with information about the services offered.

2.3. Yandex shall not be held liable for the content and/or relevance of information provided by the partners of the Service, including information on the cost and current availability of the partners’ benefits. The User shall independently (without the participation of Yandex) discuss the acquisition of services with the partners in accordance with the partners’ rules on the provision of services. Yandex shall not be held liable for financial and any other transactions effected by the User and the partners and for any consequences of the acquisition of the partners’ services by the User.

2.4. The User may access functions of rating the services of the Service partners and commenting / leaving feedback on the Service or services of the Service partners. Users ratings and feedback are posted on the Service website and can be available on third-party websites. Yandex reserves the right to refuse to post any ratings / feedback and delete / block, at any time, any rating / feedback the User posted, at own discretion and without giving any reason.

2.5. When demand for services is higher (including days before holidays, days of mass events and other cases), tariffs of the Service partners can be raised. Yandex informs of higher tariffs by posting the relevant notice on the Service website or otherwise as Yandex thinks fit, inter alia, by sending an information message to the User’s mobile phone number.

2.6. If the Service supports ordering delivery services in advance (hereinafter, "pre-ordered delivery"), the order will be available for the Service partner to confirm near the time specified by the User in the order (no earlier than 30 minutes before the pre-ordered delivery is scheduled to start). The cost of the pre-ordered services will be calculated and indicated in the Service when the delivery services are ordered. The price may change in circumstances listed on the Service website.

2.7. The Service partner charges fees for a trip cancelled by the User, if such cancellation took place after the courier’s arrival to the place the User had appointed. The amount of such fees is calculated the same way as the cost of service as per tariff for a period of time from when the courier actually arrived to the pick-up place or from the time of arrival specified in information the provider submitted to the User regarding the Users’ parcel ordered (whichever comes later) until the User cancelled the service. The User shall cancel a service by sending a relevant notice to the provider via the Service.

The User is considered to have cancelled a service if he or she has not delivered the shipment for delivery to the pick-up place within 10 (ten) minutes from the moment of the courier's actual arrival, taking into account waiting time specified for the corresponding tariff (if applicable).

2.8. The User authorizes Yandex to process personal information (including personal details) of the User of Yandex, to transfer personal information of the User to Yandex’s partners, and to process personal information for Yandex’s partners to provide services to the User in the Service. When the User turns to the Service, their personal information is transmitted to be processed under the terms and for the purposes determined in the Privacy Policy of available at: (https://yandex.com/legal/confidential).

2.9. The time of arrival of the courier at the place of departure indicated by the User in the Request is approximate and can be changed depending on the traffic situation and other external factors. Yandex notifies about the change in the arrival time of the courier by sending an information message to the User's mobile phone number or otherwise at the discretion of Yandex.

2.10. The User is responsible for the contents of the items transferred for delivery to partners and couriers, and undertakes not to hand over for the delivery the following items:

  • hand-held combat, non-military and service weapons, ammunition, spare parts and components, sports bows and crossbows, weapons designed for light, smoke and sound signals, electric weapons, electroshock devices and spark dischargers, cold bladed weapons, bludgeons, knuckle-dusters, shurikens, twigs, boomerangs and other adjusted items for striking, smashing, throwing, piercing, and cutting except for sporting equipment, special technical dual-use devices and components, fireworks, flares and ammunition;
  • narcotic drugs, psychotropic substances, precursors and their analogs;
  • nuclear materials, radioactive, superpotent, caustic, explosive and flammable substances, firing agents, pyrotechnic substances and related items, and other hazardous substances;
  • poisons, poisonous animals, poisonous substances, poisonous plants and seeds of poisonous plants;
  • the national currency and foreign currency;
  • printed publications, graphic materials, film, photo, audio and video materials containing propaganda for or promotion of violent changes of the constitutional order, destruction of national security, war, social, racial, national, religious, class and clan superiority, cruelty, violence, and pornography;
  • perishable foodwithout special package;
  • items and substances that, by their nature or due to packaging, can be a danger to the public, can contaminate or damage (destruct) other loads, surrounding people, or items;
  • animals and plants, biological materials;
  • items requiring specially equipped vehicles to be transported, including foodstuff;
  • liquids in open containers;
  • space eating items, which total length, width (two diameters or axes at the roll base) and height dimensions (subject to special exemptions) exceed 150 cm; long items over 150 cm; the weight of transferred items may not exceed 20 kg. In case of ordering a delivery service by foot courier, the size of the transferred items (width, length, height) cannot exceed 50x50x50; the weight of the transferred items cannot exceed 10 kg;
  • fragile items without special packaging;
  • any other items, which distribution is prohibited or limited in the territory of country of delivery service provision.

The Yandex’s partners may set other limits on items to be delivered.

The User is aware of and confirms that, if he or she fails to meet the above requirements to items to be delivered, the User is solely responsible for all the negative effects that may occur while the Yandex’s partner provide delivery services. At the same time, a Yandex’s partner may deny delivery services to the User, if the Yandex’s partner/ representatives of the Yandex’s partner discover any non-deliverable items.

2.11. The Partner or his Representative accepts shipments for delivery according to the number of packages, provided that the package of the shipment is satisfactory, without checking the internal contents by the Partner or his Representative.

2.12. The User agrees that the shipment is considered delivered to the recipient, provided that the package of the shipment is intact (there are no traces of opening the package, damage to the package and other characteristic traces of physical impact).

 

3. Function of cashless payment for delivery and other services

3.1. The User can pay for delivery or other services provided to the User in compliance with the information on potential demand for the relevant service the User posted via the Service:

3.1.1. Directly to a service provider (inter alia, by cash or by any other means stipulated by the said provider, if any, hereinafter referred to in these Terms and the Service interface as Cash). The said payment shall be made without Yandex being involved and shall not be governed by these Terms.

3.1.2. The User can access the function of cashless payment by a Linked Bank Card (cl. 3.5 hereof); in this case, Yandex acts in the name of the relevant service provider or otherwise (including directly) with an authorized payment processor, electronic money processor, or any other party to settlements involved and receives payments as an agent of the provider or otherwise (including directly) (hereinafter referred to as cashless payments).

Yandex does not guarantee that the operation of the Service will be error- and failure-free in view of enabling cashless payments.

Depending on the User's region, cashless payments can be made without Yandex acting as a payment recipient or with Yandex involved as another party to settlements or a party to information exchange.

3.2. The User shall choose the relevant form of payment in the Service interface. If the User selects a wire payment, the payment to the partner's address in Cash or otherwise directly to the partner's representative, without additional notification of Yandex by changing the payment method in the Service interface (if possible), shall be prohibited. The debit of Yandex funds from the Linked Card shall be deemed correct and corresponding to the payment method selected by the User, and no refund shall be made by canceling the debit.

At the same time, if it is impossible to pay by wire for any reason (including, but not limited to, temporary technical unavailability of this function, temporary or permanent impossibility of wire payment using a Linked Card, insufficient funds on the Linked Card), the User undertakes to ensure there is sufficient funds on the Linked Card to repay the arrears on Partner's services as soon as possible, but in any case no later than 30 calendar days from the moment of rendering the relevant service to the User.

3.3. For cashless payments, it is possible to effect both one transaction for the entire cost of delivery or other service and several transactions for certain parts of the cost of the service. Cashless payments can be effected by any of the above means during the service or when the service is over.

3.4. The User shall specify the Linked Bank Card in the Service interface indicating the following details:

  • Bank card number
  • Valid through
  • Verification code

If the bank card details are true, valid and it is technically feasible to use this card in the Service, the said bank card becomes the Linked one and can be used for cashless payments (cl. 3.1.2 hereof). All Linked Cards are displayed in the Service interface; for the User’s convenience, the interface displays the last 4 digits of the Linked Card number.

The User may also indicate the Linked Card in the interface of third-party services supporting integration with the Service and payment participants and providing authorization of the User's payment without transmitting information about the Linked Card to Yandex.

The procedure for using the third-party services specified in this Clause shall be governed by the rules stipulated by such third parties. Yandex shall not be liable for the User's use of such third-party services and shall not guarantee the correctness and safety of such third-party services.

3.5. When a Linked Card is added and when the User chooses the function of cashless payment for a certain service, the amount limited to amount equivalent to 1 US dollar (or any other amount in the User’s region currency) will be charged to confirm that the Linked Card details are true and valid; if the transaction is successfully effected, the said amount will be refunded to the User. Failure to charge the said amount means that it is impossible to add this Linked Card and/or the function of cashless payment is unavailable, respectively.

3.6. In case of cashless payments, the User can, along with payment for delivery or other service, make an additional cashless payment to the service provider as a percentage of the cost of the paid delivery or other service (hereinafter referred to in these Terms and the Service interface as Tips) as they think fit.

3.7. When adding the Linked Card and at any time after it was added, the User can set and/or change the default amount of Tips via the Service interface; the User can change the amount of Tips for a certain trip/service in the Service interface, when the trip/service is over.

3.8. Tips (in the default amount or in the amount specifically indicated by the User for a certain trip/service) will be charged from the Linked Card, if the User, within 30 minutes after the trip/service is over, assigns a high rating to the trip (4–5 stars) in the Service interface and clicks "Done" or assigns neither high nor low rating to the trip/service (specifies no number of stars) and clicks "Done".

3.9. If within 30 minutes after the trip/service is over the User assigns a low rating to the trip/service (1–3 stars) in the Service interface and clicks "Done", no Tips will be charged from the Linked Card.

3.10. If within 30 minutes after the trip/service is over the User did not click "Done", the amount of Tips (in the default amount or in the amount specifically indicated by the User for a certain trip/service) will be blocked in the Linked Card for 24 hours, during which the User can increase or reduce the amount of Tips for this trip/service. When the said time expires, the Tips will be charged in the amount specified by the User (by default or specifically for this trip/service).

3.11. Yandex does not have access to the bank card data specified by the User and is not responsible for the safety and confidentiality of the transmitted data during non-cash payment. User's cashless payments shall be made with an authorized payment processor or electronic money processor involved and shall be governed by rules of international payment systems, banks (including the bank that issued the Linked card), and other parties to settlements.

3.12. When indicating their details pursuant to cl. 3.5 hereof and further using the Linked Card, the User confirms and guarantees that they indicated reliable and full information on the valid bank card issued in their name; they comply with rules of international payment systems and requirements of the bank that issued the Linked Card, inter alia, in relation to the procedure of cashless payments.

3.13. The User understands and agrees that all actions performed in the Service using the mobile phone number confirmed by the User, inter alia, cashless payments with the use of the Linked Bank Card, are deemed to be performed by the User.

3.14. If the User disagrees with the fact and/or the amount of cashless payments and has any other questions on how to use the Linked Card in the Service, they may contact Yandex by phone numbers specified by the Service and/or via the help desk (feedback) interface within 14 days from the date of cashless payments or any other actions or events that prompted the request.

If, following the inspection caused by such a request, Yandex decides to refund the amount of cashless payment, in whole or in part, the said amount shall be refunded to the bank account of the bank card the cashless payment was made with. The refund shall be made with an authorized payment processor or electronic money processor involved and governed by rules of international payment systems, banks (including the bank that issued the Linked Card), and other parties to settlements. If Yandex is not a party to settlements made via the Linked Card, Yandex can act as a body that transfers above user requests to providers, dispatch offices, or any other person being a recipient of payments under the above transactions with the Linked Card.

3.15. Yandex reserves the right to require at any time that the User confirm the details they specified in the Service, including the details of the Linked Card, and request supporting documents in this regard (in particular, identity documents); failure to provide these documents may qualify as the provision of unreliable information and have implications stipulated hereof, if Yandex thinks fit.

3.16. The provisions on the terms and procedure of payment for delivery services, specified in this Section shall not apply, when a third party pays for such services instead of the User under a separate contract Yandex signed with such third party.

3.17. By accepting these Terms, the User gives his express consent that Yandex may, on behalf of and for the account of the Partner, deliver to the User a fiscal bill for delivery services by SMS which will contain the link to the fiscal bill, and which SMS will be delivered to a phone number previously provided to Yandex by the User during registration.

Uslovi korišćenja servisa Yandex Delivery

 

1. Opšte odredbe

1.1. Ovi Uslovi (u daljem tekstu „Uslovi“) jeste ponuda društva Foodtech & Delivery B.V. (u daljem tekstu „Yandex“) korisniku Internetske mreže (u daljem tekstu „Korisnik“) da koristi servis Yandex Delivery (u daljem tekstu „Usluga“).

1.2. Počevši da koristi Servis ili njegove pojedinačne funkcije, smatra se da je Korisnik u potpunosti prihvatio ove Uslove bez ikakvih primedbi ili izuzetaka. Ako se Korisnik ne slaže sa bilo kojom od odredbi Uslove i/ili Pravila, Korisnik ne može da koristi Servis.

1.3. Yandex može promeniti odredbe ovih Uslova u bilo kom trenutku bez obaveštenja Korisnika. Važeća verzija ovih Uslova je objavljena na: https://yandex.com/legal/yandexgo_termsofuse_delivery.

1.4. Korisnik mora prestati da koristi Servis ako ne prihvati izmene Uslova. Nastavak korišćenja Servisa nakon izmene Uslova smatra se izričitim pristankom Korisnika na njihovu novu verziju.

1.5. Servis nudi Korisniku besplatnu mogućnost postavljanja informacija o potencijalnoj potražnji Korisnika za uslugama dostave ili drugim uslugama, kao i mogućnost da se upozna sa informacijama o ponudama organizacija koje pružaju usluge u ovoj sferi i da traži takve ponude prema parametrima koje odredi Korisnik. Sve trenutno postojeće funkcije Servisa, kao i svaki razvoj istih ili dodavanje novih funkcija, podležu ovim Uslovima.

1.6. U zavisnosti od regije gde se nalazi Korisnik, sve ili neke funkcije Servisa mogu biti nedostupne ili ograničene. Funkcije se smatraju nedostupnim (ograničenim) za Korisnika iz određene regije ako takav Korisnik ne može da ih izričito koristi. Zabranjena je upotreba bilo kakvih tehničkih i softverskih metoda za zaobilaženje ovih ograničenja. Odredbe ovih Uslova koje regulišu nedostupne (ograničene) za Korisnika funkcije Servisa, neće se primenjivati sve dok takve funkcije ne postanu izričito dostupne Korisniku. Informacije o dostupnosti funkcija Servisa u određenoj regiji dostavljaju se Korisniku na njegov zahtev upućen Yandex-u.

1.7. Da ne bi bilo sumnje, Yandex ne pruža usluge dostave. Ništa u ovim Uslovima neće se tumačiti tako da Yandex pruža usluge dostave, ili da je Korisnik angažovao Yandex za takve usluge dostave, ili da je strani partner koji stvarno pruža takve usluge agent ili podizvođač servisa Yandex. Usluge dostave pružaju isključivo strani izvođači koji ove usluge pružaju kao posebni, samostalni pružaoci usluga, u svoje ime i o svom trošku, pa su u obvezi da poseduju sve potrebne licence i dozvole i da poštuju sve ostale zahteve. Servis je namenjen da Korisnik postavi svoj zahtev i direktno angažuje stranog partnera, a Yandex neće snositi odgovornost za strane partnere ili usluge koje isti pružaju, pred Korisnikom niti pred bilo kojom drugom osobom.

1.8. Korisnik pristaje da se svi razgovori Korisnika sa stručnjacima službe podrške, kao i sa partnerima, mogu snimati u svrhu kontrole kvaliteta i razvoja usluga.

1.9. Korišćenjem Servisa, Korisnik pristaje da prima reklamne poruke. Korisnik ima pravo da odbije primanje reklamnih poruka koristeći odgovarajuću funkcionalnost Servisa ili prateći uputstva navedena u primljenoj reklamnoj poruci.

1.10. Yandex ima pravo da Korisniku privremeno ili trajno ograniči pružanje Servisa bez objašnjenja razliga, uključujući i u slučaju da Korisnik prekrši ove Uslove, da se zaprimi nalog od ovlašćenog organa, da se nanese šteta Yandex-u ili trećim licima (kao i da se takve radnje spreče), da se pojavi opasnost za okolna lica, da se štite prava i legitimne interese Yandex-a i trećih lica, da se zaprime više žalbi na radnje Korisnika ili lica u odnosu na koje Korisnik putem Servisa postavlja informacije o potencijalnoj potražnji za uslugama dostave i/ili drugim uslugama, ili da preduzima bilo koje druge mere u odnosu na Korisnika da bi se ispoštovali zakonski zahtevi ili prava i legitimni interesi trećih lica.

 

2. Korišćenje Servisa Posebne funkcije Servisa

2.1. Usluga se pruža Korisniku za ličnu nekomercijalnu upotrebu.

2.2. Informacije o uslugama dostave i/ili drugim uslugama pružaju partneri Servisa. Za više informacija o ponuđenim uslugama, Korisnik može kontaktirati partnere Servisa ili dati svoje kontaktne podatke preko funkcija Servisa, tako da partneri Servisa mogu samostalno kontaktirati Korisnika i pružiti mu informacije o ponuđenim uslugama.

2.3. Yandex ne odgovara za sadržaj ili relevantnost informacija koje daju partneri Servisa, uključujući informacije o ceni usluga partnera, kao i njihovoj trenutnoj dostupnosti. Interakcija Korisnika sa partnerom u vezi sa kupovinom usluga vrši se samostalno (bez učešća Yandex-a) u skladu sa pravilima za pružanje usluga koje važe kod partnera. Yandex ne odgovara za finansijske ili bilo koje druge transakcije koje vrše Korisnik i partner, kao ni za bilo kakve posledice kupovine partnerskih usluga od strane Korisnika.

2.4. Korisnik može imati pristup funkcijama ocenjivanja usluga Partnera, kao i objavljivanja komentara ili recenzija o Servisu ili uslugama partnera. Ocene i recenzije Korisnika se objavljuju na web stranici Servisa, kao i mogu biti dostupne i na web stranicama trećih strana. Yandex zadržava pravo da odbije da objavi bilo kakve ocene ili recenzije, kao i da ukloni ili blokira ocene/recenzije koje je objavio Korisnik u bilo kom trenutku po sopstvenom nahođenju i bez navođenja razloga.

2.5. U periodima povećane potražnje za uslugama (uključujući predprazničke dane, dane masovnih događaja i u drugim slučajevima), tarife za partnerske usluge mogu biti povećane. Yandex obaveštava o povećanju tarifa postavljanjem odgovarajućeg obaveštenja na web stranicu Servisa ili slanjem informativne poruke na broj mobilnog telefona Korisnika ili na bilo koji drugi način po nahođenju Yandex-a.

2.6. Ako Servis podržava prethodnu narudžbu usluge dostave (u daljem tekstu „prethodno naručena dostava“), narudžbina će biti dostupna za potvrdu od strane partnera Servisa bliže vremenu koje je Korisnik naveo u narudžbini (ne ranije od 30 minuta pre početka prethodno naručene dostave). Cena prethodno naručenih usluga biće obračunata i naznačena u Servisu prilikom naručivanja usluga dostave. Cena se može promeniti u zavisnosti od okolnosti navedenih na web stranici usluge.

2.7. Partner može naplatiti naknadu za korisnikovo otkazivanje usluge, ako je do takvog otkazivanja došlo nakon dolaska kurira na mesto koje je naveo Korisnik. Iznos takve naknade obračunava se na sličan način kao i cena usluge po odgovarajućoj tarifi za period od trenutka stvarnog dolaska kurira na mesto prijema pošiljke ili od trenutka dolaska kurira na mesto prijema pošiljke (u zavisnosti od toga šta se kasnije dogodilo) sve do trenutka otkaza usluge od strane Korisnika. Korisnik može otkazati uslugu slanjem odgovarajućeg obaveštenja partneru putem Servisa.

Smatra se da je Korisnik otkazao uslugu ako nije dostavio/la pošiljku za dostavu na mesto prijema u roku od 10 (deset) minuta od trenutka stvarnog dolaska kurira, uzimajući u obzir vreme čekanja naznačeno za odgovarajuću tarifu (ako je primenjivo).

2.8. Korisnik ovlašćuje Yandex da obrađuje lične informacije (uključujući lične podatke) Korisnika i prenosi takve lične informacije partnerima, kao i da obrađuje takve lične informacije u svrhu pružanja Korisniku funkcionalnosti Servisa. Kada Korisnik koristi Servis, njegovi lični podaci se prenose na obradu u skladu sa uslovima i u svrhe navedene u Politici privatnosti koja je dostupna na: (https://yandex.com/legal/confidential).

2.9. Vreme dolaska predstavnika partnera na mesto prijema pošiljke koje je Korisnik naveo u Zahtevu jeste okvirno i može se menjati u zavisnosti od saobraćajne situacije i drugih spoljnih faktora. Yandex obaveštava o promeni vremena dolaska predstavnika partnera slanjem informativne poruke na broj mobilnog telefona Korisnika ili na drugi način po nahođenju Yandex‑a.

2.10. Korisnik odgovara za sadržaj pošiljki predatih na dostavu partnerima i njihovim predstavnicima i obavezuje se da neće predati na dostavu stvari kako sledi:

  • ručno borbeno, nevojno i službeno oružje, municiju, rezervne delove i komponente, sportske lukove i samostrele, oružje namenjeno za davanje svetlosnih, dimnih i zvučnih signala, električno oružje, elektrošokere i šokere na varnice, hladno oružje, palice, boksere za šaku, šurikene, armaturu, bumerange i druge prilagođene predmete za udaranje, drobljenje, bacanje, ubadanje i sečenje, osim sportske opreme, specijalnih tehničkih sredstava i komponenti dvostruke namene, vatromete, signalne rakete i metkove;
  • narkotične supstance, psihotropne supstance, prekursore i njihove analoge;
  • moćne, toksične, radioaktivne, eksplozivne, otrovne, razjedajuće,
  • zapaljive i druge opasne materije, uključujući i one pod pritiskom;
  • otrove, otrovne životinje, otrovne materije, otrovne biljke i seme otrovnih biljaka;
  • domaću i stranu devizu;
  • štampane publikacije, grafičke materijale, filmske, foto, audio i video materijale koji sadrže propagandu nasilnih promena ustavnog poretka, uništavanja nacionalne bezbednosti, rata, društvene, rasne, nacionalne, verske, klasne i rodovske superiornosti, okrutnosti, nasilja i pornografije;
  • brzo kvarljivu hranu bez posebnog pakovanja;
  • stvari i materije koje po svojoj prirodi ili zbog pakovanja mogu predstavljati opasnost po ljude, zagaditi ili pokvariti (oštetiti) druge pošiljke, okolna lica ili predmete;
  • životinje i biljke, biološke materijale;
  • predmete koje za transport zahtevaju posebno opremljena vozila, uključujući namirnice;
  • tečnosti u otvorenim sudovima;
  • predmete velikih dimenzija, čiji zbir (osim posebno predviđenih slučajeva) po dužini, širini (dva prečnika ili ose u osnovi rolne) i visine prelazi 150 cm, duge predmete čija je dužina preko 150 cm; težina predatih predmeta ne može biti veća od 20 kg. U slučaju naručivanja usluge kurirske dostave pešice, veličina predatih predmeta (širina, dužina, visina) ne može biti veća od 50x50x50; težina predatih predmeta ne može biti veća od 10 kg;
  • krhke predmete bez posebnog pakovanja;
  • sve druge predmete čiji je promet zabranjen ili ograničen na teritoriji zemlje gde se pružaju usluge.

Partneri mogu postaviti dodatna ograničenja za pošiljke predate na dostavu.

Korisnik je upoznat i potvrđuje da je u slučaju nepoštovanja navedenih uslova isključivo odgovoran kao i za sve negativne posledice koje mogu nastati u procesu pružanja usluga od partnera. Istovremeno, partner ili njegov predstavnik ima pravo da Korisniku otkaže pružanje usluge u slučaju otkrivanja u pošiljki predmeta koji ne podležu dostavi.

2.11. Partner ili njegov predstavnik primaju pošiljke za dostavu po broju mesta, pod uslovom zadovoljavajućeg pakovanja pošiljke, bez proveravanja internog sadržaja od strane Partnera ili njegovog predstavnika.

2.12. Korisnik pristaje da se pošiljka smatra dostavljenom primaocu pod uslovom da je pakovanje pošiljke netaknuto (nema znakova otvaranja pakovanja, oštećenja na pakovanju i drugih karakterističnih znakova fizičkog delovanja).

 

3. Funkcija bezgotovinskog plaćanja

3.1. Plaćanje usluga dostave ili drugih usluga partnera pruženih Korisniku u skladu sa informacijama koje je on postavio koristeći Servis o potencijalnoj potražnji za relevantnim uslugama može se izvršiti na način kako sledi:

3.1.1. Direktno pružaocu usluge gotovinom ili na drugi način ako je takva funkcionalnost dostupna u Servisu (u daljem tekstu u ovim Uslovima i interfejsu Servisa označena kao „Gotovina“). Ova vrsta plaćanja se vrši bez učešća Yandex-a i nije regulisana ovim Uslovima.

3.1.2. Bezgotovinskim plaćanjem sa Povezane bankovne kartice (t. 3.5. ovih Uslova); u ovom slučaju, Yandex deluje u ime relevantnog partnera uz učešće ovlašćenog operatera za prijem plaćanja ili operatera elektronskog novca, ili drugih učesnika u obračunima, informacione i tehnološke interakciji, i primalac je uplate kao agent Partnera (u daljem tekstu „bezgotovinsko plaćanje“). Yandex ne garantuje odsustvo grešaka i propusta u radu Servisa u vezi sa pružanjem mogućnosti bezgotovinskog plaćanja, a takođe ima pravo da angažuje treća lica (podagente) za ispunjavanje svojih obaveza.

U zavisnosti od regije korisnika, bezgotovinska plaćanja se mogu vršiti bez učešća Yandex-a kao primaoca uplate ili uz učešće Yandex-a kao druge strane u obračunima ili učesnika u razmeni informacija.

3.2. Izbor odgovarajućeg oblika plaćanja Korisnik vrši u interfejsu Servisa.

Ako Korisnik izabere bezgotovinsko plaćanje, plaćanje partneru u Gotovini ili na drugi način direktno u korist predstavnika partnera, bez dodatnog obaveštenja Yandex-u promenom načina plaćanja u interfejsu Servisa (ako postoji odgovarajuća mogućnost), nije dozvoljeno. Zaduživanje sredstava sa Povezane kartice od strane Yandex priznaje se ispravnim i odgovarajućim načinu plaćanja koji je odabrao Korisnik, vraćanje novca putem poništavanja zaduženja ne vrši se.

Istovremeno, ako iz bilo kog razloga nije moguće izvršiti bezgotovinsko plaćanje (uključujući, ali ne ograničavajući se na, privremenu tehničku nedostupnost ove funkcije, privremenu ili trajnu nemogućnost bezgotovinskog plaćanja pomoću Povezane kartice, nedovoljnost sredstava na Povezanoj kartici), Korisnik se obavezuje da će obezbediti dovoljan iznos novca na Povezanoj kartici za podmirivanje duga vezano za plaćanje usluga partnera u najkraćem mogućem roku, ali u svakom slučaju najkasnije u roku od 30 kalendarskih dana od trenutka pružanja relevantne usluge Korisniku.

3.3. Uz bezgotovinsko plaćanje, prema nahođenju Yandex-a, moguće je izvršiti kako jednu transakciju za punu cenu usluge, tako i nekoliko transakcija za odvojene delove cene usluge. U ovom slučaju, bezgotovinsko plaćanje se može izvršiti na bilo koji od navedenih načina tokom pružanja usluge, ili po njenom završetku.

3.4. Povezanu bankovnu karticu Korisnik može naznačiti u interfejsu Servisa, pri čemu Korisnik navodi podatke kako sledi:

  • Broj bankovne kartice
  • Važi do
  • Zaštitni kod (CVV)

Ukoliko su podaci bankovne kartice tačni, važeći i korišćenje ove kartice u okviru Servisa je tehnički moguće, navedena bankovna kartica dobija status Povezane i može se koristiti za bezgotovinsko plaćanje (t. 3.1.2. ovih Uslova) . Sve Povezane kartice su prikazane u interfejsu Servisa; radi pogodnosti Korisnika, u odnosu na Povezanu karticu, prikazuju se poslednje 4 cifre broja Povezane kartice.

Povezanu karticu Korisnik takođe može naznačiti u interfejsu usluga trećih strana koje podržavaju integraciju sa Servisom i učesnicima obračunavanja i obezbeđuju autorizaciju plaćanja Korisnika bez prenosa informacija o Povezanoj kartici Yandex-u.

Način korišćenja usluga trećih lica navedenih u ovoj tački reguliše se pravilima tih trećih lica. Yandex ne odgovara za korišćenje takvih usluga trećih strana od strane Korisnika i ne garantuje ispravnost i sigurnost rada takvih usluga trećih strana.

3.5. Prilikom dodavanja Povezane kartice, kao u slučaju da Korisnik izabere funkciju bezgotovinskog plaćanja za određenu uslugu, zadužuje se iznos u okviru iznosa koji je jednak 1 USD što je neophodno za potvrdu tačnosti i validnosti podataka Povezane kartice; u slučaju uspešnog završetka transakcije, navedeni iznos se vraća Korisniku. Neuspešan pokušaj zaduživanja navedenog iznosa znači da se ova Povezana kartica ne može dodati i/ili funkcija bezgotovinskog plaćanja nije dostupna.

3.6. U slučaju bezgotovinskog plaćanja, uz plaćanje usluga, Korisnik ima mogućnost, po sopstvenom nahođenju, izvršiti dodatnu bezgotovinsku isplatu u korist Partnera u procentu od cene plaćene usluge (u daljem tekstu ovih Uslova i u interfejsu Usluge: „Napojnica“).

3.7. Prilikom dodavanja Povezane kartice, kao i u bilo kom trenutku nakon njenog dodavanja, Korisnik ima mogućnost preko interfejsa Servisa da podrazumevano podesi ili promeni veličinu Napojnice; iznos Napojnice za određenu uslugu Korisnik može promeniti u interfejsu Servisa nakon završetka pružanja iste.

3.8. Napojnica (u podrazumevanom iznosu ili u iznosu koji je posebno odredio Korisnik za određenu uslugu) biće zadužena sa Povezane kartice ako je Korisnik označio pozitivnu ocenu (4‑5 zvezdica) u interfejsu Servisa u roku od 30 minuta nakon što je usluga pružena i kliknuo na dugme „Gotovo“, ili nije naznačio pozitivnu niti negativnu ocenu usluge (nije naveo broj zvezdica) i kliknuo na dugme „Gotovo”.

3.9. Ukoliko je Korisnik u roku od 30 minuta nakon što je usluga pružena, u interfejsu Servisa naveo negativnu ocenu (1-3 zvezdice) i kliknuo na dugme „Gotovo“, Napojnica se neće zadužiti sa Povezane kartice.

3.10. Ako Korisnik ne klikne na dugme „Gotovo“ u roku od 30 minuta nakon što je usluga pružena, iznos Napojnice (u podrazumevanom iznosu ili u iznosu koji je posebno odredio Korisnik za određenu uslugu) biće blokiran na Povezanoj kartici na period od 24 sata tokom kojeg Korisnik može da promeni veličinu Napojnice za ovu uslugu u pravcu povećanja ili smanjenja. Nakon isteka navedenog perioda, Napojnica se zadužuje u iznosu koji je odredio Korisnik (podrazumevani ili za ovu konkretnu uslugu).

3.11. Yandex nema pristup podacima o bankovnoj kartici koje je naveo Korisnik i ne odgovara za sigurnost i poverljivost podataka koje se prenose prilikom bezgotovinskog plaćanja. Bezgotovinsko plaćanje vrši Korisnik uz učešće ovlašćenog operatera za prijem uplata, ili operatera elektronskog novca, ili drugih učesnika u obračunima, informacione i tehnološke interakciji, a reguliše se pravilima međunarodnih platnih sistema, banaka (uključujući banku koja je izdala Povezanu karticu) i drugih učesnika u obračunima.

3.12. Prilikom navođenja svojih podataka u skladu sa t. 3.5. ovih Uslova i daljeg korišćenja Povezane kartice, Korisnik potvrđuje i garantuje da je naveo tačne i potpune informacije o važećoj bankovnoj kartici izdatoj na njegovo ime; da poštuje pravila međunarodnih platnih sistema i zahteve banke koja je izdala Povezanu karticu, uključujući i u pogledu postupka za obavljanje bezgotovinskog plaćanja.

3.13. Korisnik razume i pristaje da se sve radnje izvršene u okviru Servisa korišćenjem broja mobilnog telefona koji je potvrdio, uključujući i za bezgotovinsko plaćanje pomoću Povezane bankovne kartice, smatraju izvršenim od strane Korisnika.

3.14. Ukoliko se Korisnik ne slaže sa činjenicom i/ili iznosom bezgotovinskog plaćanja i drugim pitanjima u vezi sa korišćenjem Povezane kartice u okviru Servisa, Korisnik ima pravo da kontaktira Yandex na telefone koje je naznačio Servis i/ ili preko interfejsa službe podrške (povratne informacije) u roku od 14 dana od dana obavljanja bezgotovinskog plaćanja ili drugih radnji ili događaja koji su izazvali žalbu.

Ukoliko, na osnovu rezultata provere po takvoj žalbi, Yandex odluči da vrati iznos bezgotovinskog plaćanja u celini ili delimično, navedeni povraćaj se vrši na bankovni račun bankovne kartice sa koje je izvršeno bezgotovinsko plaćanje. Postupak vraćanja novca se vrši uz učešće ovlašćenog operatera za prijem uplata, ili operatera elektronskog novca, ili drugih učesnika u obračunima, informacione i tehnološke interakciji, a reguliše se pravilima međunarodnih platnih sistema, banaka (uključujući banku koja je izdala Povezanu karticu) i drugih učesnika u obračunima.

3.15. Yandex zadržava pravo da u bilo kom trenutku zahteva od Korisnika da potvrdi podatke koje je naveo u okviru Servisa, uključujući podatke Povezane kartice, i da u vezi s tim zahteva potvrđujuće isprave (naročito isprave koje potvrđuju identitet), čije nedostavljanje, prema nahođenju Yandex-a, može se izjednačiti sa davanjem netačnih informacija i izazvati posledice predviđene ovim Uslovima.

3.16. Odredbe o uslovima i načinu plaćanja usluga dostave navedene u ovom odeljku ne primenjuju se kada treće lice plaća te usluge umesto Korisnika na osnovu posebnog ugovora koji je Yandex potpisao sa takvim trećim licem.

3.17. Prihvatanjem ovih Uslova, Korisnik daje svoju izričitu saglasnost da Yandex može u ime i za račun Partnera da dostavlja Korisniku fiskalni račun za izvršene usluge dostavljanja putem SMS-a u kome će biti naveden link na kome će se nalaziti fiskalni račun, a koji SMS će biti dostavljen na broj telefona koji je Korisnik prethodno dostavio Yandex-u prilikom registracije.
