1. Общие положения

1.1. Настоящие Условия (далее — «Условия») представляют собой предложение от компании RideTechnology Global FZ-LLC (РайдТехнолоджи ФЗ-ЛЛС) (далее — «Яндекс.Такси») пользователю сети Интернет (далее — «Пользователь») использовать сервис Яндекс.Такси (Яндекс Go) (далее — «Сервис»).

1.2. Использование Пользователем Сервиса регулируется настоящими Условиями, а также Политикой конфиденциальности (https://yandexgo.com/legal/yandexgo_privacy_notice)

(далее — «Регулирующие документы»).

1.3. Начиная использовать Сервис / его отдельные функции, Пользователь считается принявшим настоящие Условия, а также условия Регулирующих документов, в полном объеме, без каких-либо оговорок и исключений. В случае несогласия Пользователя с какими-либо из положений Условий и (или) Регулирующих документов, Пользователь не вправе использовать Сервис.

1.4. Яндекс.Такси вправе в любое время без уведомления Пользователя изменить положения настоящих Условий. Действующая редакция настоящих Условий доступна по адресу: https://yandexgo.com/legal/yandexgo_termsofuse. Риск неознакомления с новой редакцией Условий и Регулирующих документов несет Пользователь, продолжение пользования Сервисом после изменения Условий или Регулирующих документов считается согласием с их новой редакцией.

1.5. В случае, если компания «Яндекс» внесла изменения в настоящие Условия в том порядке, который предусмотрен п. 1.4. настоящих Условий, с которыми Пользователь не согласен, Пользователь обязан прекратить использование Сервиса.

1.6. Сервис предлагает Пользователю бесплатную возможность размещать информацию о потенциальном спросе Пользователя на услуги по перевозке пассажиров и багажа, а также возможность осуществлять ознакомление с информацией о предложениях организаций, оказывающих услуги в указанной сфере, и заниматься поиском таких предложений по заданным Пользователем параметрам. Все существующие на данный момент функции Сервиса, а также любое их развитие и (или) добавление новых функций является предметом настоящих Условий.

1.7. В зависимости от региона Пользователя все или некоторые функции Сервиса могут быть недоступны или ограничены. Функции считаются недоступными (ограниченными) для Пользователя из определенного региона, если такой Пользователь не может ими воспользоваться в явном виде. Применение любых технических и программных методов обхода данных ограничений запрещено. Положения настоящих Условий, регулирующие недоступные (ограниченные) для Пользователя функции Сервиса, не применяются до тех пор, пока Пользователю такие функции не станут доступны в явном виде. Информация о доступности функций Сервиса в определенном регионе предоставляется Пользователю по его запросу, направленному в Яндекс.Такси.

1.8. Во избежание сомнений, Яндекс.Такси не оказывает услуги по перевозке пассажиров и багажа и услуги информационно-диспетчерской службы.

1.9. Все переговоры, которые Пользователь ведет со службой поддержки и водителями партнеров Сервиса, могут быть записаны с целью контроля качества и улучшения услуг.

1.10. Используя Сервис, Пользователь дает свое согласие на получение сообщений рекламного характера. Пользователь вправе отказаться от получения сообщений рекламного характера путем использования соответствующего функционала Сервиса или следуя инструкциям, указанным в полученном сообщении рекламного характера.

2. Использование Сервиса. Отдельные функции Сервиса

2.1. Сервис предоставляется Пользователю для личного некоммерческого использования.

2.2. Информация об услугах по перевозке пассажиров и багажа (далее — «Информация»), предоставлена партнерами Сервиса. Перечень партнеров доступен по адресу http://taxi.yandex.com/partners. Для получения более подробной информации о предлагаемых услугах (включая информацию о наличии точки доступа Wi-Fi в машине такси, проведении фото-/видеозаписи в машине такси партнерами Правообладателя или другой информации) Пользователь может обратиться либо к партнерам Сервиса или предоставить свою контактную информацию, воспользовавшись функциональными возможностями Сервиса, которая может быть использована партнерами Сервиса для самостоятельной связи с Пользователем и предоставления ему информации о предлагаемых услугах.

2.3. Яндекс.Такси не несет ответственности за содержание и (или) актуальность информации, предоставляемой партнерами Сервиса, включая информацию о стоимости услуг партнеров, а также об их наличии в данный момент. Взаимодействие Пользователя с партнерами по вопросам приобретения услуг осуществляется Пользователем самостоятельно (без участия Яндекс.Такси) в соответствии с принятыми у партнеров правилами оказания услуг. Яндекс.Такси не несет ответственности за финансовые и любые другие операции, совершаемые Пользователем и партнерами, а также за любые последствия приобретения Пользователем услуг партнеров.

2.4. Пользователю могут быть доступны функции оценки услуг партнеров Сервиса, а также размещение комментариев/отзывов о Сервисе и (или) услугах партнеров Сервиса. Оценки и отзывы пользователей размещаются на сайте Сервиса, а также могут быть доступны на сайтах третьих лиц. Яндекс.Такси оставляет за собой право отказать в размещении любых оценок/отзывов, а также в любой момент удалить/заблокировать размещенные Пользователем оценку/отзыв по своему усмотрению и без указания причин.

2.5. Яндекс.Такси оставляет за собой право на свое усмотрение ограничить доступ Пользователя к Сервису (или к определенным функциям Сервиса, если это возможно технологически) с использованием его учетной записи или полностью заблокировать учетную запись Пользователя при неоднократном нарушении настоящих Условий, либо применить к Пользователю иные меры с целью соблюдения требований законодательства или прав и законных интересов третьих лиц.

2.6. Информация об актуальных максимальных тарифах размещена на сайте Сервиса и/или в мобильном приложении Яндекс Go. В периоды повышенного спроса на услуги такси (в том числе в предпраздничные дни, в дни проведения массовых мероприятий и в иных случаях) максимальные тарифы Сервиса могут быть увеличены. Об увеличении максимальных тарифов Яндекс.Такси сообщает путем размещения соответствующего уведомления на сайте Сервиса http://taxi.yandex.com или иными способами по усмотрению Яндекс.Такси, включая, помимо прочего, отправку Пользователю информационного сообщения на номер мобильного телефона.

2.7. Услуги по перевозке пассажиров и багажа по тарифам «Эконом», «Комфорт», «Бизнес» и других представленных на Сервисе тарифов осуществляется разными классами автомобилей. Отнесение автомобиля к тому или иному классу осуществляется автоматически на основании данных о характеристиках автомобиля, предоставленных партнерами Сервиса.

2.8. В случае отказа Пользователя от транспортных услуг, произошедшего после прибытия автомобиля в место подачи, указанное Пользователем, служба такси взимает комиссию за аннулирование заказа. Сумма такой комиссии рассчитывается аналогично стоимости транспортных услуг за период с момента фактического прибытия автомобиля к месту подачи или с момента, указанного в информационном сообщении, отправленном Пользователю службой такси, от момента прибытия автомобиля в место подачи (в зависимости от того, что произошло позже) до момента отказа Пользователя от транспортных услуг. Пользователь производит отказ от транспортных услуг посредством отправки в службу такси информационного сообщения через Сервис. Если иное не предусмотрено правилами соответствующей службы такси или соглашением между Пользователем и представителем службы такси (водителем), считается, что Пользователь отказался от транспортных услуг, если Пользователь не сел в автомобиль, прибывший к месту подачи, указанному Пользователем, в течение 10 (десяти) минут, включая время ожидания, предусмотренное соответствующим тарифом на оказание транспортных услуг. Комиссия за отказ от транспортных услуг из аэропорта рассчитывается с учетом надбавки за прибытие автомобиля к месту подачи за пределами города согласно соответствующему тарифу на транспортные услуги.

2.8.1. В зависимости от местоположения Пользователя и наличия в его местоположении доступных транспортных средств Пользователю может быть предложено заказать Услугу перевозки с использованием транспортного средства из более отдаленного места за дополнительную плату ("Платная подача"). Стоимость такой Платной подачи рассчитывается, исходя из (1) расстояния между соответствующим транспортным средством и местоположением Пользователя и (2) времени, необходимого для такого транспортного средства, чтобы преодолеть это расстояние. Пользователь может принять или отклонить предложение о Платной Подаче по своему усмотрению, нажав соответствующую кнопку в мобильном приложении Яндекс Go. В случае принятия предложения о Платной подаче стоимость Предложения о Платной подаче будет добавлена к стоимости Услуги перевозки. После того как заказ, включающий Платную подачу, принят Пользователю предоставляется срок для бесплатной отмены заказа (Срок бесплатной отмены). Длительность Срока бесплатной отмены рассчитывается для каждого конкретного заказа и доводится до сведения Пользователя в мобильном приложении Яндекс Go. Если пользователь решит отменить заказ по истечении Срока бесплатной отмены (поздняя отмена), с Пользователя будет списана полная стоимость Платной подачи (применимо только к Услугам перевозки, которые оплачиваются банковской картой).

2.9. Используя Сервис, Пользователь дает согласие Яндекс.Такси на обработку персональной информации (в том числе персональных данных) Пользователя, передачу персональной информации Пользователя партнерам Яндекс.Такси и обработку персональной информации Пользователя партнерами Яндекс.Такси для целей предоставления Пользователю услуг в рамках Сервиса. При использовании Сервиса персональная информация Пользователя передается для обработки на условиях и для целей, определенных в Политике конфиденциальности, доступной для ознакомления по адресу: https://yandexgo.com/legal/yandexgo_privacy_notice.

2.10. Пользователю может быть доступна опция «Попутчик», в рамках которой Служба такси имеет право во время выполнения поездки принимать Запрос от другого Пользователя и осуществлять перевозку двух Пользователей в рамках их Запросов одновременно в одном транспортном средстве (выполнять два Запроса одновременно).

При размещении Пользователем Запроса с применением опции «Попутчик», Пользователь подтверждает свое согласие с условиями и ограничениями в рамках указанной опции, в том числе:

во время осуществления поездки Служба такси имеет право принять к исполнению Запрос другого Пользователя, в связи с чем возможно а) изменение маршрута поездки с целью выполнения второго Запроса, б) увеличение предварительно рассчитанного времени в пути;
при размещении Пользователем Запроса с применением опции «Попутчик» поездку в рамках такого Запроса может совершить только один пассажир. Это означает, что при выполнении двух Запросов одновременно в рамках опции «Попутчик», в транспортном средстве могут находиться не более двух пассажиров;
маршрут поездки при выполнении Запросов определяется в соответствии с алгоритмами Сервиса или на усмотрение Службы такси;
в рамках опции могут быть недоступны иные дополнительные опции Сервиса.

Партнеры сервиса могут устанавливать дополнительные ограничения, в том числе к габаритам багажа пассажиров. Партнеры сервиса имею право отказать Пользователю в поездке в случае несоблюдения Пользователем установленных требований.

3. Функция безналичной оплаты Сервиса по перевозке пассажиров и багажа

3.1. Оплата услуги по перевозке пассажиров и багажа, оказанная Пользователю в соответствии с размещенной им с использованием Сервиса информацией о потенциальном спросе на соответствующую услугу, может быть произведена Пользователем:

3.1.1. непосредственно службе такси (в том числе наличными или иными способами, предоставляемыми указанной службой такси при наличии таковых, далее по тексту настоящих Условий и в интерфейсе Сервиса — «Наличные»). Указанный вид оплаты осуществляется без участия Яндекс.Такси и не регулируется настоящими Условиями.

3.1.2. Пользователю может быть доступна функция безналичной оплаты с Привязанной банковской карты (п. 3.2 настоящих Условий); в этом случае Яндекс.Такси действует по поручению соответствующей службы такси, либо по иному основанию, с привлечением уполномоченного оператора по приему платежей или оператора электронных денежных средств или иной стороны, занимающейся расчетными операциями или информационным взаимодействием, и является получателем платежа в качестве агента службы такси, либо в ином качестве (далее — «безналичная оплата»). Яндекс.Такси не гарантирует отсутствия ошибок и сбоев в работе Сервиса в отношении предоставления возможности безналичной оплаты.

В зависимости от региона Пользователя безналичная оплата может осуществляться без участия Яндекс.Такси в качестве получателя платежа, либо с привлечением Яндекс.Такси в качестве иного участника расчетов или участника информационного взаимодействия.

Выбор соответствующей формы оплаты производится Пользователем в интерфейсе Сервиса. При этом при невозможности по любым причинам произвести безналичную оплату (включая, но не ограничиваясь, временную техническую недоступность данной функции, временную или постоянную невозможность безналичной оплаты с использованием Привязанной карты, недостаточность средств на Привязанной карте) Пользователь обязуется произвести оплату Наличными.

При безналичной оплате возможно проведение как одной транзакции на полную стоимость услуги по перевозке пассажиров и багажа, так и нескольких транзакций на части стоимости как во время поездки, так и по завершении поездки.

При безналичной оплате наряду с оплатой услуги по перевозке пассажиров и багажа Пользователь имеет возможность по своему усмотрению совершить также дополнительный безналичный платеж в пользу службы такси в процентном отношении от стоимости оплачиваемой услуги по перевозке пассажиров и багажа (далее по тексту настоящих Условий и в интерфейсе Сервиса — «Чаевые»).

3.2. Привязанная банковская карта указывается Пользователем в интерфейсе Сервиса, при этом Пользователь указывает следующие данные:

номер банковской карты;
срок действия;
защитный код.

Если данные банковской карты верны, действительны и использование данной карты в рамках Сервиса технически возможно, указанная банковская карта приобретает статус Привязанной и может быть использована для безналичной оплаты (п. 3.1.2 настоящих Условий). Все Привязанные карты отображаются в интерфейсе Сервиса; для удобства Пользователя в отношении Привязанной карты отображаются 4 последние цифры номера Привязанной карты.

3.2.1. Пользователь также может указать информацию о Привязанной карте в интерфейсе сторонних сервисов, поддерживающих интеграцию с Сервисом, а также участников расчетов, и авторизующих оплату Пользователем без передачи в Яндекс.Такси информации о Привязанной карте. В этом случае положения п. 3.2 и 3.3 настоящего документа не применяются.

Использование сторонних сервисов, указанных в данном документе, регулируется правилами таких сторонних сервисов. Яндекс.Такси не несет ответственности за использование Пользователем таких сторонних сервисов и не гарантирует корректную и безопасную работу таких сторонних сервисов.

3.3. При добавлении Привязанной карты, а также в случае выбора Пользователем функции безналичной оплаты конкретной поездки осуществляется списание суммы в пределах 5 российских рублей (или иной суммы в валюте региона Пользователя), необходимое для подтверждения точности и действительности данных Привязанной карты; в случае успешного прохождения транзакции указанная сумма возвращается Пользователю. Неуспешная попытка списания указанной суммы означает невозможность добавления данной Привязанной карты и (или) недоступность функции безналичной оплаты соответственно.

3.4. При добавлении Привязанной карты, а также в любое время после ее добавления Пользователь имеет возможность через интерфейс Сервиса установить и (или) изменить размер Чаевых по умолчанию; размер Чаевых для конкретной поездки может быть изменен Пользователем в интерфейсе Сервиса после завершения этой поездки.

3.5. Чаевые (в размере по умолчанию или в размере, специально указанном Пользователем для конкретной поездки) будут списаны с Привязанной карты, если Пользователь в течение 30 минут после завершения поездки указал в интерфейсе Сервиса положительную оценку поездки (4–5 звезд) и нажал на кнопку «Готово» либо не указал ни положительную, ни отрицательную оценку поездки (не указал количество звезд) и нажал на кнопку «Готово».

3.6. В случае, если Пользователь в течение 30 минут после завершения поездки указал в интерфейсе Сервиса отрицательную оценку поездки (1–3 звезды) и нажал на кнопку «Готово», Чаевые не будут списаны с Привязанной карты.

3.7. В случае, если Пользователь в течение 30 минут после завершения поездки не нажал на кнопку «Готово», сумма Чаевых (в размере по умолчанию или в размере, специально указанном пользователем для конкретной поездки) будет заблокирована на Привязанной карте на срок 24 часа, в течение которых Пользователь имеет возможность изменить размер Чаевых для данной поездки в большую или меньшую сторону. По истечении указанного времени происходит списание Чаевых в указанном Пользователем (по умолчанию или для данной конкретной поездки) размере.

3.8. Безналичная оплата осуществляется Пользователем с участием уполномоченного оператора по приему платежей или оператора электронных денежных средств и регулируется правилами международных платежных систем, банков (в том числе банка-эмитента Привязанной карты) и других участников расчетов.

3.9. При указании своих данных согласно п. 3.2 настоящих Условий и дальнейшем использовании Привязанной карты Пользователь подтверждает и гарантирует указание им достоверной и полной информации о действительной банковской карте, выданной на его имя; соблюдение им правил международных платежных систем и требований банка-эмитента, выпустившего Привязанную карту, в том числе в отношении порядка проведения безналичных расчетов.

3.10. Пользователь понимает и соглашается, что все действия, совершенные в рамках Сервиса с использованием подтвержденного им номера мобильного телефона, в том числе по безналичной оплате с использованием Привязанной банковской карты, считаются совершенными Пользователем.

3.11. В случае несогласия Пользователя с фактом и (или) суммой безналичной оплаты и по иным связанным с использованием Привязанной карты в рамках Сервиса вопросам Пользователь вправе обратиться к Яндекс.Такси по указанным Сервисом телефонам и (или) через интерфейс службы поддержки (обратной связи) в течение 14 дней со дня произведения безналичной оплаты или иных действий или событий, послуживших причиной обращения.

Если по результатам проверки по такому обращению Яндекс.Такси принимает решение о возврате суммы безналичной оплаты полностью или частично, указанный возврат осуществляется на банковский счет банковской карты, с которой была произведена безналичная оплата. Порядок возврата денежных средств осуществляется с участием уполномоченного оператора по приему платежей или оператора электронных денежных средств и регулируется правилами международных платежных систем, банков (в том числе банка-эмитента Привязанной карты) и других участников расчетов. В случаях, когда Яндекс.Такси не является участником расчетов по Привязанной карте, Яндекс.Такси может выступать в качестве лица, которое передает обращения Пользователей по указанным выше вопросам службам такси, диспетчерским или иному лицу, которое является получателем платежа по указанным выше операциям с Привязанной картой.

3.12. Яндекс.Такси оставляет за собой право в любой момент потребовать от Пользователя подтверждения данных, указанных им в рамках Сервиса, в том числе данных Привязанной карты, и запросить в связи с этим подтверждающие документы (в частности, документы, удостоверяющие личность), непредоставление которых, по усмотрению Яндекс.Такси, может быть приравнено к предоставлению недостоверной информации и повлечь последствия, предусмотренные п. 2.5 настоящих Условий.

3.13. Указанные в настоящем разделе положения об условиях и порядке оплаты услуги по перевозке пассажиров и багажа не применяются в случае, когда оплата такой услуги производится за Пользователя третьим лицом на условиях отдельного договора, заключенного Яндекс.Такси с таким третьим лицом.

Terms of Use of Yandex.Taxi (Yandex Go)

1. General Provisions

1.1. These Terms (hereinafter referred to as the Terms) constitute an offer of RideTechnology Global FZ-LLC (referred to as Yandex.Taxi) to an Internet user (hereinafter referred to as the User) to use Yandex.Taxi (Yandex.Go) (hereinafter referred to as the Service).

1.2. The User’s work with the Service is governed by these Terms and documents as follows:

(hereinafter jointly referred to as the Regulatory Documents).

1.3. When starting using the Service / its certain functions, the User is deemed to have accepted these Terms and provisions of the Regulatory Documents, in full, without any qualification or exception. If the User disagrees with any provisions of the Terms and/or Regulatory Documents, the User may not use the Service.

1.4. Yandex.Taxi may, at any time without notice to the User, amend provisions of these Terms. The current version of these Terms is available at: https://yandexgo.com/legal/yandexgo_termsofuse. The risk of failing to read a revised version of the Terms and Regulatory Documents shall be borne by the User; the continued use of the Service once the Terms or Regulatory Documents have been amended shall constitute consent to the revised version thereof.

1.5. The User shall stop using the Service, if it disagrees with any amendments to these Terms made by Yandex in the manner prescribed by cl. 1.4 hereof.

1.6. The Service enables the User to place information, free of charge, on the User’s potential demand for services involving the transportation of passengers and baggage, look through offers of organizations providing services in the said field, and search for such offers using parameters set by the User. All currently available functions of the Service along with any developments thereof and/or newly added functions are subject to these Terms.

1.7. Depending on the User’s region, any or all functions of the Service can be inaccessible or limited. The functions are deemed to be inaccessible (limited) for the User from a certain region, if such a User is unable to use them explicitly. It is prohibited to apply any technical and software-based methods to circumvent these limitations. Provisions of these Terms governing functions of the Service inaccessible (limited) for the User shall not be applied until such functions become explicitly accessible for the User. Information on the accessibility of functions of the Service in a certain region shall be provided to the User upon its request sent to Yandex.Taxi.

1.8. For the avoidance of doubt, Yandex.Taxi does not provide services involving the transportation of passengers and baggage and help desk services.

1.9. All conversations the User holds with the support team and drivers of partners of the Service can be recorded to control quality and improve services.

1.10. By using the Service, the User gives its consent to receive advertising messages. The User may refuse to receive advertising messages by using the relevant functionality of the Service or following instructions specified in the received advertising message.

2. Use of the Service. Certain Functions of the Service

2.1. Service is provided to the User for personal non-commercial use.

2.2. Information on services involving the transportation of passengers and baggage (hereinafter referred to as the Information) is provided by partners of the Service. The list of partners is available at http://taxi.yandex.com/partners. To get more details on services offered (including the information on the availability of Wi-Fi hotspot inside the taxi, carrying out of photo/video recording inside the taxi by the Right Holder's partners or other information), the User can either address partners of the Service or provide its contact information through the functionality of the Service, which can be used by partners of the Service to contact the User on their own and provide it with the information on services offered.

2.3. Yandex.Taxi shall not be held liable for the content and/or relevance of information provided by the Service’s partners, including information on the cost of the partners’ services and on their current availability. The User shall independently (without the participation of Yandex.Taxi) discuss the acquisition of services with the partners in accordance with the partners’ rules on the provision of services. Yandex.Taxi shall not be held liable for financial and any other transactions effected by the User and the partners and for any consequences of the acquisition of the partners’ services by the User.

2.4. The User access functions to rate services of the Service’s partners and comment / leave feedback on the Service and/or services of the Service’s partners. Ratings and feedback of users are posted on the Service website and can be found on third-party websites. Yandex.Taxi reserves the right to refuse to post ant ratings / feedback and remove / block, at any time, any rating / feedback posted by the User at own discretion and without giving any reason.

2.5. Yandex.Taxi reserves the right, at own discretion, to limit access of the User to the Service (or to certain functions of the Service, if technologically feasible) using its account or block the User’s entire account upon multiple violations of these Terms, or take any other measures against the User to respect legislative requirements or third-party rights and legitimate interests.

2.6. Information about the current maximum rates is available on the Service website and/or in the Yandex Go mobile application. When the demand for taxi services is higher (including days before holidays, days of mass events and other cases), maximum tariffs of the Service can be increased. Yandex.Taxi informs of maximum tariffs increases by posting the relevant notice on the Service website http://taxi.yandex.com or otherwise, if Yandex.Taxi so decides, inter alia, by sending an information message to the User’s mobile phone number.

2.7. Services involving the transportation of passengers and baggage as per Economy, Comfort, Business tariffs and other tariffs represented on the Service are rendered by different types of vehicles. Vehicles are ranked automatically based on vehicle performance data provided by the Service’s partners.

2.8. The taxi service charges a cancellation fee, in case of User’s refusal of transport services, occurred after the car arrival to the pickup location appointed by the User. The amount of such fee is calculated similar to transport services fee for the period from the moment of actual car arrival to the pickup location or from the moment specified in information notice sent to the User by the taxi service as a moment of the car arrival to the pickup location (depending on what have taken place later) to the moment of User’s refusal of transport services. The User makes the refusal of transport services sending the information notice to the taxi service by the Service. Unless otherwise is foreseen by the rules of the corresponding taxi service or by the agreement between User and taxi service representative (driver), the User is considered to be refused of transport services if the User hasn’t get into a car that arrived to the pickup location appointed by the User within 10 (ten) minutes including the waiting time limits specified in the corresponding transport services rate. The cancellation fee for transport services from the airport is calculated with extra charge for the car arrival to the pickup location outside the city according to the corresponding transport services rate.

2.8.1. Depending on the location of the User and the availability of vehicles at the User's location, the User may be offered to order a Transportation service using a vehicle from a more remote location for an additional fee ("Paid Delivery"). The price of the Paid Delivery will be calculated based on (1) the distance between the respective vehicle and the User's location and (2) the time required for such vehicle to cover this distance. The User may accept or reject the Paid Delivery at his own discretion by clicking the appropriate button in the Yandex Go mobile application. In case of acceptance of the Paid Delivery, the price of the Paid Delivery will be added to the price of the Transportation service. After the order, including the Paid Delivery, is accepted, the User is given free cancellation period (Free Cancellation Period). The term of the Free Cancellation Period is calculated for each order and is brought to the attention of the User in the Yandex Go mobile application. If the User decides to cancel the order upon expiration of the Free Cancellation Period (late cancellation), the User will be charged the full cost of the Paid Delivery (applicable only to Services on transportation, which are paid by bank card).

2.9. By using the Service the User gives its consent to Yandex.Taxi to process personal information (including personal details) of the User, to transfer personal information of the User to Yandex.Taxi’s partners and to process personal information of the User by Yandex.Taxi’s partners to provide services to the User within the Service.

By using the Service the personal information of the User is to be processed under the terms and for the purposes determined in the Privacy Notice available at: https://yandexgo.com/legal/yandexgo_privacy_notice.

2.10. The User may have access to the “Carpooling” option, within which the taxi provider has the right to accept a Request from another User during the trip and transport two Users within their Requests simultaneously in one vehicle (perform two Requests simultaneously).

When the User places a Request using the “Carpooling” option, the User confirms his agreement with the conditions and restrictions within the specified option, including:

during the trip, the taxi provider has the right to accept the Request of another User for execution, in connection with which it is possible a) to change the route of the trip in order to fulfill the second Request, b) to increase the pre-calculated travel time;
when the User places a Request using the “Carpooling” option, only one passenger can make a trip within the framework of such a Request. This means that when making two Requests at the same time as part of the “Carpooling” option, no more than two passengers can be in the vehicle;
the route of the trip when fulfilling Requests is determined in accordance with the algorithms of the Service or at the discretion of the taxi provider;
other additional options of the Service may not be available within the option.

Service partners may impose additional restrictions, including on the dimensions of passengers' luggage. The taxi providers have the right to refuse the User a trip if the User fails to comply with the established requirements.

3. Function of Cashless Payment for Services Involving the Transportation of Passengers and Baggage

3.1. The User can pay for services involving the transportation of passengers and baggage provided to the User in compliance with the information on potential demand for the relevant service posted by the User via the Service:

3.1.1. directly to a taxi service (inter alia, by cash or by any other means stipulated by the said taxi service, if any, hereinafter referred to in these Terms and the Service interface as Cash). The said payment shall be made without Yandex.Taxi being involved and shall not be governed by these Terms;

3.1.2. the User can access the function of cashless payment through a Linked Bank Card (cl. 3.2 hereof); in this case, Yandex.Taxi acts on the authority of the relevant taxi service or otherwise involving an authorized payment processor, an electronic money processor or another party to settlements or a party to communication, and receives payments as an agent of the taxi service or otherwise (hereinafter referred to as cashless payments). Yandex.Taxi does not guarantee that the operation of the Service will be error- and failure-free in view of enabling cashless payments.

Depending on the User’s region, cashless payments can be made without the participation of Yandex.Taxi as a payment recipient or with the participation of Yandex.Taxi as another party to settlements or a party to communication.

The User chooses the relevant form of payment in the Service interface. In this respect, if it is impossible to make cashless payments for any reason (including, but not limited to temporary technical inaccessibility of this function, temporary or constant impossibility to make cashless payments using the Linked Card, insufficient funds in the Linked Card), the User undertakes to pay by Cash.

In case of cashless payments, it is possible to effect both one transaction for the total cost of the service involving the transportation of passengers and baggage and several transactions for parts of the cost, during and after the trip.

In case of cashless payments, the User can, along with payment for services involving the transportation of passengers and baggage, at own discretion, make an additional cashless payment to the taxi service as a percentage of the cost of the paid service involving the transportation of passengers and baggage (hereinafter referred to in these Terms and the Service interface as Tips).

3.2. The User shall specify the Linked Bank Card in the Service interface indicating the following details:

Bank card number
Valid through
Security code

If the bank card details are true, valid and it is technically feasible to use this card within the Service, the said bank card becomes the Linked one and can be used for cashless payments (cl. 3.1.2 hereof). All Linked Cards are displayed in the Service interface; for the User’s convenience, the interface displays the last 4 digits of the Linked Card’s number.

3.2.1. The User can also specify the Linked Card in the interface of third-party services supporting integration with the Service and parties to the settlements and authorizing the User’s payment with no information on the Linked Card transferred to Yandex.Taxi. In this case provisions of cl. 3.2 and 3.3 hereof shall not apply.

The use of third-party services specified herein is governed by rules of such third parties. Yandex.Taxi shall not be held liable for the use of such third-party services by the User and does not guarantee the proper and safe operation of such third-party services.

3.3. When the Linked Card is added and when the User chooses the function of cashless payment for a certain trip, the amount limited to RUB 5 (or any other amount in the User’s region currency) will be charged to confirm that the Linked Card details are true and valid; if the transaction is successfully effected, the said amount will be refunded to the User. Failure to charge the said amount means that it is impossible to add this Linked Card and/or the function of cashless payment is unavailable, respectively.

3.4. When adding the Linked Card and at any time after it was added, the User can set and/or change the default amount of Tips through the Service interface; the User can change the amount of Tips for a certain trip in the Service interface, when the trip is over.

3.5. Tips (in the default amount or in the amount specifically indicated by the User for a certain trip) will be charged from the Linked Card, if the User, within 30 minutes after the trip is over, assigns a high rating to the trip (4-5 stars) in the Service interface and clicks “Done” or assigns neither high nor low rating to the trip (does not specify the number of stars) and clicks “Done”.

3.6. If the User, within 30 minutes after the trip is over, assigns a low rating to the trip (1-3 stars) in the Service interface and clicks “Done”, no Tips will be charged from the Linked Card.

3.7. If the User, within 30 minutes after the trip is over, did not click “Done”, the amount of Tips (in the default amount or in the amount specifically indicated by the User for a certain trip) will be blocked in the Linked Card for 24 hours, during which the User can increase or reduce the amount of Tips for this trip. When the said time expires, the Tips will be charged in the amount specified by the User (by default or for this trip).

3.8. Cashless payments shall be made by the User involving an authorized payment processor or electronic money processor and shall be governed by rules of international payment systems, banks (including the bank that issued the Linked card) and other parties to settlements.

3.9. When indicating its details pursuant to cl. 3.2 hereof and further using the Linked Card, the User confirms and guarantees that it indicated reliable and full information on the valid bank card issued in its name; it complies with rules of international payment systems and requirements of the bank that issued the Linked Card, inter alia, in relation to the procedure of cashless payments.

3.10. The User understands and agrees that all actions performed within the Service using the mobile phone number confirmed by the User, inter alia, cashless payments with the use of the Linked Bank Card, are deemed to be performed by the User.

3.11. If the User disagrees with the fact and/or the amount of cashless payments and has any other questions associated with the use of the Linked Card within the Service, it may contact Yandex.Taxi by phone numbers specified by the Service and/or via the help desk (feedback) interface within 14 days from the date of cashless payments or any other actions or events that prompted the request.

If, following the inspection caused by such a request, Yandex.Taxi decides to refund the cashless payment amount, in whole or in part, the said amount shall be refunded to the bank account of the bank card, with which the cashless payment was made. The refund shall be made involving an authorized payment processor or electronic money processor and governed by rules of international payment systems, banks (including the bank that issued the Linked Card) and other parties to settlements. If Yandex.Taxi is not a party to settlements made by the Linked Card, Yandex.Taxi can act as a body that transfers Users’ above requests to taxi services, dispatch offices or any other person being a recipient of payments under the above transactions with the Linked Card.

3.12. Yandex.Taxi reserves the right to require, at any time, from the User to confirm the details it specified within the Service, including the details of the Linked Card, and request supporting documents in this regard (in particular, identity documents); failure to provide these documents can, at Yandex.Taxi’s discretion, be deemed amounting to the provision of unreliable information and have implications stipulated by cl. 2.5 hereof.

3.13. The provisions on the terms and procedure of payment for services involving the transportation of passengers and baggage specified in this Section shall not apply, when a third party pays for such services instead of the User under a contract signed by Yandex.Taxi with such a third party.

Yandex.Taxi (Yandex Go) xizmatidan foydalanish shartlari

1. Umumiy qoidalar

1.1. Ushbu shartlar (keyingi oʻrinlarda – “Shartlar”) RideTechnology Global FZ-LLC kompaniyasining (keyingi oʻrinlarda – “Yandex.Taxi”) internet tarmogʻi foydalanuvchisiga (keyingi oʻrinlarda– “Foydalanuvchi”) Yandex.Taxi (Yandex.Go) xizmatidan foydalanish taklifini bildiradi.

1.2. Foydalanuvchining Xizmatlardan foydalanishi ushbu Shartlar, shuningdek Maxfiylik siyosati ( https://yandexgo.com/legal/yandexgo_privacy_notice) bilan tartibga solinadi.

(keyingi oʻrinlarda – “Tartibga soluvchi hujjatlar”)

1.3. Xizmatdan / uning alohida funksiyalaridan foydalanishni boshlash bilan Foydalanuvchi ushbu Shartlarni, shuningdek, Meʼyoriy hujjatlar shartlarini toʻlaligicha, hech qanday shartlarsiz va istisnolarsiz qabul qilgan deb hisoblanadi. Foydalanuvchi Shartlarning va (yoki) Meʼyoriy hujjatlarning biror bandiga rozi boʻlmagan taqdirda Foydalanuvchi Xizmatdan foydalanmaslik huquqiga ega.

1.4. Yandex.Taxi istalgan vaqtda Foydalanuvchiga xabar bermay ushbu Shartlarning bandlarini oʻzgartirish huquqiga ega. Ushbu Shartlarning amaldagi tahriri quyidagi manzilda mavjud: https://yandexgo.com/legal/yandexgo_termsofuse. Shartlar va Meʼyoriy hujjatlarning yangi tahriri bilan tanishmaslik masʼuliyati Foydalanuvchi zimmasida, Shartlar va Meʼyoriy hujjatlar oʻzgarganidan keyin Xizmatdan foydalanishda davom etish ularning yangi tahririga rozilikni anglatadi.

1.5. Agar “Yandex” kompaniyasi ushbu Shartlarga Foydalanuvchi rozi boʻlmagan oʻzgarishlarni ushbu Shartlarning 1.4 bandida nazarda tutilgan tartibda kiritgan boʻlsa, Foydalanuvchi Xizmatdan foydalanishni toʻxtatishi shart.

1.6. Xizmat Foydalanuvchiga yoʻlovchi va yuk tashish toʻgʻrisidagi maʼlumotlarni bepul joylash, shuningdek, ushbu yoʻnalishda xizmat koʻrsatuvchi tashkilotlar takliflari toʻgʻrisidagi maʼlumotlar bilan tanishish va Foydalanuvchi belgilagan parametrlarga muvofiq bunday takliflarni izlash imkoniyatini taqdim etadi. Ayni damda Xizmatda mavjud barcha funksiyalar, shuningdek, ularning har qanday rivojlanishi va (yoki) yangi funksiyalarning qoʻshilishi ushbu Shartlarning predmeti hisoblanadi.

1.7. Foydalanuvchining mintaqasiga qarab barcha yoki ayrim funksiyalar mavjud boʻlmasligi yoki cheklangan boʻlishi mumkin. Agar Foydalanuvchi ulardan ochiq foydalana olmasa, muayyan mintaqadagi Foydalanuvchi uchun funksiyalar mavjud emas (cheklangan) deb hisoblanadi. Bu cheklovlarni chetlab oʻtish uchun istalgan texnik yoki dasturiy usullarni qoʻllash taqiqlanadi. Xizmatning Foydalanuvchi uchun mavjud boʻlmagan (cheklangan) funksiyalarini tartibga soluvchi ushbu Shartlar bandlari bunday funksiyalar Foydalanuvchi uchun ochiq boʻlmaguniga qadar amal qilmaydi. Muayyan mintaqada Xizmat funksiyalarning mavjudligi haqidagi maʼlumot Foydalanuvchining Yandex.Taxi xizmatiga yuborgan soʻrovi asosida unga taqdim etiladi.

1.8. Shubhalarga oʻrin qoldirmaslik uchun Yandex.Taxi yoʻlovchilar va yuklarni tashish, shuningdek, axborot-dispetcherlik xizmatlarini koʻrsatmaydi.

1.9. Foydalanuvchining yordam xizmati va Xizmat hamkorlarining haydovchilari bilan olib boradigan barcha suhbatlari sifatni nazorat qilish va xizmatlarni yaxshilash maqsadida yozib borilishi mumkin.

1.10. Xizmatdan foydalanish bilan Foydalanuvchi reklama mazmunidagi xabarlarni olishga oʻz roziligini bildiradi. Foydalanuvchi Xizmatning tegishli funksiyalaridan foydalangan holda yoki reklama mazmunidagi xabarda koʻrsatilgan yoʻriqnomaga rioya qilgan holda reklama mazmunidagi xabarlarni olishni rad etishga haqli.

2. Xizmatdan foydalanish. Xizmatning alohida funksiyalari

2.1. Xizmat Foydalanuvchi uchun shaxsiy notijoriy maqsadda foydalanish uchun taqdim etiladi.

2.2. Yoʻlovchilar va yuk tashishga oid xizmatlar haqidagi maʼlumot (keyingi oʻrinlarda – “Maʼlumot”) Xizmat hamkorlari tomonidan taqdim etilgan. Hamkorlar roʻyxati bilan quyidagi manzilda tanishish mumkin: http://taxi.yandex.com/partners. Taklif etiladigan xizmatlar (jumladan, taksi mashinasida Wi-Fi ulanish nuqtasi borligi, Huquq egasi hamkorlari tomonidan taksi mashinasida foto/video tasvirga olish yoki boshqa axborot) haqida batafsil maʼlumot olish uchun Foydalanuvchi Xizmat hamkorlariga murojaat qilishi yoki Xizmatning funksional imkoniyatlaridan foydalanib, Xizmat hamkorlari tomonidan Foydalanuvchi bilan mustaqil aloqaga chiqishga va taklif etiladigan xizmatlarga oid maʼlumotlarni taqdim etish uchun qoʻllaniladigan aloqa maʼlumotlarini berishi mumkin.

2.3. Yandex.Taxi Xizmat hamkorlari tomonidan taqdim etiladigan maʼlumotlar, jumladan, hamkorlar xizmatlarining narxi, shuningdek, ularning ayni vaqtda mavjudligi haqidagi maʼlumotlarning mazmuni va (yoki) dolzarbligi uchun javobgar emas. Xizmatlarni xarid qilishga oid masalalar boʻyicha Foydalanuvchining hamkorlar bilan oʻzaro muloqoti hamkorlar qabul qilgan xizmat koʻrsatish qoidalariga asosan mustaqil ravishda (Yandex.Taxi ishtirokisiz) amalga oshiriladi. Yandex.Taxi Foydalanuvchi va hamkorlar oʻrtasida amalga oshirilayotgan moliyaviy va har qanday boshqa operatsiyalar, shuningdek, Foydalanuvchining hamkorlar xizmatini sotib olishi bilan bogʻliq har qanday oqibatlar uchun javobgar emas.

2.4. Foydalanuvchi Xizmat hamkorlari xizmatlarini baholash, shuningdek Xizmat va (yoki) Xizmat hamkorlarining xizmatlari haqida izoh/fikr-mulohaza qoldirish funksiyasidan foydalanishi mumkin. Foydalanuvchilarning baholari va fikr-mulohazalari Xizmatning veb-saytida, shuningdek, uchinchi shaxslar veb-saytlarida joylashtiriladi. Yandex.Taxi har qanday baho/fikr-mulohazani joylashtirishni rad etish, shuningdek, istalgan paytda Foydalanuvchi tomonidan joylashtirilgan baho/fikr-mulohazani oʻz ixtiyori bilan va sabablarini bayon qilmasdan oʻchirish/bloklash huquqiga ega.

2.5. Yandex.Taxi Foydalanuvchining hisobidan foydalangan holda Xizmatdan (yoki Xizmatning maʼlum funksiyalaridan, agar bunga texnologik jihatdan imkon boʻlsa) foydalanish imkoniyatini cheklash yoki ushbu Shartlarni bir necha marta buzilgan hollarda Foydalanuvchi hisobini butunlay bloklash, yoki qonunchilik talablari yoxud uchinchi shaxslarning huquqlari va qonuniy manfaatlariga rioya qilish maqsadida Foydalanuvchiga boshqa choralar koʻrish huquqini oʻzida saqlab qoladi.

2.6. Aktual maksimal tariflar haqidagi maʼlumot Xizmat veb-saytida va/yoki Yandex.Go mobil ilovasida joylashtirilgan. Taksi xizmatlariga talab ortgan vaqtlarda (jumladan, bayram oldi kunlari, ommaviy tadbirlar oʻtkazilgan kunlarda va boshqa holatlarda) Xizmatning maksimal tariflari oshishi mumkin. Yandex.Taxi maksimal tariflarning oshishi haqida Xizmatning http://taxi.yandex.com veb-saytida tegishli bildirishnomalar joylashtirish yoki Yandex.Taxi istagan boshqa usullar, jumladan, Foydalanuvchiga mobil telefon raqamiga informatsion xabar yuborish va boshqa usullar orqali bildiradi.

2.7. Yoʻlovchilar va yukning “Ekonom”, “Komfort”, “Biznes” va Xizmatda taqdim etilgan boshqa tariflarda tashilishiga oid xizmatlar turli klassdagi avtomobillarda amalga oshiriladi. Avtomobilni u yoki bu klassga kiritish Xizmat hamkorlari tomonidan taqdim etilgan avtomobil xarakteristikasi haqidagi maʼlumotlarga asoslanib avtomatik tarzda amalga oshiriladi.

2.8. Avtomobil Foydalanuvchi tomonidan belgilangan taqdim etish joyiga yetib kelganidan keyin Foydalanuvchi transport xizmatlaridan voz kechgan taqdirda taksi xizmati buyurtmani bekor qilganlik uchun komissiya undiradi. Bunday komissiya miqdori avtomobil haqiqatda taqdim etiladigan joyga kelganidan yoki taksi xizmati tomonidan Foydalanuvchiga yuborilgan maʼlumot xabarida koʻrsatilgan vaqtdan boshlab, avtomobil taqdim etiladigan joyga kelganidan (keyin yuz bergan voqeaga qarab) Foydalanuvchi transport xizmatlaridan bosh tortguniga boʻlgan vaqtgacha transport xizmatlari narxiga oʻxshash tarzda hisoblanadi. Foydalanuvchi Xizmat orqali taksi xizmatiga axborot xabarini yuborish orqali transport xizmatlaridan voz kechadi. Agar tegishli taksi xizmati qoidalarida yoki Foydalanuvchi bilan taksi xizmati vakili (haydovchi) oʻrtasidagi kelishuvda boshqacha tartib nazarda tutilmagan boʻlsa, agar Foydalanuvchi oʻzi tarafidan belgilangan taqdim etish joyiga kelgan avtomobilga transport xizmatlarini koʻrsatish uchun tegishli tarifda nazarda tutilgan kutish vaqtini qoʻshib, 10 (oʻn) daqiqa ichida oʻtirmagan boʻlsa, Foydalanuvchi transport xizmatlaridan bosh tortgan deb hisoblanadi. Aeroportdagi transport xizmatlaridan voz kechish uchun komissiya transport xizmatlari uchun tegishli tarif boʻyicha avtomobilning shahar tashqarisidagi taqdim etish joyiga yetib kelgani uchun qoʻshimcha toʻlovni hisobga olgan holda hisoblanadi.

2.8.1. Agar Foydalanuvchi turgan joyda boʻsh avtotransport vositalari boʻlmasa, unga qoʻshimcha haq evaziga uzoqroq joydan transport vositasi yordamida tashish xizmatiga buyurtma berish taklif qilinishi mumkin (“Pulli taqdim etish taklifi”). Foydalanuvchi Yandex Go mobil ilovasidagi tegishli tugmani bosish orqali oʻz xohishiga koʻra Pulli taqdim etish taklifini qabul qilishi yoki rad etishi mumkin. Pulli taqdim etish taklifi qabul qilingan taqdirda, Pulli taqdim etish Taklifining narxi tashish xizmati narxiga qoʻshiladi va (1) tegishli transport vositasining haqiqiy joylashuvi va Foydalanuvchi turgan joy oʻrtasidagi masofa va (2) bunday transport vositasining oʻz haqiqiy joylashuvidan siz turgan joyga yetib borishi uchun ketadigan vaqt asosida hisoblab chiqiladi. Pulli taqdim etish taklifi qabul qilinganidan keyin Foydalanuvchi Pulli taqdim etish Taklifini qabul qilganidan keyin besh (5) daqiqa yoki undan koʻproq vaqt oʻtgach buyurtmani bekor qilishga qaror qilsangiz (bemavrid bekor qilish), Foydalanuvchidan Pulli taqdim etish Taklifining toʻliq qiymati yechib olinadi (faqat bank kartasi orqali toʻlanadigan tashish xizmatlariga nisbatan qoʻllaniladi).

2.9. Xizmatdan foydalanish bilan Foydalanuvchi Yandex.Taxi kompaniyasiga Foydalanuvchining shaxsiy axborotini (shu jumladan, shaxsiy maʼlumotlarini) qayta ishlashga, Foydalanuvchining shaxsiy maʼlumotlarini Yandex.Taxi hamkorlariga uzatishga va Xizmat doirasida Foydalanuvchiga xizmatlar taqdim etish maqsadlarida foydalanuvchining shaxsiy maʼlumotlarini Yandex.Taxi hamkorlari tomonidan qayta ishlanishiga rozilik beradi. Xizmatdan foydalanishda Foydalanuvchining shaxsiy maʼlumotlari Maxfiylik siyosatida koʻrsatilgan shartlar va maqsadlarda qayta ishlash uchun uzatiladi, ular bilan quyidagi manzilda tanishish mumkin: https://yandexgo.com/legal/yandexgo_privacy_notice.

2.10. Foydalanuvchi “Hamroh” parametridan foydalanish imkoni boʻlishi mumkin, uning doirasida Taksi xizmati safar davomida boshqa Foydalanuvchining soʻrovini qabul qilish va ikkita Foydalanuvchini ularning oʻz Soʻrovlari doirasida bir vaqtning oʻzida bitta transport vositasida tashish (bir vaqtda ikkita soʻrovni bajarish) huquqiga ega.

Foydalanuvchi “Hamroh” parametridan foydalanib soʻrov yuborganida, foydalanuvchi belgilangan parametr doirasidagi shartlar va cheklovlarga roziligini tasdiqlaydi, jumladan:

Foydalanuvchi “Hamroh” parametridan foydalangan holda So‘rov yuborilganida, bunday So‘rov doirasida faqat bitta yo‘lovchi safar qilishi mumkin. Bu shuni anglatadiki, “Hamroh” parametri doirasida bir vaqtning oʻzida ikkita soʻrovni amalga oshirishda transport vositasida ikki nafardan ortiq yoʻlovchi boʻlishi mumkin emas;
Soʻrovlarni bajarishda safar marshruti Xizmat algoritmlari asosida yoki Taksi xizmatining ixtiyoriga koʻra belgilanadi;
parametr doirasida Xizmatning boshqa qoʻshimcha imkoniyatlari mavjud boʻlmasligi mumkin.

Xizmat hamkorlari qoʻshimcha cheklovlar, shu jumladan, yoʻlovchilar yukining oʻlchamlariga nisbatan cheklovlar belgilashi mumkin. Agar Foydalanuvchi belgilangan talablarga rioya qilmasa, Xizmat hamkorlari Foydalanuvchi safarini amalga oshirishdan bosh tortishga haqli.

3. Yoʻlovchilar va yuk tashish boʻyicha Xizmatning naqd pulsiz toʻlov funksiyasi

3.1. Tegishli xizmatga nisbatan ehtimoliy talab toʻgʻrisidagi axborot Xizmatidan foydalangan holda joylangan soʻrov boʻyicha Foydalanuvchiga koʻrsatilgan yoʼlovchi va yuk tashish xizmatlari uchun toʻlov Foydalanuvchi tomonidan amalga oshirilishi mumkin:

3.1.1. bevosita taksi xizmatiga (shu jumladan naqd pulda yoki agar mavjud boʻlsa, koʻrsatilgan taksi xizmati tomonidan taqdim etilgan boshqa yoʻllar bilan, keyingi oʻrinlarda ushbu Shartlar matnida va Xizmat interfeysida – “Naqd pul”). Koʻrsatilgan toʻlov turi Yandex.Taxi ishtirokisiz amalga oshiriladi va ushbu Shartlar bilan tartibga solinmaydi.

3.1.2. Foydalanuvchi Ulangan bank kartasidan naqd pulsiz toʻlov funksiyasidan foydalanishi mumkin (ushbu Shartlarning 3.2-bandi); bu holatda Yandex.Taxi tegishli taksi xizmati nomidan yoki boshqa asosda, toʻlovlarni qabul qilish boʻyicha vakolatli operator yoki elektron pul mablagʻlari operatori yoxud hisob-kitob operatsiyalarida yoki oʻzaro axborot munosabatlarida ishtirok etuvchi boshqa shaxsni jalb qilgan holda ish olib boradi va taksi xizmati agenti sifatida yoki boshqa maqomda toʻlovning qabul qiluvchisi hisoblanadi (keyingi oʻrinlarda – “naqd pulsiz toʻlov”). Yandex.Taxi naqd pulsiz toʻlov imkoniyatini taqdim etish boʻyicha Xizmat faoliyatida xato va nosozliklar yoʼqligiga kafolat bermaydi.

Foydalanuvchi mintaqasiga qarab, naqd pulsiz toʻlov Yandex.Taxi xizmatining oluvchi sifatidagi ishtirokisiz yoki Yandex.Taxi xizmatini hisob-kitoblarning boshqa ishtirokchisi yoki axborot almashinuvi ishtirokchisi sifatida jalb qilgan holda amalga oshirilishi mumkin.

Tegishli toʻlov shaklining tanlovi Foydalanuvchi tomonidan Xizmat interfeysida amalga oshiriladi. Shu bilan birga, agar biror sabab bilan naqd pulsiz toʻlovni amalga oshirish imkoni boʻlmasa (shu jumladan, ushbu funksiyaning texnik jihatdan vaqtincha ishlamayotgani, Ulangan kartadan foydalangan holda naqd pulsiz toʻlovni vaqtincha yoki doimiy ravishda amalga oshirish mumkin emasligi, Ulangan kartada mablagʻ yetarli boʻlmasligi va boshqalar), Foydalanuvchi naqd pul bilan toʻlash majburiyatini oladi.

Naqd pulsiz toʻlov bilan yoʻlovchi va yuk tashish xizmatining toʻliq narxi uchun bitta tranzaksiyani, shuningdek, safar davomida yoki yakunida qismlarga boʻlingan narx uchun bir necha tranzaksiyalarni amalga oshirish mumkin.

Naqd pulsiz toʻlovda, yoʼlovchilar va yuk tashish xizmati uchun toʻlov bilan bir qatorda, Foydalanuvchi oʻz xohishiga koʻra yoʻlovchilar va yuk tashish boʻyicha pullik xizmat narxining maʼlum foizi nisbatida taksi xizmati foydasiga qoʻshimcha naqd pulsiz toʻlovni amalga oshirish imkoniyatiga ega (keyingi oʻrinlarda ushbu Shartlar matnida va Xizmat interfeysida – “Choy puli”).

3.2. Ulangan bank kartasi Xizmat interfeysiga Foydalanuvchi tomonidan kiritiladi, bunda foydalanuvchi quyidagi maʼlumotlarni kiritadi:

bank kartasi raqami;
amal qilish muddati;
himoya kodi.

Agar bank kartasi maʼlumotlari toʻgʻri va amalda boʻlsa hamda Xizmat doirasida ushbu bank kartasini texnik jihatdan qoʻllash imkoni boʻlsa, koʻrsatilgan bank kartasi Ulangan statusini oladi va naqdsiz toʻlov uchun ishlatilishi mumkin. (Amaldagi Shartlarning 3.1.2 bandi) Xizmat interfeysida Barcha ulangan kartalar koʻrinadi; Ulangan karta bilan muomalada Foydalanuvchiga qulay boʻlishi uchun Ulangan karta raqamining oxirgi 4 ta raqami koʻrsatiladi.

3.2.1. Shuningdek, Foydalanuvchi Xizmat bilan integratsiyani dastaklaydigan tashqi xizmatlari interfeysiga ulangan karta haqidagi, shuningdek, ulangan karta haqidagi ma’lumotlarni Yandex.Taxiga uzatmay Foydalanuvchi tarafidan to‘lovni avtorizatsiya qiladigan hisob-kitoblar ishtirokchilari haqidagi maʼlumotlarni koʻrsatishi mumkin. Bu holatda amaldagi hujjatning 3.2 va 3.3 bandlaridagi qoidalar qoʻllanilmaydi.

Ushbu hujjatda koʻrsatilgan tashqi xizmatlardan foydalanish ushbu tashqi xizmatlarning qoidalari bilan tartibga solinadi. Yandex.Taxi Foydalanuvchining bunday tashqi xizmatlaridan foydalanishi uchun javobgar emas va bunday tashqi xizmatlarining toʻgʻri va xavfsiz ishlashiga kafolat bermaydi.

3.3. Ulangan karta qoʻshilganida, shuningdek, agar Foydalanuvchi muayyan safar uchun naqd pulsiz toʻlov funksiyasini tanlasa, Ulangan karta maʼlumotlarining aniqligi va haqiqiyligini tasdiqlash zarur boʻlgan 5 Rossiya rubli (yoki Foydalanuvchi mintaqasi valyutasidagi boshqa summa) miqdorida pul yechib olinadi; tranzaksiya muvaffaqiyatli yakunlangan taqdirda koʻrsatilgan summa Foydalanuvchiga qaytariladi. Belgilangan summani yechib olish boʻyicha muvaffaqiyatsiz urinish ushbu Ulangan kartani qoʻshish imkonsiz ekani va (yoki) mos ravishda naqd pulsiz toʻlov funksiyasi mavjud emasligini anglatadi.

3.4. Ulangan kartani qoʻshishda, shuningdek, uni qoʻshgandan keyin istalgan vaqtda Foydalanuvchi Xizmat interfeysi orqali Choy pulining birlamchi hajmini belgilash va (yoki) oʻzgartirish imkoniyatiga ega; muayyan safar uchun Choy puli miqdori ushbu safar tugaganidan soʻng Xizmat interfeysida Foydalanuvchi tomonidan oʻzgartirilishi mumkin.

3.5. Foydalanuvchi safar tugaganidan keyin 30 daqiqa ichida Xizmat interfeysida safarga ijobiy baho (4-5 yulduz) qoʻygan va “Tayyor” tugmasini bosgan boʻlsa yoki safarni ijobiy ham, salbiy ham baholamagan (birorta yulduz qoʻymagan) va “Tayyor” tugmasini bosgan boʻlsa, Ulangan kartadan (standart yoki foydalanuvchi tomonidan muayyan safar uchun maxsus belgilangan miqdordagi) choy puli yechib olinadi.

3.6. Agar Foydalanuvchi safar tugaganidan keyin 30 daqiqa ichida Xizmat interfeysida safarga salbiy baho (1-3 yulduz) qoʻygan va “Tayyor” tugmasini bosgan boʻlsa, Ulangan kartadan Choy puli yechib olinmaydi.

3.7. Agar Foydalanuvchi safar tugaganidan keyin 30 daqiqa ichida “Tayyor” tugmasini bosmasa, (standart miqdordagi yoki foydalanuvchi tomonidan muayyan safar uchun belgilangan miqdordagi) choy puli summasi Ulangan kartada 24 soatga bloklanadi, bu vaqt ichida Foydalanuvchi ushbu safar uchun choy puli miqdorini koʻproq yoki kamroq qilib oʻzgartirish imkoniyatiga ega. Belgilangan vaqt oʻtganidan soʻng Foydalanuvchi tomonidan (birlamchi yoki ushbu konkret safar uchun) belgilangan miqdorda Choy puli yechib olinadi.

3.8. Naqd pulsiz toʻlov Foydalanuvchi tomonidan toʻlovlarni qabul qilish boʻyicha vakolatli operator yoki elektron pul mablagʻlari operatori ishtirokida amalga oshiriladi va xalqaro toʻlov tizimlari, banklar (shu jumladan, Ulangan kartanining emitent banki) va hisob-kitoblarning boshqa ishtirokchilarning qoidalari bilan tartibga solinadi.

3.9. Foydalanuvchi ushbu Shartlarning 3.2 bandiga muvofiq oʻz maʼlumotlarini koʻrsatishda va keyinchalik Ulangan kartadan foydalanishda oʻz nomiga berilgan amaldagi bank kartasi toʻgʻrisida ishonchli va toʻliq maʼlumotlarni taqdim etishini; xalqaro toʻlov tizimlari qoidalariga va Ulangan kartani chiqargan emitent bankning talablariga, shu jumladan, naqd pulsiz hisob-kitoblarni amalga oshirish tartibiga rioya qilishini tasdiqlaydi va kafolatlaydi.

3.10. Foydalanuvchi oʻzi tasdiqlagan mobil telefon raqamidan foydalangan holda Xizmat doirasida amalga oshirilgan barcha amallar, shu jumladan, Ulangan bank kartasi yordamidagi naqd pulsiz toʻlovlar Foydalanuvchi tomonidan amalga oshirilgan deb hisoblanishini tushunadi va bunga rozilik beradi.

3.11. Agar Foydalanuvchi naqd pulsiz toʻlov fakti va (yoki) summasidan hamda Xizmat doirasida Ulangan kartadan foydalanish bilan bogʻliq boshqa masalalardan norozi boʻlsa, Foydalanuvchi Xizmatda koʻrsatilgan telefon raqamlari orqali va (yoki) yordam xizmati (teskari aloqa) interfeysi orqali naqd pulsiz toʻlov amalga oshirilgan yoki murojaatga sabab boʻlgan boshqa amallar yoki voqealar sodir boʻlgan kundan boshlab 14 kun ichida Yandex.Taxiga murojaat qilishga haqli.

Agar bunday murojaat boʻyicha tekshiruv natijalariga koʻra, Yandex.Taxi naqd pulsiz toʻlov summasini toʻliq yoki qisman qaytarish toʻgʻrisida qaror qabul qilsa, ushbu qaytarish naqd pulsiz toʻlov amalga oshirilgan bank kartasining bank hisob raqamiga amalga oshiriladi. Pul mablagʻlarini qaytarish tartibi toʻlovlarni qabul qilish boʻyicha vakolatli operator yoki elektron pul mablagʻlari operatori ishtirokida amalga oshiriladi va xalqaro toʻlov tizimlari, banklar (shu jumladan, Ulangan kartaning emitent banki) va boshqa hisob-kitob ishtirokchilarining qoidalari bilan tartibga solinadi. Yandex.Taxi Ulangan karta boʻyicha hisob-kitoblar ishtirokchisi boʻlmagan hollarda, Yandex.Taxi foydalanuvchilarning yuqoridagi masalalar boʻyicha murojaatlarini taksi xizmatlariga, dispetcherlik markazi yoki Ulangan kartaga oid yuqorida tilga olingan operatsiyalar boʻyicha toʻlovni qabul qiluvchi boʻlgan boshqa shaxsga uzatuvchi shaxs sifatida harakat qilishi mumkin.

3.12. Yandex.Taxi istalgan vaqtda Foydalanuvchidan Xizmat doirasida kiritgan maʼlumotlarini, shu jumladan, Ulangan karta maʼlumotlarini tasdiqlashni talab qilish va bu boradagi tasdiqlovchi hujjatlarni (xususan, shaxsni tasdiqlovchi hujjatlarni) talab qilish huquqini oʻzida saqlab qoladi. Ushbu maʼlumotlarni taqdim etmaslik Yandex.Taxi tarafidan yolgʻon maʼlumot taqdim etishga tenglashtirilishi va ushbu Shartlarning 2.5 bandida nazarda tutilgan oqibatlarga olib kelishi mumkin.

3.13. Ushbu boʻlimda koʻrsatilgan yoʻlovchi va yuk tashish xizmati uchun haq toʻlash shartlari va tartibi toʻgʻrisidagi qoidalar, agar bunday xizmat haqi Foydalanuvchi uchun Yandex.Taxi va uchinchi tomon bilan tuzilgan alohida shartnoma shartlari boʻyicha uchinchi shaxs tomonidan amalga oshirilgan holatda qoʻllanilmaydi.
